THAT PETITION FOR CONDITIOt1AL USE PERMIT N0. 1995 BE GRA~~TED
NHEREAS, the Anaheim Llty Planning Commission did recelve a verified
Petitinn for Conditional Use Permit from SOUTH4lEST LEASItIG CORPORATIOM, 12312 West
Olympic Eoulevard, Los Angeles, California. 90064, owner. and WILLIAM L. SNELLING.

property situated tn the City of Anaheim, County of Orangc, 5tate of California,
described as:
Lots 13 and 14 of Tract No. 498, Berger Half-Acres, as shown on a
Map recorded In book 19, page 24 of Mtscellaneous Maps, records of
Orange County, California. Excepting therefrom the South 50 feet
of Lot lk. Also excepting therefran that portion o` the Westeriy
129.17 feet of said Lo[ tk lying ~1or[h of the N~rth line of the
South 50.00 feet of sald Lot 14.
WHEREAS, the City Planning Cormission did hold a public hearing at the City
Hall fn the City of Anaheim on Ju~e 12, 1979, at 1:30 p.m., notice of sald public
hearing having been duly given as required by law and in accordance with the
provisions of the Anahein Municipai Code, Chapter 1£5.03, to hear and consider
evidence for and against said proposed conditional use and [o fnvestigate and make
findings and recomnendations in cor.nection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf. and after due consid~ration of all evidence and reports
offered at said hearin9, does find and de[ermine the following facts:
1, That the proposed use is properly one for which a conditional use
permit is authorized by Anaheirt; Municlpal Code Sectlon 18.03.03~•~~0 to wit: to
permtt aucomobile storage and leasing.
2, That the proposed use is hereby granCed subject ta the petitioner's
stipulations a[ the public hearing to provide a 6-foot high masonry block wall along
the 62-Foot west property line and along the westerly 129-feet of the sauth property
line separating the proposed use from the Satellite Mobitehomc Park; that landscaping
and a permanent irri9ation facility shall be provided in the 35-foot wide front
se;back along Mountain View Avenue; and that the 16-foot wide driveway to Mountain
View Avenue shall be paved with asphalt.
3, That the proposed use witl no[ adversely affect the adJo(ning land uses
and the growth and development of the area in ahich i: is proposed to be ioca[ed.
4. Tha[ the size and shape of the site proposed for the use is adequate to
ailow the futl development of the proposed use in a manner not detrimental to the
particular area ~or to the peace, heatth~ safety. and general welfare of the Citizens
of the City of Anaheim.
5. That the granting of the Conditional Use Permit under the condttTons
imposed, if any, will not be detrimental to the peace, health, safety and general
welfare of the Citizer.s of the Clty of Anaheim.

6. That the traffic generated by the proposed use wlil not impose an undue
burden upon thc streets and high~•iays designed and improved to carry the traffic in
the area.
7. That one concerned person indicated his presence at safd publtc
hearing; and that no correspondence was received in opposition [o the subJect
petition.
EMVIROtJMENTAL It1PALT fllIDING: That the Anaheim Clty Planning Commiss(on has
reviewed the proposa Lo permit automobtle storage and leasi -~ on a rectangularly-
shaped parcel of land consisting of approxtmately 0.5 acr~.,, having a frontage of
approximately 62 feet on the west side of Mountain View Avenue, having a maximum
depth of approximately 360 fee[, being located approximately 535 feet south of the
centerline of Katella Way; and does hereby approve the ~legattve Declaration from the
requiremen[ to prepare an environmental imFatt report on the basis that there would
be ~o significant individual or cumulative adverse environmental Impact due to the
approval of this Negative Declaration since the Anaheim General Plan designates the
subject property for low-density restdenti~l land uses commensurate with the
proposal; that ~o sensitive envtronmental impacts are involved in the proposal; that
the Initial Study submitted by the petittoner indTca[es no significant individual or
cumulative aJverse environrnental impacts; and [hat the Negative Oeclaration
substantiating the foregoing findings is on file in the City of Anaheim Planning
Department.
N011, THEREFORE, BE IT P.ESOLL~ED that chc Anaheim Ctty Planning Corsnission
does hereby grant subJect Petition for Condi[tonal Use Permit, upon the following
condltions which are hereby found to be a necessary prerequlsite to the prc,osed use
of the subject property in order to preserve the safety and general welfare af the
Citizens of the City of Anaheim:
1. That all engineering requlrements of thc Ctty of Anaheim along Mountain
View Avenue including preparation of improvenent plans and installa[ton of all
improvements such as curbs and gutters, s(dewalks, street grading and paving.
drainage facilitles or other appurtenant work, shall be canplied with as required by
the City Engineer and tn accordance with standard p)ans and speciffcait~ns on file Tn
Lhe Office of the City Engineer; and/or that a bond, cer[iflcate of deposit. letter
of credit, or cash, in an amount and form satlsfactory to the City of Anaheim shall
be posted rrith the Lity to guarantee the lnstallati~n of the above-mentioned
requirements.
2. That the owner(s) of subjec[ property shatl pay to the Ctty of Anahetm
a fee~ in an amount as determined by the City Council, for :ree planting purposes
along 1lountain Vtew Avenue.
3. That trash storage areas shall be provlded in accordance with approved
plans on file with the Office of the Director of Public Works.
4. That drainage of subJect property shall bc disposed of tn a manner
satisfactory to the City Engineer.
5. That the owner(s) of subject property shall pay to the City of Anaheim
a fee. in an amount as determined by [he City Council, for stree[ lighting along
Mo~ntain View Avenue.

6. That the proposed au[omobile storage lot shall comply wtch all signing
requlrements of the RS-A-43~000 zoning.
7. That subJect propcrty shall be develaped substan[tally in accordartce
with ptans and specificatlons on file with the City of Anaheim marked Exh(btt No. 1,
provided, however, that a 6-foot high masonry block wall shall be constructed along
the west property ltne and the westerly 129 feet of the south property line, that
landscaping with permanent irrigation facilities shall be provided in the fro~t 35
foo[ setback along Mountain View Avenue, and that the 16-foot wtde driveway to
Mountain View Avenue shail be paved with asphalt.
8. That wtthin b0 days of the date of approval of thls permi[. Condttion
Nos. 1, 2, 3. 4, 5~ and 7 above-me~tioned~ shall be uxnpleted.
BE IT FURTHER RESOLVED that [he Anahetm City Planning Commission does hereby
find and determinc that adoption of this Resolution is expressly predicated upon
appllcant's cnmpliance with each and all of the conditions hereinabove set forth.
Should any such condltion, or any part thereof, be declared invalid or unenforceable
by the final judgment of any court of competent Jurtsdiction, then this Resolution~
and any approvals herein contained. shall be dcemed null and void.
