A RESOLUTION OF THE ANAHEIM CITY PLANNING COI MISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 1773 PE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from FOREMOST- DAIRIES, INC., One Post Street,
Crocker Plaza, San Francisco, Caliifornia, 1410 owner, and BYRON L. CRUME AND
VERNON W. MONROE, 5209 Seashore Drive, Newport Beach, California r92GF3, agents, of
certain real Property situated in the City of Anaheim, County of Orange, State of
California, described as:
That portion of the northwest nuarter of the northeast quarter of
the northwest quarter of Section 23, Township 4 South, Ranee 1°
West, in the Rancho San Juan Cajon de Santa Ana, in the City of
Anaheim, County of Orange, State of California, as per map
recorded in Book 51, Page 10 of Miscellaneous Maps, Records of
Orange County, described as follows:
Beginning at a point on the easterly line of parcel ( as per map
filed in Book 27, Page 44 of Parcel Mans, records of said County
distant thereon North 0 10' 12," West 6(0.51 feet from the
Southwest Corner of the Northeast quarter of the Northwest quarter
of said Section 23; thence alone said easterly line of said parcel
map number 27/44 North 0 10' 18" West r 07.51 feet to the
Northeasterly corner thereof, said point being on the Southerly
line of Ball Road, 10r, feet wide, as shown on said parcel map;
thence along said southerly line North '9 8' 09" East 20.00
feet to a line parallel with and distant easterly 20.00 feet,
measured at right angles from said easterly line of said parcel
map number 27/44; thence along said parallel line South 0° 10'
1"" East 417.60 feet; thence North " 5 41" East 330.40 feet;
thence South 0 10' 1`3" East 189.91 feet; thence North 39° 5"'
41" West 359.40 feet to the point of beginning.
Containing 76,'05 square feet, or 1.75 acres, more or less.
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on November 21, 1977, at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 1`8.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and make
findings and recommendations in connection therewit'-; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use
permit is authorized ky Anaheim Municipal Code Section r.(1.°5°.5°7 to wit: to
permit a truck storage yard.
2. That the proposed use will not adversely affect the adjoining land uses
and the growth and development of the area in which it is proposed to ke located.
3. That the size and shane of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anaheim.

4. That the ranting of the Conditional Use °ermit under the conditions
imposed, if any, will no >e detrimental to the peace, h .th, safety and general
welfare of the Citizens of the City of Anaheim.
5. That no one indicated their presence as said public hearing in
opposition; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL IMPACT FINDING: The Director of the Planning Department has
determined that the proposed activity falls within the definition of Section 3.01,
Class 3, of the City of Anaheim Guidelines to the Requirements for an Environmental
Impact Report and is, therefore, categorically exempt from the requirement to file an
EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. In the event that subject property is to be divided for the purpose of
sale, lease, or financing, a parcel map, to record the approved division of subject
property, shall be submitted to and approved by the City of Anaheim and then be
recorded in the office of the Orange County Recorder.
2. That trash storage areas shall be provided in accordance with approved
plans on file with the Office of the Director of Public Works.
3. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Fire Department prior to commencement
of structural framing.
4. That the owner(s) of subject property shall pay to the City of Anaheim
the sum of $3.50 per front foot along Ball Road for street lighting purposes.
5. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1
and 2.
6. That Condition Nos. 1 and 4, above- mentioned, shall be complied with
prior to the commencement of the activity authorized under this resolution, or prior
to the time that the building permit is issued, or within a period of one year from
date hereof, whichever occurs first, or such further time as the Planning Commission
may grant.
7. That Condition Nos. 2 and 5, above- mentioned, shall be complied with
prior to final building and zoning inspections.
THE FOREGOING RESOLUTION is signed and approved by me this 21st day of
