UHEREAS, the City Planning Comnission dId hold a pubiic hearing at the Ctty
Ha)1 in the City of Anaheim on September 24, 1979~ at 1:30 p,m.~ nottce of sald
publlc hearing having 6een duly given as required by IaN and in accordancc wfth the
provisions of the Anaheim Hunicipal Code, Chapter 18.03, to hear ar~d conslder
evidence for and against sald proposed condittona) use permtt and to investigatc and
make findings artd recortmendatlons in connection therewith; a~d
WHEREAS, said Commission, after due tnspection. Investtgation and study nade
by itseif and in iis behalf, and after due consideration of all evidence and reports
offered at said heartng~ does find and determina the followiny facts:
1. That the proposed use is properly one for whtch a canditional use
permit (s authorized by Anaheim Munictpal Code Section 18.45.050.080 r,o wit: to
permit a self-service car wash In the CG (Commerciai. General} Zone.
2. That thc proposed use is hereby granted subJect to the pe[ltToner's
stlputation at the public hearing to close the existing 20-foot ~Ide driveway nearest
the easterly property line and replace it with standard curb, gu[ter, and sidewalk.
3. That the proposed use wt:l not adversely affect the adJoining land uses
and the growth and development of the area In which it Is proposed to be located.
4, That the size and shape of the site proposed for the use is adequate to
allow the fult development of the proposed use in a manner not detrlmental to the
particular area nor to the peace, health, safe[y, and general welfare of the CTtTzens
of the City of Anaheim.
5. That the granting of the Condltlonal Use Permit under the conditions
imposed, tf any. wiil not be detrimental to the peace, health~ safety and general
welfare of the Cittzens of the City of Anaheim,
6, That the trafflc generated by the proposed use will not Impose an undue
burden upon the sLreets and hlghways designed and Smproved to carry the trafftc in
the area.

ENVIRONMENTAL IMPACT FINDING: That the Anaheim Clty Planning Commission has
reviewed the proposa to permit a self-service car wash in the CG (Commercial,
General) Zone on an Irregularty-shaped parcel of land consisting of approxtmately 0.5
acre located at the northeast corner of Lincoln Avenue and West Street. having a
frontage of approxlmately 196 feet on the north side of Ltncoln Avenue and a frontage
of 65 feet on the east sTde of West Street; and does hereby aparove the Negative
Oeclaratton from the requlrement to prepare an environmental fmpact report on the
basis thet there would be no stgnfficant indivldual or cumulative adverse
environmental impact due to the approval of this Negative Declaratton slnce the
Anaheim General Plan destgnates the subject property for general cartmercial land uses
commensurate with the proposal; that no sensitive environmental impacts are involved
in the proposal; tha[ the initial 5[udy submitted by the petittoner indicates no
significant indfvtdual or cumulative adverse envlronmentat Impacts; and that the
Negativ~ Declaration substantiating the foregoing findings ts on file in the City of
Anaheim Pianning DEpartment.
NOW. THEREFORE~ BE IT RESOLVED that the Anaheim City Planning Commisslon
does hereby grant subJect Petition for Co~ditional Use Permit, upon the following
conditions which are hereby found to be a necessary pre~equisite to the proposed use
of the subJect property in order to preserve the safety and general welfere of the
Citizens of the City of Anaheim:
1, That trash storage areas shall be provided in accordance with approved
plans on fite wlth the Office of the Executive Dlrector of Publtc Works.
2. That street lightlnq facllities alo~g Lincoln Avenue shall be installed
as requlred by the Offlce of Utiiities Generai Manager, and in accordance with
specifications on file in the OffTce of UtilTties General Managcr; and/or that a
bond~ certiflcate of deposit, letter of credit, or cash, in an ar,rount and form
satisfactory to the City of Anahelm shall be posted with the Clty to guarantee the
installatlon of the above-mentloned requirements prior to occupancy.
3. That [he owner(s) of subject property shall pay to che Cfty of Anaheim
a fee, 1~ an amount as determined by the City Council, for street iighting along West
StreeL.
4. That the proposed car wash shall comply with all signing requtrements
of the CG (General, Commerctal) zoning.
5. That subJect property shall be developed substantlally in accordance
wlth plans and speciflcatTons on file wtth the City of Anahelm marked Exhibit Nos. 1,
2 and 3; provided, however~ that the most easterly driveway shalt be removed and
replaced with a standard curb, gutter a~d sidrNaik.
6, That the owner(s) of subJect property shall submtt a letter requesting
the terminatlo~ of Condlttonal Use Permit No. 1907 to the Planning Commisslon,
7, That Condltlon Nos. 2, 3 and 6, above-mentloned~ shali be complted with
prior to the commencement of the actlvity authorized under this resolution, or prior

to the tlme that the bullding permit Ts issued~ or wlthTn a perlod of one year fran
date hereof, whichever occurs first, or such further time as the Planning Cammisslon
may granx.
8, That Condition Nos. 1, 4 and 5, above-mentioned, shall be compiled wTth
prtor to final building and zoning inspectlons.
BE IT FURTHER RESOLVED that the Anaheim City Planntng Commisslon does hereby
find and determine that adoption of this Resoiution ls expressty predicated upon
applicant's compliance with each and all of the conditlons hereinabove set forth.
Should any such condition, or any part thereof, be declared tnvalid or unenforceable
by the final Judgment of any court of comp~tent Jurlsdictior, then this ResolutTon,
and any approvals herein co~tatned, shall be deemed null and vold.
