THAT PETITIOh! FOR CONDITIONAL USE PERMIT N0. 172tE BE GRANTFD
WHEREAS, the Ar.aheim City Planning Commission did receive a verified
Petition for Conditional Use Permit fram ESTATE OF LrG GOGERTY, LUDELLA GOGERTY~
EXECUTP,IX, 1311 Cliff Drive, Newport Beach, California 92663 and U-HAUL CUMPANY Uf
ORAi~GE COUNTY, u60 South Placentia Avenue, Placentia, California 92670, agent, of
certain real property situated in the City of Anaheim, County of Orange, State of
California, described as:
Lot Nos. 3, 4, $, 6 and 7, Block A, of Tract Plo. 373 as shown on a
map recorded in book 15, page 49, of Miscellaneous Maps, r~cords
of Oranye County, California; and
WNEREAS, the City Planning Commission did hold a public hearing at the CiCy
Hall in the City of Anaheim on July 6, 1977, at 1:30 p.m., no2ice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter iG.03, to hear and consider
evidence for and against said proposed conditional use and to invest!gate and make
findings and recortmendations in connection ti~ereoiitli; and
WHEREAS, said Commission, after due inspection, investigation and s„udy made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and de[ermine the fallowing facts:
1, Thac the propo~ed use is properly one for which a cond?tional use
permit is authorized by Anaheim Municipal Code Sectie~: 18.03.030.~10 to wit: to
permit truck and traller rentals.
7_, That thN petitioner stipulated there would be no outdoor stcrage, other
than the trucks and trailers.
3, That the petitioner stipulated there would be no maintenance performed
on the trucks anJ trailers other than the installation of permanent bumper-mounted
trailer hitches wliich will be done inside a building.
4. That the proposed use will not adversely affect the adjoining land uses
and the grawth an~ development of the area in wh(ch it is proposed to be located.
5, That the size and shape of the site proposed for the use is adequate to
allow the fuil developr~ent of the proposed use in a manner not detrimental to the
perticular area nor [o the peace, health, safety, and general welfare of [ha Citizens
of the City of Anaheim.
6. That the granting of the Conditional Use Permtt unc'er the conditions
imposed will no[ be detrimental to the peace, health, safety and general welfare of
the Citizens of the City of Anaheim.
7, That two (2) interested persons indicated their presence at said public
hearing; that no one indicated tlieir presence in opposition; and that no
correspondence was received in opposition to the subject petition.

EtJVIROtJ11EtJTAL INPACT FINDING: ?hat the Director of the Planning Department
has determined tha[ thc: proposed activity fails within thc definition of Section
3.01, Class 1, of the City of Anaheim Guideiines to the Requirements for an
Environmental Impact Report anJ is, therefore, categorically exempt from the
requirement to file an EIR.
NOIJ, THEREFORE, BE IT RESOIVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Corditional Use Permit, upon the fallowing
conditions which are liereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That trasli storagc areas shall be provided in accordance with approved
plans on fiie with the office of tfie Director of f'ublic Works.
2. That the two (2) existing driveways nortli of the exis[ing building
shall be removed and replaced ::?th one (1) standard commercial driveway and necessary
standard curb, guiter and sidewalk.
3. That subject property shall be developed substan[ially in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit tJo, i.
4. Tha[ Conditien t2os. 1, 2 and 3, above mentioned, shall be complied with
prior to the commencement of the activity authorized under this resolution~ or prior
to the time that the building permit is issued, or within a period of one year from
the date hereof, whichever occurs firs[, or such further time as ihe Planning
Commission and/or City Council may grant.
