WHEREAS, the Anaheim City Plan~ing Commfssion dfd receive a verifTed

Anaheim, County of Orange, State af California, described as follows:
PARCEL 1: The South 100 feet of the Northeast quarter of the
Northeast quarter of the Southwest quarter of Section 2i, Township
4 South. Range 10 West, in the Rancho San Juan Cajon de Santa Ana
and Rancho Las Bolsas, as shown on a Map recorded in book 51, Page
10 of Miscellaneous Maps, records of said Orange Lounty.

NHEREAS. the City P1anning Commission did hold a publfc hearing at the City
Hali in the City of Anaheim on October 22, 1979, at 1:30 p.m., notice of said public
hearing having been duly given as re~uired by law and in accordance with the
provisions of the Anahelm Municipal Code, Chapter 18.Q3, to hear and consider
evidence for and against sald proposed reclassificacion and to tnvestigate and make
findings and recommendations in connectton therewtth; and
VJHEREAS~ said Commisston, after due inspectton, investigation and s[udy made
by itself and in its behalf, and after due consideration of all evidence and reports
offered a[ said heartng, dces ftnd and determine the f~liowing facts:
i, That the petitfoner proposes reclassification of subJect property from
the RS-A-43,000 (Residential/Agricul[urat) Zone to the CL (Cor,mercTal, Limitcd) Zone.
2. That the Anaheim General Plan desfgnatcs subJect property for
commerclal-recreation land uses.
3. That the proposed recla~sificaiion of subject property is necessary
and/or desirable for the orderly and proper development of [he community.
4. That the proposed reclassification of subject property d~~s properly
relete to the zones and their permi[ted uses tocally estabiished tn clos:. proxim?ty
to su6ject property and to the zones and theTr Rermitted uses gcrserally establis:~cd
throughout the communlty.
5. That no one indicated their presence at said publtc hearing fn
opposition; and that no correspondence was recetved in opposttion to the subject
petttion.
ENVIRONMEPlTAL IMPACT FINDINC: That the Anaheim City Planning Comnisslon has

approximately 100 feet on the west side of Flarbor Boulevard, havtng a maxlmum depth
of approximately 270 feet and being located approximately 600 feet south of the
centerline of Orangewood Avenue; and does hereby approve the Negative Declaratton
fran the requirement to prepare an environmental impact report on the basis that
there would be no signiffcant lndlvidual or cumulative adverse environmental impact
due to the approval of this Negative OeclaratTon stnce the Anaheim General Plan
des(gnates the subJect property for corrmercial-recreatlon land uses caranensurate atth
the proposal; that no sensitlve envtronmenial tmpacts are involved in thr proposal;
that the Initial Study submTtted by the petittoner tndtcates no significant
tndividual or cumulative adverse environmental impacts; and that the Negatlve
Declaratlon substantiating the foregoing flndings is an file in the Lity of Anahelm
Planning Department.
NOW, TNEREFORE, BE IT RESOLVE~ that the Anahefm City Planning Commisslon
does hereby grant subjeci Petttion for Reclassification and, by so doing, that Tttle
1B-Zoning of the Anaheim Hunicipal Code be amended to exclude the above-described
property from the RS-A-43,000 (RESIDEtITIAL/AGRICULTURAL) ZOt7E and to incorporate said
described property Into the CL (COMMERCIAL, LIHITED) ZOtJE upon the following
conditions whfch are hereby found to be a necessary prerequisite to the proposed use
of subject property in order to preserve the safe[y and general welfare of the
Citizens of the City of Anaheim:
1. That the owner(s) of subJect property shall pay to the City of A~aheim
a fee, in an amount as de[ermined by the City Council, for tree planting purposes
atong Harbor Boulevard.
2, That trash storage areas shall be provided in accordance wtth approved
plans on file with [he Office o` the Executive Director of P~~blic uorks.
3. Tha[ subJect property shatl be served by underground utiltties.
4, That drainage of subject property shall be disposed of in a manncr
satisfactory to the Clty Engineer.
5. Tha[ completion of these reclassifica[lon proceedings is conttngent
upon the granttng of Conditlonal Use Permft No. 2027.
6. Prior to the ineroduction of an ordinance rezoning subject property,
Conditlon No. 1, above-mentioned~ shall be canpleted. Thc provlsions or r"tghts
9ranted by thts resolution shall beco~e null and void by action of the Planniny
Cortnission unless said conditlons are complied with within one year from the date
hereof~ or such further time as the Planning Comnlsston may grant.
7. That Condition Nos. 2, 3 and 4, above-mentioned, shall be complied with
prtor to final building and zoning inspections.
BE IT FURTHER RESOLVED that the Anaheim Ctty Planning Commission does hereby
find and determine [hat adoption of this Resolutio~ is expressly predicated up~n
applicant's compllance wlth each and all of the condltions hereinabove set forth.
Shoutd any such condttton, or any part thereof, be declared tnvalid or unenforceable
by the final Judgment of any court of competent Jurlsdictlon~ then this Resolutlon~
and any approvals herein contalned, shall be deemed null and void,
