NHEREAS, the City Plannin~ Comnission did hold a public hearing at the City
Hall in thc City of Anahcim on August 1, 1977, at 1:30 p.m,, nutice of said public
hearfng having been duly given as requireJ by law and in accordance wi[h the
provisions of the Anaheirn Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed reclassification and to investtgate and make
findings and recc,mmendations in conncction [herewitli; and
WIiEREAS, said Lomnission, aft~r due inspection, investiyation and study made
by i[sel` and fn fts behalf, and af[er due consideratlon of all evidence and reports
offercd at said heariny, Joes ffnd and deterrnina the follawing facts:
1. That [he pe[itioner proposes reclassificati~~n of subject property from
the CL (COMi1ERClAL, L1111TE0) ZOI~E to [hc RM-1200 (RESI~JEtJTIAL, MULTIPLE-FAMILY) ZONE.
2. That ttie Anaheim Generai Plan desiynates sub,ject property for general
comr~rc~al and/or medium-density residen[ial land uses.
3. Tha[ the above-mentioned reclassification is gran[ed on the basls that
the property will be developed substantially in accordance with plans and
specfflcations marked Exhibi[ No. 1 on file with the Planning Department.
4. That the proposed reclassifica;ion of subJect proper[y is necessary
and/or desirable for [he orderly and proper dcvelopment of the community.
5. Ttiat the proposed reclassific~ti~~n of subject property does properly
relat~ to tlie zones and tlieir permitted uses locally established in close proxlmlty

G. That the proposed reclassification of subject property requires the
dedication and improvertieni of abutting streets in accordance with [he Circulation
Element of the General Plan, due to the anticipated increase in traffic which will be
gcnerated by the incensificatio~ of IanJ use.
7. That no one indica[ed their presence a[ said public hearing in
oppositi~n; and that no correspondence was received in opposition to subjPCt
petition.
EItVIRONMEIITAL IMPACT FINDING: That the Anaheim City Planning Commissicn has
revieweJ the subject proposal to reclassify [he zoning from the CL (Cortmercial,
Limited) Zone to the R11-1200 (Residential, Multiple-Family) 2one on approximately 1.1
acres having a fronta~e of approxirtwtely 175 feec on the south side of Lincoln Avenue
ano 130 feet at the cul-de-sac terminus of Bella Vista SCreet and being located
approximately 99~ feet east af the centerlinc of Knot[ Street, and does hereby
approve a tlega;ivc Declaration from [he requirement to preparc an environmental
impact report on the basis that there would be no significan[ individual or
cumulative adverse envirnnmental impac[ due to the approval of this Ilegative
Declaratlon since the Anafieim General Plan designates tlie subject property for
general commercial and medium-density residenCial land uses commens:srate wfth the
propo5al; that no sensitive environrnental elements are involved in the proposal; that
the Init(al Study submitted by the petitioner indica[es no significant ind(vldual or
cumulative adverse environmental impacts; and that the Negative Declaration
subs[antiating [hc foreyoing findings is on file in thc City uf Anahelm Planning
Department.
PiOW, THEREFOR[, BE IT RESOLVED tfiat the Anaheim City Planning Commission
does hereby gran[ subjec[ Pe[i[ion for Reciassification and~ by so doing, that Title
18-Zoning of the Anaheim Nunicipal Code be amended to exclude the above-described
property from the CL (LOMH[RCIAL, LIMITED) ZO!~C and to incorporate saiJ described
property into the RM-1200 (RESIDEIlTIAL, MULTIPLE-FAHILY) ZONE upon the following
conditions wliich are hereby found [a be a necessary prerequisite to the proposed use
of subject property in order to prescrvc the safety and gencral welfare of the
Cit(zens of [he City of hnaheim:
1. That tt~e owner(s} of subject property shall deed to the City of Anaheim
a fifty (50) foot radius fros~, 2he center of the cul-de-sac.
2. Tha[ siJeo-ialks shall bc installed along Bella Yista Stree[ as required
by Che City Engineer and in accordance with s[andard plans and specifications on file
in the Officc of the City Engineer.
3. Tha[ street ligtiting facilities alony Lincoln Rvenue and 3ella Vist~a
Street shall be installed as required by the Director of Public Util(tie.s and in
accordance with standard speciffcations on file in Lhe Office of the yirector of
Public Utlllties; and/or that a bond, certificate of deposit, let[er of credit, or
cash, in an amount anJ form satisfactory to tlie City of Anaheim, shall be posted with
tlie City to guarantec the (nstallation of the abovc-mentioned requirements.
4. That the ov~ner(s) of subject propcrty shall pay to tfie CfCy of Anaheim
the sum of sixty (60) cents per front fooi along lincoln Avenue and Bella Vista
Street for Cree plantinc~ purpo5es.
5, That subject property shall be served by underground utilities.

6, That drainage af subject property shall be disposed of in a manner
sattsfactory to ths i.ity Engineer.
7. That the owner(si of subject praperty shall pay [o the City of Anaheim
t~e appropriate park and recreation in-lieu fecs as determined to be ap{~ropriate by
the Ci[y Council. said fees to be paid at the time the building permit is issucd.
8. That the owner(s) shall apply for, and pay all costs of, an abandonmen[
by the City of Anahein of the vehicular access rights to Bella Vista Strcet.
9, That fire fiydrants sfiall be installed and charged, as re~uired and
determined to be necessary by the Chi~f of the Fire Department, prior to commencement
of structural framing.
10. That appropri3te waccr assessment fees, as detcrmtned by thc Director
of Public Utilities, shall be paid to the Ci[y of Anaheim prior to the issuance of a
building permit.
11, That trash storage areas shall be provided in accordance with approved
plans on file with tfie Office of ttie Director of Public 1Jorks.
12. That the subject property will be developed substantially in accordance
with plans and specifications marked Exh:bit ~~o. 1 on file with the Planning
Department.
13. Prlor to the introduction of an ordinance rezoning subject property,
Condition Nos. 1, 3 and 4, abovc rtx:ntioned, shall be completed. Thc provisions or
riqhts grant~d by this resolution shall becomc null and void by action of the
Plann(ng Comrission unless said conditions are complied with within one Ye.rr from the
date hereof, or such fur[her time as [he Planning Lommission may gran[.
14, That Condition Ilos. 2, 5, ~, R, 11 and 12, above mentioned, shall he
complied with prior to final buildiny and zoning lnspections.
