A RE50LUTIO~J OF THE ANAHEIM CITY PLANNING COMMISSIOtS
THAT PETiTION FOR CONDITIONAL USE PERhtIT N0. 2032 BE GRANTED
WHEREAS, the Anaheim City Planni~o Commisslon did receive a verified
Petition for Conditlonal Use Permit from HERMAN H. FLUM, ~4205 Hatteras Street, Van
Nuys, California, 91401, owner of certain real property situated in the City of
Anaheim, County of Orange, Sta[e of California, described as:
LOT 50. 51, AND 52 OF TRACT N0. 2180, A5 SHOWtI ON A MAP RECORDED
IN BOOK 62, PAGES 31 AND 32 OF MISCELLANEOUS MAPS, RECORDS OF
ORAdGE COUNTY, CAIIFORt~IA.
WHEREAS, the City Planninq Cortmission did hold a public hearing at the C1ty
Hall in the City of Anafiefm on November 5, 1979. at 1:30 p.m., notice of sald public
hearing having been duly glven as required by law and in accordance with the
provisions of the Anaheim Municipai Code, Chapter 18.03, [o hear and consider
evfdence for and against said proposed conditional use permit and to investiga[e and
make findings and recommendatfons in connection therewitfi; and
NHEREAS, satd Lommission, after due inspection, investigation and study made
by itseif and In Its behalf, and after due consideratlon of all evidence and reports
offered at said hearing, does find and determtr~e the following facts:
1, That the proposed use is properly one for which a condittonal use
permit is authorized by Anahetm Municipal Code Sectton 18.44.050.160 to wit: to
permit a 32-unit motel with waiver of:

2, That the requested waiver is hereby granted on the basis of the lnlited
size of the property which ts only 127 feet deep and ihat iandscaping witl provide an
additional buffering effact between the exlsting residences and the proposed motel.
3. That the proposed use ts hereby granted subJect [o the petitioner's
stipulation at the public hearing to provide wrought-iron gates {or other ornamen[al
type gates approved by the Planning Department) to restrict access to the interTor
yards fran the adJacent sCreets.
4. That the proposed use wTll not adversely affect the adJoining land uses
and the growth and development of the area in which it is proposed to be located.
So That the size and shape of the site proposed for the use is adequate to
aliow the full development of the praposed use in a manner not detrimental to the
particula~ area no~r *_o the peace~ health, safety. and general welfare of the Citizens
of the City of Anahelm.

6. That the granting of the Condittonal Use Permit under the conditions
imposed, ff any, will not be detrimental to the peace, heaith, safety and general
welfare of the Citizens of the City of Anaheim.
7. That the traffic generated by the proposed use wlll not impose an undue
burden upon the streets and highways desig~~d and improved to carry the traffic in
the area.
8. That 4 persons indicated their presence at said publlc hearing in
opposTtion; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Pianning Cortmission has
reviewed t e proposa to perm t a 32^unit motel with a rraiver of maximum structural
helght on a rectangularly-shaped parcel of land consisting of approxtmately 0.6 acre
located at the northwest corner of Katella Avenue and Walnut Street, havtng
approximately frontages of 127 fcet on the north side of Ka[ella Avenue and 223 fee[
on the wes[ side of Walnut Street; and does hereby approve thc Negative Declaration
from the requirement to prepare an ertvironmental impact report on the basis that
*here would be no significant individual or cumulative adverse environmen[al impact
due to the approval of this Negative Declaration since the Ananeim Gener?! Plan
designates the subject property for general commercial land uses cormnensurat~~ with
[he proposal; that no sensitive envlronmental impacts are involved i~ the proposai;
that the Ini[ial Study submitted by the petitioner indicates no signiftcant
individual or cumulative adverse environmental impacts; and that the Negative
Declaration substan~iattng the foregoing findings is on file in the C1ty of Anahetm
Planning Department.
NOW, TNEREFORE, BE IT RESOLVED that the Anaheim City Planning Comnission
does hereby grant subject Petition for Conditional Us~: PermiC, upon the foilowing
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property tn order to preserve the safecy and generai welfare of the
C(tizens oF the Cit~/ of Anaheim:
i. That sidewalks shall be installed along I'.atella Avenue and Walnut
Stree[ as required by [he City Engineer and (n accordance with standard plans and
speciftcations on file in the Office of the City Engineer; said sidewalk Installation
shall not be required until such time as Katella Avenue is widened.
2. That Lrash storage areas shall be providzd in accordance with approved
plans on fils with the Offtce of the Executive Director of Public Works.
3. That subject property shall be served by underground utilities.
4. That drainage of subJect property shalt be disposed of in a manner
satisfactory to [he Ctty Engineer.
5. That appropriate water assessment fees as detarmi~ed by Che Office of
Utitities General Manager shali be paid to the ~t2y of Anaheim prior to the tssuance
of a buiiding permit.

6. That the owner(s) of subJec[ property shall pay the trafftc signal
assessment fee (Ordtnance No. 389~) in an amount as determined by the City Council~
for cammercial buildings prior to the issuance of a building permit.
7, That a 6-foot htgh masonry wall shall be constructed along the north
and west property lines~ and that wrought-iron gates (or other ornamental gates as
may be approved by the Planning Department) shall be installed at the northeasterly
and southwesteriy corners of the property connecting with the aforementioned block
wall with the motel building thereby restric[ing access to the northerly and westerly
yard setbacks.
II. That the proposed motel shall comply wtth ail siantng requirements of
the CL (Commercial, Limited) 2one.
9, That the o~rner(s) of subject property shall submit a letters requesting
the termination of Varia~ce Nos. 918 and 3~26 Co the Planning Commission.
10. That subject property shall be developed substantialiy in accordance
with plans and specifica:ions on file with the City of Anaheim marked Exhibit Nos. 1
and 2; and/or provided; however, that kitchen effictency untts with a maximum of 6-
cublc foot refrigerators; two-burner stoves, excludi~g oven and baking facilities;
and single compartment sinks may be tnstailed 1~ no more than 2;~ of the notei uni[s;
except [ha[ the manager's unit will be allowed to have full kitchen facilities; and
thac there shall be no windows in the north and west walls.
11. That Condition No. 9, above-mentioned, shall bc complied with prior to
the commencement of the activity authorized under this resolution, or prior to the
time that the buifding permit is issued, or within a period of one year from date
hereof, whichever occurs first, or such further tfine as the Planning Commission may
grant.
12, That Condition Nos. 2, 3, 4, 7, 8 and 10, above-mentioned, shall be
co:nplied with prior to Final butiding and zoning inspections.

applicant's compliance +oith each and ali of the condttlons hereinabove set forth.
Should any such conditfon, or any part thereof, be declared invalid or unenforceable
by the final Judgment of any court of competent jurisdiction, then this Resolution,
and any approvals herein contained, shall be deemed nuli and void.
