A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR VARIANCE NO. 2062 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Variance from WRATHER INNS, INC., 1855 South Harbor Boulevard, Anaheim,
California 92302, owner, and ANDREW SCHWEBEL, 1150 West Cerritos Avenue, Anaheim,
California 92802, agent, of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as:
THE EAST HALF OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF
SECTION 27, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO SAN
JUAN CAJON DE SANTA ANA, AS SHOWN ON A MAP RECORDED IN BOOK 51,
PAGE 10 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY,
CALIFORNIA.
EXCEPTING THEREFROM THE NORTH 453 FEET THEREOF.
ALSO EXCEPTING THEREFROM THE WEST 4.00 FEET OF THAT PORTION
THEREOF LYING NORTHERLY OF THE NORTH LINE OF THE SOUTH 10 ACRES OF
SAID EAST HALF.
ALSO EXCEPTING THEREFROM THE EASTERLY 60 FEET THEREOF LYING WITHIN
THE RIGHT OF WAY OF HARBOR. BOULEVARD; and
WHEREAS, the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on October 10, 1977, at 1:30 p.m., notice of said
public hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 13.03, to hear and consider
evidence for and against said proposed variance and to investigate and make findings
and recommendations in connection therewith; said public hearing having been
continued to the Planning Commission meeting of November 7, 1977; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the petitioner proposes a waiver of the following to construct
three parking- ticket booths:
SECTION 13.04.045.011 - Minimum structural setback.
(50 feet required along Harbor Boulevard;
43 & 15-3/4 feet proposed)
2. That the above - mentioned waiver is hereby granted on the basis that the
petitioner demonstrated that a hardship exists in that subject property is a large
fully developed parcel with existing driveways; that problems have been caused by the
uncontrolled use of the parking lots on subject property because of the proximity of
the Anaheim Convention Center and parking- ticket booths would he a solution to said
parking problems; and that because the proposed booths are small in floor area (3n
square feet) and height (7 -1/2 feet), there will he a minimal visual obstruction
within the setback area.
3. That the above- mentioned variance is hereby granted subject to
petitioner's stipulation to providing angled curbing adjacent to the most northerly
ticket booth on Harbor Boulevard to prohibit vehicular entrance to the site at that
location.

4. That there re exceptional or extraordinar' ircumstances or conditions
applicable to the properly involved or to the intended use of the property that do
not apply generally to the property or class of use in the same vicinity and zone.
5. That the requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
vicinity and zone, and denied to the property in question.
6. That the requested variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located.
7. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL IMPACT FINDING: The Director of the Planning_ Department has
determined that the proposed activity falls within the definition of Section 3.01,
Class 5, of the City of Anaheim Guidelines to the Requirements for the Environmental
Impact Report and is, therefore, categorically exempt from the requirement to file an
EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Variance, upon the following conditions which
are hereby found to be a necessary prerequisite to the proposed use of the subject
property in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
1. That adequate vehicle storage space he provided along Harbor
Boulevard, as required by the Traffic Engineer.
2. That subject property shall he developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit No. 1;
provided, however,that angled curbing be provided adjacent to the most northerly
ticket booth on Harbor Boulevard to prohibit vehicular entrance to the site at that
location.
3. That Condition Nos. 1 and 2, above mentioned, shall be complied with
prior to final building and zoning inspections.
THE FOREGOING RESOLUTION is signed and approved by me this 7th day of
November, 1977.
