Avenue, Anaheim, California 92001, agene, of certain real property situated in the
CiCy of Anahein, County of Urange, State of California, described as:

edge of Lincoln Avenue, and more specifically described as being

WHCREAS, the City Planniny Commission did hold a public hearing a[ [he City
liall in the City of Anaheim on Septernber 12, 1977, at 1:30 p.m., notice of said
public heariny having been duly qiven as required by law and in accordance with [he
provisions of the Anaheim I~tunicipal Code, Chapter 18.03, to hear and consider
evidence for and ayainst said proposeJ reclassification and to investigate and make
findings and recommenda[ions in connec:ion [fierewith; an~J
IIHEP,EAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, anc! after due consideration of all evidence and reports
offered at said liearin9, does find anJ Jetermine ttie folla~ing facts:
1. Tliat the petitiuner proposes reclassifica[ion of subject property from
the RS-A-43,000 (RESIDEtITIAL/AGRICl1LiURl1L) ZOtIE to the CL (CCMPIERCIAL, L1141TED) ZOP1E.
2. That the Anahcim General Plan designa[es subject property for general
commerciel land uses.
3. That tfie proposed reclassification of subJect property is necessary
and/or aesirable for the ordcrly and proper development of the community.

4. Tha[ the proposed reclassificaiion of subject property does properly
relate to the zones and their pernitted uses locally established in close proximity
to ~ubject proper*_y an~ [o the zones and thcir permitted uses generally established
throughout the comrnur.i ty.
5. That no one indicatea th~ir presence at said public hearing in
opposition; and that no correspondence was received in opposition to subject
petition.
EUVIROtJM[NTAL IMPACT FINDItIG: That the Anaheim City Planning Commission has
reviewed [he subj~c[ proposal [o reclassify Lhe zoning from RS-A-43,0~0
(Residential/Agricultural) to CL (Commercial, Limited) on property consisting of
approxima[ely 0.3 acres, haviny a frontage of approxim3tely &0 fee[ on tfie north side
of Lintoln Avenue, being low ted approximately 560 feet west of the centerline of
Deach Boulevard, to establish an art yallery and s[ud9o in an existing single-family
residence in the CL (Commercial, Limited) Zoric, with waiver of minimum front setback;
and does hereby ~pprove the fleya[ive Declaration from the requirenen[ to prepare an
environmental impact report on the basis tnat there would be no significant
individual or cumulative adverse environmentat impac[ due to the approval of this
i~egative Declaration sincc the Analieim General Plan designates the subject property
for general comm~.rcial land uses conaaensurate with the proposal; that no sensiCive
environmental impacts are invoivcd in t`~e proposal; that tFie Initial Study submitted
by [he petitioner indicates no significan[ ;ndividual or cumulative adverse
envi~oninen[al impacts; and that the Flegative Declaration substantiating the foregoing
findings is on file in the City of Anaheim Planning Department.
N04l, THER[FORE, BE IT RESOLV[U [ha[ the Anahcim City Planning Commission
does hereby grant subjeci Petition for Reclassification and, by so doing, tliat 7itle
18-Zoniny of the Anaheim Municipal Code be an,ended to exclude the above-described
property from thc RS-A-~+3,OU0 (RESIL'EIITIAL/l1GRICULTURl1L) ZOt~E and to incorRorate said
described property into tl~e CL (COHMERCIAL, LIMITED) ZOlIE upon the followin~
c~ndition which is hereby found to be a necessary prerequisite to the proposed use of
subjeGt property in ordcr [o preserve the safety and 9encral welfarc of the Citizens
of thc City of Anaheim:
1, That prior to ttie introduction of an oruinance rezonin~ subject
property, the o~mer(s) af subjec[ property shall pay to the Ci*.y of Anaheim the sum
