WHEREAS, the AnahEim Clty Planning Commissio~ did receive a verified
petition for Reclassification from SHERRILL J. POHLMAt1N, ET AL, 2333 Nest Lincoln
Avenue, Anaheim, California 928C1, owner, and A.S.A..W.A, CORP., 540 ~~orth Golden
Circle Drive, 5uite llk, Santa Ana, California 9270>, a~ent, of certain real property
si[uated in the City of Anahein, Coun[y of Orange, State of California, described as
follows:
That pcrtion of the East half of [he Wcst half of thc Southvrest
Quarter of the Southeas[ Quarter of Section 7, Townstiip ~+ South,
Range 10 West, in the Rancho Los Coyotes, as shown on a map
recorded in book 51, page 1'J of Miscellaneous Maps, recurds of
Orange County, Califorria, descrined as Farcels tJo. 1 and 3, as
shown on a map, filed in book 31, page 49 of ?arc-.et Maps, in the
officc of the County Recorder of Orangc Coun[y, California.
WH[REAS, the City Planning Lc,nx~ission did hold a public hearin9 at [he City
Hall in the City of Anaheim on October 26, 1?77, at ~:3~ p.r:., notice of said public
hearing having been duly glven as required by law and in atcordance with the
provisions of the Anaheim Municipal Codc, Chaptcr 13.03, to hear and consider
evfdence for and against said pr~posed reclassificatt~n and to investigate and make
findings and recommendatlons in connection therewith; and
WNEREAS, sald Lommission, afcer duc inspection, investiga[ion and study made
by itself and in its behalf, arid after due consideration of all evidence and reports
offered at sald hearing, does find and dctermine the folloo~inq facts:
1. That [he petltioner proposes reclassifica[ion of subJect property from
the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) 7.!?NE to chc Rr-1?0~ (RESIDEN7IAL,
MULTIPI.E-FAMILY) ZO?~E.
2. Tha[ the Anahelm General Plan desi9nates subject property for general
commercial and/or medium density residential land uses.
3. That the proposed reclassification of subject propcrty is necessary
and/or desirable for the orderly and propcr devclopment of the community.
4. That the prooosed reclassification of subJect property Joes properly
relate to the zones and their permltteed uses locall~ established ln elose proximity
to sub]ect pr~pcrty and to the zones and their pcrmitted uscs generally established
thraughout thc community.
5. That the proposed reclassification of subject property requlres the
dedication and improvemen[ of abutting streets in accord-ance with the Circulation
Element uf the General Plan, due to the anticipated Increase in traffic which wi11 be
generated by the intensiffcation of land use.
G. That one person indtcated [heir presence at said public hearing in
opposition; and [hat np correspondence was recelved fn opposition to subject
petition.
ENVIROtINEPITAL IMPACT FINDING: Tha[ the Anahetm City Planning Ca~rnisslon has
revlewed the suhJect p~oposal to reclassify the property from the P,S-A-43,000
(Resider,tial/Agricultural) Zone to tlie RM~-1200 (Residential, Mult(ple-Family) Zone to
establish a f,-lot, RM-1200 ~ubdivislon with walvers of mar,imum structural height and

minimum recreational-leisure area on property consisting of approximately 1.4 acres
located at the northeast and northriest corners of Lincoln Avenue and Belinda Clrcle,
having approximate frontages of 1~5 feet on the north side of Li~coln Avenue and
Belinda Circte, east and west of Belinda Circle, and being located approximately 330
feet east of the centerline of Gilbert Street; and does hereby approve the Negative
Declaration from the requirement to prepare an environmental i~pact report ort the
basis chat there would be no significant individual or curulative adverse
environmentai impact due to the approval o` this Negative Declaration since ihe
Anaheim General Plan designates the subject property for general commercial/medium
density r^sid~r~tal land uses comrnensurate with the proposal; that no sensitive
environmental impacts are involved ~n the proposal; that thc Initial Study submf'ted
by the pet~tioner indicates no significant individual or cumulative adver,e
e m ironmen[.1 impacts; and that the I~eqative Qeclaration substantiating the foregoing
findings ~s ~~n file in the City of Anafieim Planninq Department.
NOk', THEREFORE~ dE IT RESOLVED that thc Anaheim City Planning Lommission
does hereby grant subject Petition for Reclassificat~un and, by so doing, that Title
13-Zoning of the Anatieim Municipal Code be amended to exclude the above-described
propcrty from the RS-A-43,0~0 (RESI~ENTIl+L~AGRICULTUP.AL) 7.ONE and to incorporate said
described property ~nto the RN-1200 (RESIDEIITIAL, MIILTiPLE-FA`1ILY) ZOt7E upon Yhe
following conditions which are hereby found to be a necessary prerequisite to the
proposed use o` subject property in order to preservc the safety anct general welfare
of the Citizens of thc City of Anaheim:
1. That fire hydrants shall be installed and charged, as required and
determined to be necessary by the Chief of tlie Fire Department, prior to commencement
of structural framing.
2, That subject property shall bc scrveJ by under~round utilities.
j, That dr~inage ~f subject propr_rt/ s~~all be disposed of in a manner
satisfactory to the City E~gineer.
4, In the event that subJect property is to hc divided for the purpose of
sale, lease or financing, a parcel map, to record the aoproved dlvision of subject
property, shall be submitted to and approved by the City of Anaheim and then be
recorded in the Office of the Orange Coun[y Recorder.
5, Tha[ thc owner(s) of subjec[ propcrty shall pay to the City of Anahelm
thc appropriate p~rk and recreation in-licu fees as determined to bc appropriate by
thc Ci[y Council, said fces to bc p~id a[ thc time the buitding permit is issued.
G, That Condition Nos. 2 and 3, above mentioned, shall be co^~plied with
prior [o final huilding and ~r,,;iiny insaections.
