41HEREAS, the Anahetm City Planntng Commisslon did recelve a verlfied
petition for Reclassification from N. B. CORPORATION, 392(1 Lemon Ave~ue, Long Beach,
Californla 90807, owner of certatn real propr_rty situated tn the City of Anaheim.
County of Orange, Stace of Callfornta~ described as follows:

NHEREAS, the City Planning Commisston did hold a pubiic heartng at the City
Nall in the City of Anaheim on August 13, 1979. at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anahelm Municipal Code, ChapLer 13,03, to hear and consider
evldence for and against satd proposed reclassification and to investigate and make
firtdings and recarnendatfons fn connection therewith; and
WHEREAS, said Commisslon, after duc inspection, investlgation and study made
by itself and in its behalf~ and after due conslderatTon of ail evidence and reports
nffered at said hearing, does find and detcrmine the following facts:
t. That the petiti~ner proposes reclassification of subJect property from
the RS-A-43,000 (Residentlal/Agricultural) Zone to the LL (Cortmerctal, LimTted) Zone.
2. That the proposed reclassification is herehy granted su6Ject to the
pettrioner's stlpulaLion ai L`te putllc heartng [hat 3 feet of Iandscaping will be
provided on the west property line adJacen[ to the existing mo611e home park.
3. That the Anaheim General Plan designates subJect proper[y for general
commercial land use.
4. That the proposed reclassiflcation of subJect property is necessary
and/er desirable for the orderiy and proper development of the communiCy.
5. That Che proposed reclasstficatlon of subJect property does properly
relate to the zones and thefr permltted uses locally established in close proxlmity
to subJect property and to the zones and their permitted uses generally es[ablished
throughout the community.
6. That the propossd reclassification of subJect property requlres the
dedicatlon and Improvemen[ of abutting streets Tn accordance with the Circulaticn
Element of the General Plan~ due to the anticipated Tncrease fn traffic which will be
generated by thc i~tensification of land usc.

7. That no one indicated thelr presence at said pubiic hearing in
opposition; and that no correspondence was recelved tn opposition to the subJect
petttion.
E~IVIRONMENTAL IMPAGT FINDING: That the Anahetm City Planntng Cortmission has
reviewed the proposai to reclass fy subJect property from :he RS-A-43,000
(Residenttal/Agricultur;,l) Zone to [he LL (Lommercial, Ltmited) Zone on a
rectangutarly-shaped parcel of land consisting of approximately Q.8 acres, having a
frontage of approximately 118 feet on the sou[h side of B•.11 P,oad, having a maxlmum
depth of approximately 277 feet, and betng 3ocated approxtmately 528 feet west of the
centerline of Beach Boulevard; and does hereby approve the Negatlve Declaration `rom
the requirement to prepare an envtronmental impact report on the basts that there
would be no significant individual or cumulative adverse environmental impact due to
the approval of thts Negative Oeclaratian since the Anaheim f,eneral Pian d:signates
the subJ•~ct property for general cor.merciai land uses carenensurate with the proposal;
that no sensitfve environmental impacts are involved t~ the proposal; that the
Initial Stucly submitted by the pe[itioner tndicates no significant individual or
cumulative adverse environmental (mpacts; and that the Negative Declaratton
substantiating the foregoing finJings is on file In ihe City of Anahelm Planning
Department.
NOW, THEREFORE, !3E IT RESOLI~ED tha[ the Anaheim Lity Planninq Commtsslon
does hereby grant subject Petition for Reclassificatlon and, by so doing, that Tttle
13-Zening of the Anaheim Hunicipal Code 6e amended to exclude the above-described
property from the RS-A-43,000 (RESIDEHTIAL/Af,PICULTURAL) ZO~IE and [o Incorporate said
described property into the Cl (COMHERCIAL, LIMITED) ZONE upon the followtng
conditions which are hereby found to be a necessary prerequisite to the proposed use
of subJect property ln ordcr to preserve the safiety and generai welfare of the
Citlzens of the City of Anaheim:
1. That the owner(s) of subJect proper[y shall deed to the City of Anaheim
a strip of land 53 feet in width frrxn the centerline of the street along Ball Road
for street wfdening purposes.
2. That all engineering requirements of the City of Anaheim alonq Bali
P,oad includl~g preparation of improvemert[ plans and i~stallatton of ail
improvements such as curbs and gutters, siderialks. street grading and paving,
drainage facilittes or other appurtenant work, shall be complied with as requtred by
the City Engineer and in accordance with standard plans and spectficatlons on f11e in
the Office of the Ci[y Engineer; thac screet lighting facilfties along Ball Road
shall be installed as required by the Dtrector of Public Utilitles, and in
accordance with specifications on ftlc in the ~Jffice of the Director of Public
Utillttes; and/or that a bond, certtficate of depostt, letter of credlt. or cash, in
an amount and form satisfactory to the Lity of Anaheim shall be posted with the C1ty
to guarantee the installation of the above-menttoned requlrements prior to occupancy.
3. That the owner(s) of subject property shall pay to the City of AnaheTm
a fee, tn an amount as determl~ed by the City Council, for tree planting purposes
along Ball Road.
4. That trash storage areas shall be provtded tn accordance with approved
plans on file wTth the Office of the Director of Public Wo~ks,

5. That fire hydrants shall be installed and charged as requlred and
determined to be necessary by the Chief of the Fire Department prior to commencement
of structural framing.
6. That subject property shal) b~ served by underground utilitles.
7. That dralnage of subJect property shall be disposed of in a manner
satisfactory to the City Engineer.
8. That the owner(s) of subJect property shall pay Lhe trafflc stgnal
assessment fee (Ordlnance No. 3896) in an amaunt as determined by the City Council.
for office buildings prior to the issuance of a building permit.
y. That a 3-foot wide landscaped planter shall be provided along the west
property ltne, said landscaping to be permanently maintained tn a neat and orderly
manner.
10. Prior to the introduc[1on of a~ ordtnance rezoning subJect property,
Condition Nos. 1, 2 and 3. above-menttoned, shall be completed. The provlsions or
rights granted by this resolutlon sfiall becor,ie null and void Fy action of the
Planning Correnission unless sald condtttons arc complied with within one year from the
date tiereof, or ,uch furcher ttme as the Planning Commlssion may grant.
11. That Condition Nos. 4, 6 and 7, above-mentioned. shall be complied wlth
prior to flnal building and zoning Inspections.
BE IT FURTHEP, RESOLVED that the Ansheim Ci[y Planning CortmTssion does hereby
`ind and determine that the adoption of thts Resolutton Is expressly predtcated upon
applicant's canpilance with each and all of the condttlons hereinabove set forth.
Should any condition or any part thereof, be declared invalid or unenforceable by the
final Judgment of any court of competent Jurisdiction, then [his Resolution, and any
approvals herein contained, shali be deemed nul) and vold.
