WH[REAS, the Anahcim Ci[y Planning Commission did receive a vPrified
Petition for Variance from MARGARET M. D03ROSK1, lt092 Headowbrook SLrePt, Orange,
California 92665, awner, and BETTY L. TIDWELL, 70~ East ~~orth Stree[, Hnaheim,
California 9'1801, agent, of certain real property situated in the City of Anaheirn,
County of Oranye, State of California, described as follows:
Lot 10 in Block D of Tract 247, as per Map recorded in aook 13,
Page 51 of Maps, in the office of the County Recorder of said
Lounty; and
Wl1EREA5, the City Planning Lor,mission did hold a public hearing at thc City
Hall in the City of Anahuin on December 5, 1977, at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 1£,.03, to hear and consider
evidence for and ayainst said proposed variance and to investigate and make fi~dings
and racommenda[ions in connection therewith; and
WHtREAS, said Corru~issio~, aftcr due ir~spection, investigation and study made
by itself and in its behalf, and aftcr due consideration of all evidence and reports
offered at said fiearing, does find and determine the following facts:
i. That the petitioner proposes a waiver of the following to permit two
singte-family residences on a lot:
(a) SECTIOIJ 1E.~2.062.031 - Minimum floor area. (1225 square feet

2. That ihe oroposed waiver (a) is hereby granted on the basis that the
existing houses In [he surroundin9 neigfiborhood are of a stmilar sizc.
3, That th~e proposed waivers (b) and (c) are hereby granted on the basis
that the driveway and garage are existing and that similar paricing and vehicular
access are provided to existing dwellinys in the area,
4. That there are exceptional or extraordinary circumstances or conditions
applicable ta the property involved or to the intended use of the property that do
not apply generally to the property or class of use in the same vicinity and zone.

5. That the re~uested variance is necessary for the preservation and
enjoyment of a substantial proper[y rigFit pcssessed by other prop.erty in the same
vicinity and zone, and deinied to the property in question.
G. That [he reouested variance will not be mater"i•ally detrimental to thc
public welfare or injurious to the property or improvements =n such viciRity and zone
in which [he property is locaied.
7. That no one indicated their presen~e at said ~ublic hearing In
opposition anJ one person indicated his presence in support of subjec[ petition; and
that no corresp~nJence was received in opposition t~ the subject petition.
ENVIRONIIENTAL INPACT FlNDIIJG: That tte~ Director of [he Plan~ing Department
has determined that the proposed activiCy f.alls within the defbnition of Sec[ion
3.01, Class 3, of the City of Anaheim Guidelines to the Requirements for an
Environmental Impact Report and is, therefore, caieyorically exempt from the
requirement to file an EIR.

is hereby fou~d to be a necessary prereq~isite ta ihe proposed use of the subJect

1. Tha[ subject property shalt be Jev~lo~?ed substantially in accordance
with plans and specifications on file wi[h the City of ~`~naheirn marked Exhibit tJos. 1
and 2.
