WHERE115, the Anaheim City Planning Commission did receive a verified
petition for Reclassification from THELPIA I. IJINTER, 125~1 Jane Drive, Garden C,rove,
California 92641, owner, and BILL PHELPS, 1045 ~~. Main Street, Suite S, OranaE,
California 926~7, agent, of certain real property situated in the City of Araheim,
County of Orange, State of California, described as folloo-~s:
The Nor[herly 150 feet of the Westeriy 170 feet of the West 2 1/2
Acres of thc 5outh 1/2 of the Southwest quarter of the So~thwest
quarter of the Southeast quarter of Section 14, Township 4 South,
Range 11 Wes[, S.B.B.S M.; and
WHEREAS, tfie City Planning Commission did hold a public hear~ng at [he City
H~11 in the City of Anaheim on September 11, 1~77, a[ 1:30 p.m., notice of said
public hearing having beer duly given as required by law and in accordance with [he
provisions of the Anaheim Municipal Lode, Chapter 1£3,0;, to hear and consider
evidence for and against said prop~sed reclassification and to inves[igate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due insnection, investigaCion and study made
by itself and in its behalf, and af[er due consideration of all evidence and reports
offered at said hearin9, does find and determine the following facts:
1. Tha[ the petitione:- proposes reclassification of subject pr•operty from
the Rs-n-43,OOU (RESICENTIAL/AGRICULTURAL) Zone to the P,1•i-12~0 (RESlDEFITIAL,
MUL7IPLE-FA"iILY) Zone.
2. That the proposed reclassification is hereby granted subject to
petitioner's stipulation to providing an 8-foot hign block r~all on the north property
line abu[ting residential/agricultural zoning.
3. That the pr~posed reclassification of s~bject property is necessary
and/or desirable for the orderly and proper development of the community.
4, Tha[ the proposed reclassification of subject property d~es properly
relate to the zones and their permitted uses iccally es[ablished in close pror.imity
to sub)ect property and to the zones and their permitted uses general!y established
tliroughout the community.
5. Tha[ the proposed reclacsification of subject property requires the
dedication and improvenent of abutting streets In accordance Y~ith the Circulation
Element of the General Plan, due to the an[icipated incrEase in traffic which wi11 be
generated by the in[ensification of land use.
6. Ttiat 7 people indicated th~ir ~resence at said public heartng in
oppo5ition; and that no correspondence was received in opposition to subject
petition.

reviev~ed the subje~t proposal to reclassify the subject property ~rom RS-A-43,000

(RESIDEtlTIAL/AGRICULTURAL) to RN-1200 (RESIDENTIAL, MULTIPLE-FAPIILY) Zonc on proper[y
consisting of approximately 0.4 acre having a frontage of approximately 150 feet on
the east side of Western Avenue and having a maximum depth of approximately 125 feeC,
being located approximatety 17~ feet north of the centerline of Ball Road; and does
hereby approve the ~~egative Declaration fr~m [he requirement to prepare an
environmental impact report on the basis that there would be no signiflcant
individual or cumulative adverse environmental impact due [o the approval of this
Ne9ative Declaration since the Anaheim General Plan designates the subject property
for medium-density residential land uses co~nensura[e with the proposal; that no
sensitive environmertal impacts are involved i~ th~ proposal; that the Initial Study
submitted by the petitioner indicates no significant individual of cumulative adverse
environmental impacts; and that the ~~egative Declara[ion substantiating the foregoing
findings is on file in the Ci[y of Anaheim ~lanning Department.
FlOk', THEREFORE, BE IT RESOLVED that [he Anaheim City Planni~g Commission
does heret~y grant suhject Peti[ion for Reclassificition and, bv so doing, that Title
18-Zoning of the Anaheirn Municipal Code t>e ~mended to exclude the above-described
property from the RS-A-4;,000 (RESIDE~JTiA VAf,RICU~TURAL) I~tiE and co incorporate said
described property into the Rt+-1200 (RESIDEtJTI~I, MULTIPLF.-FA'i1LY) ZOt7E upon the
foliowinn conditions which are nereby found to 6e a nccessary prerequisite to the
proposed use of subject propcrty in order to preserve the safety arid general welfare
of the Citizens of the City of Anaheim:
1. That all engineering requirements of thc City of Anaheim along Western
Avenue, including prepara[ion of improvement plans and installation of all
improvements such as curhs and gucters, side~.~alks, s[reet yrading and paving,
drainage facili[ies or other anpurtenant work, shall be conplied with as required by
the City Engineer and in accordan:e o-rith standard plans and specifications on file in
the Office of the City En9ineer; that stree[ ligh[ing facilities along Western
Avenue shall be ins[alled as required by the Director of Public Utilities, and in
accordance +aith standard plans and soecifications on file in the Office of the
Director of Public Utilities; and/or that a bond, certificate of depo5it, let[er of
credit or cash, in an amount and form sa[isfactory to the City of Anaheim shall be
posted with the City to guarantee the ins[allation of thc above-mentioned
requirements.
2. That [he ot•mer(s) of subject property sh~ll pay ta Che City of Anaheim
the sum of 60 cen[s per front foot along Western Avenue for cree planting purposes.
3, That trash storage areas shall be provided in accordance with approved
~tans on file with the Office of the Director of Public 4lorks.
4. Tha[ fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of [he Fire Department prior to commencement
of structural framing.
5. That subject property shall be served by underground utilities.
6. That drainage of suhject property shall be disposed af in a manner
satisfactory [o the City En31n-:er.
7, That the owner(s) of subject prnper[y shall pay to :fie City of Anaheim
the appropriate park and recreaticn in-lieu fe.es as determined to be appropriate by
[he City Council, said fees to be paid at the time the building permit is issued.

8. That the subject property shall be developed substantialiy in
accordance with plans and specifications on file with the City of Anaheim marked
E~hibit ~dos. 1, 2 and 3; provided, however, that an 8-foot high biock watl shall be
constructed along the north property line.
9. Prior to the introduction of an ordinance rezoning subject proper[y,
Condition Nos. 1 and 2, above-mentioned, shall be completed. The provisions or
right> granted by this resolution shall become null and void by action of the
Planntng Commission unless saiJ conditions are complied with within one year from the
date hereof, or such further time 2s the Planning Commission may grant.
10. That Condition Nos. 3, 4, and 5, above-mentioned, shall be complied
with prior to final buiiding and zoning inspections.
