RESOLUTION NO. 7lR-123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ADOPTING THE RECO~mNDATION OF THE
PLANNING CO~~ISSION IN APPROVING THE OR&~GE-
BLUE ROUTE OF FREEWAY 39 THROUGH THE CITY OF

"VvHEREAS p heretofore, on January 7 and February 2, 1971,
the Planning Commission of the City of Anaheim did hold public
hearings in connection with the alternate routes of Freeway 39
through the City of Anaheim; and
WHEREAS, the City Council of the City. of Anaheim did
hold a public hearing in connection with said alternate routes of
said Freeway on March 30~ 1971, and has reviewed the recommenda-
tion of the Planning Commission thereon; and
WHEREAS, the City Council, after said public he.aring!
finds that it would be in the best interests of the City of .
l~naheim to uph.old the reconunendation of the Planning Commission.
~ow, THEREFORB, BE IT RESOLVED by the City Council of
the City of An~~eim that it adopt as its recommendation to the
Highway Commission of the State of California, and it does hereby
adopt the recommendation of the Planning Commission of the City
of Anaheim as follows;
::NO"rl}' 'rHEREFORE, BE IT RESOLVED that the Planning
Commission of the City of Anaheim does hereby adopt and
recommend to the City Council of the City of Anaheim the
adoption of the Orange-Blue Route for the proposed High-
way 39 u'" Huntington Beach Freeway.
;;BE I 'll FURTHEI{ RESOLVED that in the consideration of
the design criteria for the freeway route, careful con-
sideration and adoption of the following should be the
minimums in adoption of the freeway design:
:. 1. fj,'l1.at the State rlighway COnL"'1lission acquire sufficient
right'-of-way in order tl'1at t.he freeway could be con-
structed below-grade or that landscaping and" berming
may be inst.alled thereby providing sufficient distance
between the noises and odors from the freeway traffic
and the residential uses that are adjacent to said
freeway.
;; 2. :i'hat the State Highway Conunission provide adequate
space sufficient in size for future rapid transit
system.
;; 3. That tlle State Highway Commission construct the free-
way below-grade or a depressed freeway; howeverr
should conditions exist that would render it impos-
sible to construct a fully below-grade facility,
either a partially depressed route combined with
landscaped berming on both sides of an at-grade
freeway with fully landscaped earth berms in order
to minimize tI1e noise and detrimenta.l effects to
the adjacent residential areas.

.~ 4. That the State shall provide monies to schools
and libraries adjacent to the adopted route which
may be used to adequately buffer the buildings
from noises from the freeway; and further, that
additional dense landscaping be provided along the
freeway right--of'-way adjacent to said schools and
libraries to further buffer the noises.
.~ 5 . 'rhat the City should exercise its prerogative by
requiring the design to be acceptable prior to
executing any freeway agreements on the route, in
order that the freeway will create the least possi-
ble disruptive effects on the community.
~:BE IT FURTHER RESOLVED that the .City Council
give consideration to the feasibility of acquiring from
the State large remnant parcels or groups of parcels which
may be combined to form small neighborhood parks - parti-
cularly at on and off-ramps - said parcels to be a mini-
mum of five acres, or of sufficient size, since the City
could e~iminate many possible eyesores thereby creating
for the citizens of adjacent residential areas and addi-
tional noise and visual buffer zone, and at the same time
expand the City park land system. if
AND BE IT FURTHER RESOLVED that a certified copy of
thi.s Resolution be presented to the Highway Commission of the
State of California at the public hearing scheduled by the State
at Buena Park on the evening of March 3l, 1971.
~HE FOREGOING RESOLUTION is approved and signed by me
this 30th day of March, 1971.
