A RESOLUTION OF THE ANAHEIM CITY PLANNING COMHISSION
THAT PETITION FQR CONDITIONAL USE PERHIT N0. 1925 BE GRA!lTED
NHEREAS, the Rnahe(m Ctty Planning Commission did recelve a verifled
Petition for Conditlonal Use Permi[ from ANAHEIM REDEVELOPMENT AP,ENCY, 106 North
Claudina, Anahetm, Californla, 92a05, owner, and ROBEP,T E. BE~ITLEY, ~~33 West Lincoln
Avenue, Anaheim, Gal)fornla 92805, agent, of certain real property situated in the
City of Anahcim, County of Oran~e, State of California, describe~ as:

WFiEREAS~ the City Plannfng Commission did hold a public hearing aC the City
Hall in the Li[y of Anahefm on January 15, 1979, at i:3n p,m., nottce of said public
hearing having been duly g(ven as required by la~•~ and tn accordance wi[h the
provisfons of the Anaheim Municipal Code, Chapter i8.03, to hear and consider
evidence for and against said proposed variance and to investtgate and make ftndings
and recornendations in connection therewtth; and
WNEP,F.RS, said Commfssion, after due inspection, investigatlon and study made
by Itself and in its behalf, and after due consideration of all evtdence and reports
offered at said hcaring, does find and determine the followtng fac[s:
1. That [he proposed use is properiy onc for which a conditional use
permit fs au[horized by Anaheim Muntclpal Cod~ Section 13.03.030.~10 to wit: to
permit an insurance office in a residentlal s[ructure.
That the proposed use Is hereby qranted for a period of onc year.
3. That the proposed use, as temporar(ly granted, will not adversely
affect the adJoining land uses and Lhe growth and developme~t of the a~ea in whTch it
is proposed to be located.
k. Tha[ the slze and shape or the site proposed for the use, as
temporarily granted, is adequate to altow the full development of the proposed use ln
a manner not detrimental to the par[icular area nor to the peace, hea![h, safety, and
general welfarc of the Cttizens of the Ctty of Anahelm.
5. That the granting of the Conditional Use Permit under the condTtions
imposed, if any~ wi11 not be detrtmental to the peace, health, safety and general
welfare of thc Citizens of the City of Anaheim.

6. That no one indicated thelr presence at sald public hearing In
opposition; and that no correspondence was received in opposftlon to the subJect
petitlon.
EI~VIRONHENTAL IMPACT FINDING: That thc Anahein City Plan~tng Commission has
revieWed the proposa to permlt an Insurance office In a residential structure on a
rectangularly-shaped parr_el of land conslsting of approximately 7130 square feet
located at the southwest corner of Char;res Street and Helena Street, having
approximate frontages of 155 feet on the south side of Chartres Street and 46 feet on
the west side of Helena Street; and does hereby approve the Negailve Declaration from
the requirement to prepare an environmental impact report on the basis thaC tfiere
would be no significant individual or cumulative adverse environmental impact due to
the approval of this Negative Declaration since the Anaheim General Plan designates
the subject property for general conmercia) and medium dPnslty residenetal land uses
commensurate with the proposai; that no sensitive environmental impacts are involved
in the proposal; that the I~itial Study subm(t[ed by the pet(tion~r indicates no
significant individual or cumulative adverse environmen[al impacts; and that the
Negative Declaration suhs[an[lating the foreyoing findin9s is on file in the Lity of
Anaheim Planning Dtpartment.
NOW, TtIEREFORE. BE IT RESOLVfD that the Anaheln City Planning Commisston
does hereby grant subJcct Petition for Condittonal Use Permtt, upon the folipaing
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subJect property in order to preserve the saf~ty and general welfare of the
Citizens of the City of Anaheim:
1. Tha[ the existing struc[ure shall be brought up to the minimum
standards of the Ctty of Anaheim, including the Uniforn Building, Plumbing,
Electrical, Mechanical and Fire Codes as adopted by che City of Anahelm,
2. That the owner(s) of subJect property shall pay the traffic signal
assess~ent fee (Or~inance No. 3p^E? di~.°erencc tetwcen res}dentiat and corranerciat use
anounting to 5180.00 per 1000 square feet of building or fractton thereof.
3. That subject property shall be developed substantlaily in accordance
with plans ard specifications on file with the Ciey of Anaheim marked Exhibit Nos_ i
and 2.
4. That Condttion No. 1 and 2, above-menttoned, shall be complied with
prior to the commencement of the activity authorized under this resolution~ or prior
to the time that the building permlt is issued, or Nithin a perlod of nlnety (90)
days from date hereof, whichever occurs first, or such further ttme as the Planning
Commission may grant.
5. That Condition No. 3, above-mentioned, shall be complle~ with prior to
final buildtng and zontng inspectlons.

6, That the proposed use is hereby granted for a period of one year.
BE IT FURTHER RESOLVED that the Anahcim City Planning Commlssion does hereby
find and deternine that adoptton of thts Resolution Is expressly predicated upon
applicant's compliance wtth each and all of the condittons herelnabove set forth.
Should any such conditlon, or any part thereof, be declared invalid or unenforceable
by the final Judgment of any court of competent Jurisdictlon, ehen this Resolution,
and any approvals herein contalned, shall be deemed null and vold,
