WHEREAS, the Anaheim City Planning Commission dTd receive a verified
Petition for Varlance from VINCENT C. BREIIER, 400 South Flowcr Street No. 57, Orange,
California 92668, owner, and JERRY MOORE, 9220 Telegraph Road, Downey, Californla
90241, agent of certaln real property situated in the City of Anaheim, tounty of
Orange~ State of Catifornla~ described as:
LOT 2 OF TRACT N0. 1758, IN THE CITY OF ANAHEIM, LOUNTY OF ORAP~GE,
STATE OF CALIFORNIA, AS PER MAP RECOROED IN BOOK 53, PAGES 19 AND
20 QF MISCELLANEOUS MAPS, IN THE OFFICE OF TfiE COUHTY RECORDER OF
SA1D LOUNTY.
FM EREAS, the Ctty Planning Lommission did hold a public hearing at the City
Hall in the City of Anahelm on October 8, 1979, at 1:30 p.m „ notice of said public
hearing having been duly given as required by law and in accordance with the
provtsions of the Anaheim Muntcipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed variance and to investiaate and make ftndings
and recannendations in connectlon therewith; and
WHEREAS, said Commission, after due inspection, investiga[ion and study made
by itself and in its behalf, and after due co~sideratfon of all evidence and reports
offered at said hearing, does find and determine the follor~ing facts:
t. That the petitioner proposes a waiver of the following to retain an
existing free standing sign:

2. That the above-mentioned waiver is hereby denied on the basis that the
pe[iCioner demonstrated [hat no hardship exists and that an undesirabie precedent
would be set if this petltion were approved.
3. That there are no exceptionai or extraordinary circumstances or
condittons applicable to the property involved or to the intended use of the property
that do not apply generally to the property or class of use tn the same viciniYy and
zone.
~, That the requested varlance is not necessary for the preservation and
enJoyment of a substantial property right possessed by other property in the same
vicinity and zone, and denied to the propercy tn question.
5. That the requested variance will be materTally detrimental to the
public welfare or inJurtous to the property or lmprovements in such vicinity and zone
in o~hich the praperty is located,
6, That one person indtcated his presence at said public hearing in
opposition; and that no correspondence wes recetved in opposition to the subJect
peCition.

ENVIRONMENTAL IMPACT fINDING: The Planning Director or his authorized
representative has determ ned that the proposed proJect falls within the definition
of Gategorical Exemptiorts, Class 3. as defined ln Paragraph 2 of the City of Anaheim
Environmental impact Report Guidelines and is, therefore, categoricalty exempt from
the requirement to prepare an EIR.
NOW~ THEREFORE, BE IT RESOLVEn that the Anahetm City Planning Commission
does hereby deny subJect Petition for Variance on the basis of the aforementtoned
ftndings.
