THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1944 BE DENIED
WHEREAS~ the Anahelm City Planning Commlssion dtd receive a verified
Petition for Conditlonal Use Permit from CHARLES AND PATSY CUNDIFF. 1141 North Cosby
Way~ Suite A, Anaheim~ Californla~ 92805, owners~ and ANAHEIM HILLS ~OMMUNITY
CHURCH, 52Q7 East Orangethorpe Avenue. Anaheim, Caiifornla 92807, agent, of certain
real proper[y situated in the City of Anahelm~ County of Orange, State of Californla,
described as:
PARCEL 2, IN THE CITY OF ANAHEIM COUNTY OF ORANGE~ STATE OF

evidence for and against said proposed conditional use and to investlgate and make
firtdl~gs and recanmendatlons i~ connectton therewich; and
WHEREAS, said Canmission, after due inspection, investigation and study made
by Itself and in its behalf~ and after due considerati~n of all evTdence and reports
offered at sald hearing, does find and determinc the following facts:
1. That the proposed use is properiy one for which a condittonal use
permit is authorized by Anaheim Munic(pat Cale 5ectiai 18.61.050.140 to wit: to
permit a church in the ML (Industrial, LTmlted) Zone.
2. That the proposed use Is hereby denled on the brsis that It would not
be compa[ible with the surrounding industrial uses; that a church would potentially
cause future parkinq and traffic problems Nlthin the surroundtng Industriat complex;
and that an undesirable precedent may bz estabiished if the use rrere gran[ed allowing
a church to te established tn an extsttng Tndustrtal complex.
3. That the proposed use H111 adversely affect the adJotning land uses and
che gra+th and development of Lhe area in which t[ ls proposed to be located.
4. That the size and shape of the site proposed for the use Is not
adequate to allow the fult development of the proposed use tn a manner not
detrimental to thn parcicular area nor to th~• peace, health, safety, and general
Nelfare of the Cltizens of the City of Anahelm,
5. That the granting of che Conditional Use Permit will be deLrimental to
the peace. health~ safcty and general welfare of [he CTtizens of the City of Anaheim.

EPJVIRONMENTAL IMPACT FINDING: That the Anahetm City Planning Commisslon has
revlewed the proposa to perm t a church In the ML (Industrlal, Limited) 2one on an
(rregularly-sheped parcel of tand consisting of approxlmately Q.7 acre having a
frontagc of approxtmately 20 feet on the north Nide of La Palma Avenue, having a
maximiun depth of approxtmately 3G0 feet. being located approximately 53~ feet ~+est of
the centerline of Lakeview Avenue; and does hereby approve [he Negative Declaratlon
from the requirement to preparc an environmental Impact report on the basis that
there ~+ould be no significant indivldual or cumulative adverse envtronmental impact
due to the approval of this Negacive Declaration since the Anahelm General Plan
destgna:es the subJect property for general indusirtal land uses commensurate with
the proposal; that no sensitive environmental Impacts are involved in the proposal;
that the Initlai Study submitted by the petitioner Indicates no signif(cant
indTviduaT or cumulative adverse envtronmental impacts; and that the Negative
Declaration substanLiating the foregoing findings ts on file in [he City of Anahelm
Plann(ng Department.
NOW, THEREFORE, BE IT R_SOLVEO that the Anaheim Ctty Plar.~ing CommTssio~
does hereby deny subject Petition for Condltional Use Permit on thc basis of the
aforementtoned findings.
