WHEREAS, said Ccxnmission, after due inspectlon, investigation and study made
by Itself and fn Its behalf, and after due cor,sl:~.eratlon of all evidence and repor[s
offered at sald hearing, dues find and determine the following facts:
1. Tha[ the proposed usc Is properly one for which a condltional usP
permit ls authorized by Anahelm Munfclpal Code Settfon 18.45,050.090, to wit: pernit

2. Tha[ the above-mentloned walvers are her~~y denled on the basis that
the petitioner dld not demonstrate that a hardshlp would be created if sald watvers
were not granted.
3, That, furthermore, the proposed conttnued use of the existina bt{tboard
is hereby denled on the basls that prevlous approval for the billboard allowed the
pettCloner to recover the expenses fnvolved tn the tnittai construction of the
biliboard for which a building permit was issued in error, th~c oetltloner having
requested two years for thc recovery of sald expenses and a total of ihree years
having been previously granted; that, furthermore, the subJect billboard ts exfsting
withln the Center City Area which fs speclfically excluded by the 2ontng Code as a
permissible locatlon for billboards; and, thercfore, the Plnnnfng Commission docs
hereby determine that [he subJect locatlon Is inappropriate Por E'1lboards.
4. That the proposed use wlil adversely a?fact tEe adJolning land uses and
the growth and development of the aree in which 1t Is proposed to be located.
5. That the size and shape of the site proposed for the use is not
adequata to allow ths full davelopment of ttic propased usc in a manner not

detrimental to the particular area nor to the peace, healih, safety, and general
welfare of the Cit{zens of [he City of Anahetm.
6. That the granting of thc Conditlonal Use Permit will be detrtmental to
the peace~ health, safety and general welfare of the Citizens of the Ctty of Anaheim.
7. That no one Indlcatnd their presence at said publlc hearing in
oppositlon; and that one (1) ietter was recelved in opposition to the subJect
petition.
ENVIRQNMENTAL IMPACT fINDING: That the Director of the Planning Department
has detcrm ne t at t e propose act v!ty falls Nithin the definitlon of Sectlon
3.01, Ctass 3, of the Ctty of Anahcim Guideltncs [o the Requiremenls for an
Environmental Impact Repori and Is, Lherefnre, categorically exempt from the
requiremenc to file an EIR.
NOW, THEREFORE~ BE IT RF.SOLVED that the Anaheim City Planning Commission
does hereby deny subJect Petitlon for Conditlonai Use Permic on the basls uf the
aforementioned flndings.
