use permit i s authorized by Anaheim Municipal Code Section 1 s 1 L . to
wit: to permit a drive-through restaurant, with a waiver of

2m That the proposed conditional use permit and waiver is
granted on the basis that similar waivers have peen previously granted for
drive ®through restaurants having sit- down facilities and subject to the
petitioner's stipulation to summit a revised interior circulation elan for
Planning Commission reviey' and approval prior to the issuance of h'fi 1ding
permits, said plan showing adequate hack un space for vehicles ente r i nn the
property and lining un kat suh ect drive-through restaurant.
m That the aroposed use will not adversely affect the adjoining
land use and the growth and development of the area in which i t is
p ropes ed to IYe located.

Commission has reviewed the suh ! ect proposal for a dr i ve- through restar.arant
with .jaiver of minimum numher of parking spaces on annro? imately L7 acre
located north and !west of the northwest corner of La Palma Avenue ' and State
College Boulevard, and having anproximate frontages of 7t;'? feet on the
north side of La Palma I!venue and 7R3 feet nn the ,rest side of State
College Boulevard, and does hereby approve the Negative f)eclaration from
the requirement to nrep<lre an environmental impact report on the i s s that
there would he no significant individual or cumulative adverse
environmental impact due to the approval of this Negative i)ec l ara t i on since
the Anaheim General Plan designates the suhject pronerty for general
commercial land uses commensurate with the proposal; that no sensitive
environmental impacts are involved in the proposal; that the Initial Study
submitted by the petitioner indicates no significant individual or
cumulative adverse environmental impacts; and that the Negative Declaration
substantiating the foregoing findings is on file in the City ofAnaheim
P l a n n i n g Department.
