WHEREAS, the City Planning Commission dld hoid a public hearing at [he City
Hall In the City of Anaheim on January 15, 1979, at 1:30 p~m., notice of said public
hearing havtng besn duly given as required by law and tn accordance with the
provistons of the Anaheim Municipal Code, Chap[er 18.03. to hear and consider
evidence for and against said proposed vartance and to investigate and make findings
and recomm~ndations in tonnectlon therewith; and
WNEREAS, said Commission. after due inspectlon, investigation and study made
by itself and tn its behalf, and afcer due consfderation of all evidence and reports
offered at said heariny, does ftnd and determine the foilowtng fac[s:

permit is authorized by Anaheim Municipal Code Section 18.Q3.02~.01Q to wi[: to

2. That the proposed use and waiver are hereby granted on the basis that
the use is a warehouse with no reta(1 sales to the general pubilc bei~g conducted
inside the structure and that the availa6le on-slte parking complies with the
requirement for warehousi~9 uses in an industrial zone when such use is parmitted by
right.
3. That the proposed use will no[ adversely affcc[ the adJoi~ing land uses
and the growth and develooment of the area fn which it is proposed to be located.
4. Tha[ the size and shape of the sitc proposed for the use is adeGua[e to
allow the full development or the proposed use ln a manner not detrirnentai to the
particular area nor to the peace, healih. safety, and general welfare af the Citlzens
of the City of Anahelm.
5. That the granting of the Conditi~nal Use Permlt under the condi;tons
imposed, if any, wiil not be detrtmental to the peace, health, safety and general
welfare of the Citizens of the City of Anahetm.

ENVIRONMENTAL IHPACT FINDIN;: That the Anaheim City Planning Commission has
reviewad the proposa to expand an existtng warehouse with a walver of minimum
parking area on an irreyularly-shaped parcel of land consisting of approximately 0.6
acre having a frontage of approximately 90 feet on the east side of Manchester
Avenue, having a maximum depth of approximately 14~ feet~ located approximately 260
feet nortl~ of the centerline of Lincoln Avenue; and does hereby approve the Negattve
Oeclaration from the requirement to preFare an envlronmental impact ~epert on the
basis that there would be no signtficant Individual or cumulative adverse
environmental impact due to the approval of this Negative Declaratlon since the
Anahelm Genera) Plan designates the subjec[ property for general commercial land uses
commensurate with the proposal; that no sensitive environmentat impacts are Involved
in the proposal; that the ini[io. Study submicted by the petitioner indicates no
si9nificant individual or cumulative adverse environmental impacts; and that the
Negative Declaratton substantiating the foregoing findings is on file in the Ctty of
Anaheim Ptanning Department.

NON, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subJect Petition for Condttional Use Permit~ upon the following
conditions which are hereby found to be a necessary prerequistte to the proposed use
of the subJect property in order to preserve the safety and general welfare of the
Citizens of the City of Anahelm:
~, That trash storage areas shall 6e provide~ in accordance with approved
plans on file with the Office of the Director of Publtc Works.
2, That street lighting factlities along Manchester Avenue shall be
installed prior to the final buflding and zoninq inspections unless otherwisc
approved by the Director of Public Utilities, and in accordance with standard
specifica[ions on ffle in the Office of the D;rec[or of Public Uttlitles; and/or [hat
a bond, certificate of deposit, letter of credit, or cash, in an amount and form
satisfactory to the City of Anaheim shal) be posted with the City to guarantee the
installation of the above-mentioned requirements.
j, That subject business shall comply with all signino re~Lirements of the
CG (Commercial, General) 2one.
q, That the owner(s) of subject oroperty shall pay the traffic signal
assessment fee (Ordinance N0. 3896) amounting to 53n.00 per 1000 square feet or
fraction thereof of the industrial building prlor to the issuance of a building
permit.
5, That subJect property shall be developed substantially in accordance
with plans a~d speciTications on file rrith the Ci[y of Anaheim marked Exhibit Nos. 1
through 3,
~, That Condition tto. 2, above-mentioned, shall be complied with prlor tc
the ccmmencement of the activity authorized under [his resolution. or prior to the
time that Che building perm(t is issued, or within a ptriod of one year from date
hereof, whichever occurs firs[, or such further [ime as [he Planning Commission may
grant.

prior to final building and zoning inspections.

find and determine that adoption of this Resotutlon is expressly predicated upon
applicant's comPllance with each and all of the condit(ons hereinabove set forth.
Should any such condiYion, or any part thereof. be declared invalid or unenforceable
by the flnal judgmen[ of any couri of competent Jurisdiccton. ihen thts Resotution,
and any approvals herein coniained~ shall be deemed null and void.
