THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1994 BE DENIED
WHEREAS, the Anaheim Ltty Planning Commission did receive a verified
Petition for Conditional Use Permtt from ALBERT SPENCER PORTER AND SUZANNE PORTER,
324 West Taft Street. Orange, California, 426G7, owners, and JOSEPH DOt1ALDSON, 25800
Jeronimo Road, I~100, Mission VieJo. California 92691, agent of cer[ain real proper[y
sttuated in the C1[y of Anaheim, County of Orange, State of California, described as:
That portion of Lot 5 in Block 5 of [he Golden Statc tract, in the
Lity of Anaheim, County of Orange, 5[ate of Laltfornia, as per map
recorded in book 4, pages 66 and 67 of Ntsceilaneous Maps, in ehe
office of the County Recorder of said County, shown as parcel 6 on
a map recorded in book 114, pages 39 and 40 of Parce! Maps,
records of said Orange Coun[y.
WHEREAS, [he City Planning Commtssion did hold a public hearing at the City
Hall in the City of Anaheim on June 18. 1979, at 1:30 p.m „ notfce of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Munic(pal Code, Chapter 18.03, to hear and constder
evidence for and against said proposed condi[tonal use and to investigate and make
findings and recommendations in connection therewiCh; and
WIIEREAS. said Cormtssion, after duc inspection, investtgation and study made
by itself and in its behalf, and after due consideration of all evtdence and reports
offered at said hearing, does find and determine the following facts:
1. That the proposed use fs properly one for whtch a condltional use
permi[ is authorized by Anahefm Munictpai Code Section 18.03.030.010 and
18.G1.050.450 to wft: to permit a gymnastics academy in the ML (Industrial, Limited)
Zonc.
2. That the proposed use is hereby denled on che basis that the use would
not be canpatlbie with the surroundi~g i~dustriai uses and that the resultant traffic
would have an adverse impac[ on the existtng traffic.
3. That che proposed use wtll adversely affect the adjoining land uses and
the growth and development of the a~ea in which ii is proposed to be located.
4. That the size and shape of the site proposed for the use is not
adequate to allow the full development of the proposed use in a manner not
detrtmental to the partfculai~ area nor to [he peace. health. safety~ and generai
weifare of the Citizens of the City of Anaheim.
5. That the gran[ing of the Conditional Use Permtc wilt be detrimental to
the peace. health, safety and general weifare of the Citizens of the City of Anaheim.
6, That the traffic genera:ed by the proposed use will impose an undue
burden upon the stree[s and highways designed and improved to carry the Lraffic in
the area.

7. That no one indtcated their presence at said public hearing in
opposition; and that no correspondence was recelved tn oppositton to the subJect
petition,
ENVIROIJNENTAL IMPACT FINDiNG: That the Anaheim City Planning Commission has
reviewed the proposa to permtt a gymnastics academy in the ML (industrtal, Limited)
Zone on a rectangularly-shaped parcel of land consisting of approxtmately 0.5 acre
iocated at the northwest corner of Ceena Court and Kraemer Boulevard, having
approximate frontages of 140 feet on the north side of Ceena Court and 147 feet on
the west side of Kraemer Boulevard; and does hereby approve the Negative Declaratton
from [he requiremant to prepare an e~vironmental impact report on the basis that
there would be no stgnificant individua) or cumulattve adverse environmental fmpact
due tc the approval of [h1s Negative Deciaration since [he Anaheim General Plan
designates the subject property for general industrial land uses commensurate with
the proposal; that no sensitive environmental impacts are involved in the proposal;
that the Initial Study submitted by :he petitioner indicates no significant
individual or cumulative adverse environmental impacts; and [hat the Negative
Declaration substantiating the forego!ng findfngs is on file in the Clty of Anaheim
Planning Department.
NOW, THEREFORE, QE IT RESOLVED that the Anaheim City Planning Lommission
does hereby deny subject Petition for Conditlonal Use Permit on the basis of the
aforementioned findtngs.
