THAT PETITION FOR RECLASSIFICATION N0. 79-80-13 BE GRANTED.
WNEREAS, the Anaheim Ctty Planning Commisston did recetve a verlfied
petltion for Reclassification fran BIRCH RIDGE ESTATES, 4242 Campus Drive, P. 0. Box
1668~ Newport Beach, Lalifornia 92660, owner, and RICHARD L. OWEN, 4242 Lampus Dr(ve,
P• 0. Box 1668, Newport Beach. California 92660, agent, oF certain real property

provisions of the Anaheim MunicipaD Code, Chapter 18.03. to hear and consTder
evidence for and against said proposed reclassifica[ton and [o investigate and make
findings and recommendations in connectlon therewtth; said public hearing havtng been
continued to the Planning Commission meeting of October 8. 1979; and
WHEREAS, said Commission after due inspection, investigation and study made
by Ttself and tn its behalf, and after due consldera[ion of all evTdence and reports
offered at said hearing, dces fi~d and determine the following facts:
1. That the petitioner proposes reclassification of subJect property from
the RS-HS-I0,QQ0(SL) (Residenttal, Single-Family Htllside - Scenic Corridor Overlay)
Zo~~ to the RM-3000(SC) (Residential, Multiple-FamTly - Scenic Corridor Overlay)
Zone.

medlum density residential land uses.

having revlewed A dendum No. 1 to Environmental Impact Report No. 197 for TentatTve

Hap Tract ~los. 9752 ~Revtsion No. 1) and 10800 this date and evidence, both wrttten
and oral, having been presented to supplement Addendum No. 1 to EIR No. 197, finds
that potentlal environmental impacts of the proJeci may be reduced to an
tnsigniftcant level by conformance with Ctty pians, policies and ordinances and
Addendum Na. 1 to EIR No, 1~7 is in compllance with the Californ(a Environmental
Quality Act and with City and State EIR Guidelines and, therefore, based upon such
information, the Anaheim City Planning Commisslon certlfles Addendum No. 1 to EIR No.
197.
NON, THEREFORE, BE IT RESOLVED thai the Anaheim City Planning Commisslon
does hereby grant subJect Petttion for Reclassification and, by so doing, that Title
18-Zoning of the Anaheim Municipat Code be amended to exclude the above-described
property fran the AS-HS-10,000(SC) (RESlDENTIAL, SINGLE-FAMILY - SCENIC LORRIDOR
OVERLAY) zONE to [he RM-3000(SC) (RESIDENTIAL, MULTIPLE-FAMILY - SCENIC CORRIDOR
OVERLAY) ZONE upon the following conditions which are hereby found to be a necessary
prerequisite to the proposed use of subJect property in order to preserve [he safety
and general welfare of the Litizens of the City of Anahetm:
1. That an ordlnance rezoning the subJect property shall In no even[
become effecttve except upon or following the recordation of Final Tract Map No.
10800 withtn the ttme specified in Government Code Sec[lon 66463.5 or such further
time as the advisory agency or City Council may grant.
BE IT FURTHER RESOLVED that the Anahelm City Plannin9 Cortntssion does hereby
flnd and determtne that the adoptton of this Resolution ts expressly predicated upon
applicant's complTance wtth each and a11 of the condi[tons hereinabove set forth.
Should any condltion or any part ihereof, be declared Invalid or unenforceable by [he
final Judgment of any court of competent Jurisdictlon, then this Resolu[ion. and any
approvals heretn contained, shall be deemed null and void,
