A RESOLUTION OF THE Al~AHEIM CITY PLANNIN~ COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 19~F0 BE DENIED
WHEREAS, the Anahelm Ctty Planning Commtssion dld recelve a verified
Petition for Conditional Use Permlt from RAYDELL RICHARD AMD LA WANDA HAZEL BOBST,
9282 Thistle Road, Anaheim, CalifornTa 92804~ owners of certain real property
situated in the Cicy of Anahelm, County of Orange, Ctate of Californta, described as:
Tne North 148.00 fcet of the South Z96.00 feet of the East 4 acres
of the North 10 acres o` the East 13 acres of the North 18 acres
of the East 30 acres of the Northeast quarter of the Northwest
quarter of Section 13. Township 4 Sou[h, Range ii Ves[, San
Bernardino Base and Mertdian. Excepting therefrom the Nor[h 53.5
feet thereof.
IrHEREAS, the Gity Planning Cor.mission dTd hotd a public hearing at the City
Hall in the City of Anaheim on february 12~ 1979. at ~:3e p.m „ nottce of said public
hearing having been duly gtven as required by law and in accordance wtth the
provisions of the Anahcim Municipal Code. Chapter 1R,pj~ to hear and consider
evidence for and against said proposed conditional use and to investlgate and make
findtngs and recommendations in connectton therewith; and
1JHEREAS~ sald Commission. af[er due inspection, (nvestigailon and study made
by itself and in ics behalf, and after due consideratton of ail evidence and reports
offered at said hearin9, does ffnd and determine the following facts:
1. That the proposed use is properly one for whlch a conditlo~al use
permit is authorized by Anaheim Municipal Code Section 18.03.030.010 to wit: to
permit the outdoor storage of mnsonry materials and cautpment In the RS-A-43~000
(Res(dential/Agricultural) Zone.
2, That the proposed use is hereby denied on the basTs that the exlsting
illegal use has had adverse impacts an the surrounding residentlal area; sald impacts
consisting of truck traffic, damage to adJolning property caused by stored equfpment
and materials, and stored equipment and matertals bcing vtsible from adJacent
residentTal propertles and streets; and, furthermore, that the use f~ TndustrTal Tn
nature and is not compatible with the surroundtng residentlal use.
3. That the proposed use w(11 adversely affect the adJotning land uses and
the growth and development of the area in whlch it is proposed to be locaced.
4, That the size and shape of the site proposed for [he use is not
adequate to allow che fuil developme~t of the proposed use in a manner not
detrimental to the particular area nor to the peace, health~ safety. and general
Helfare of [hc Cittzens of the Ctty of Anahcim.
5. That the granting of the Conditlonal Use Permic wTll be detrimental to
the peace. health~ safety and genera) welfare of the Ctttzens of the Ctty of Anaheim.

6. That three (3) persons indicated their presence at saTd public hearTng
in opposition; and that no correspondence was received in opposition to the subject
petition.
ENYIRONMENTAL IMPqCT FINDING: That the Anaheim CTty Planning CommTssion has
reviewed the proposal to permit the outdoor storage of masonry materials and
equlpment on a rectangularly-shaped parcel of land consisting of approximately 0.5
acre, having a frontage of approximately 95 feet on the ~rest side of Dale Avenue,
having a maximum depth of approximately 242 feet, being located approxlmately 355
feet south of the centerllne of Lincoln Rvenue; and does hereby dtsapprove the
Negative Declaration from the requirement to prepare an environmenta) impact report
an the basts that there wauld be significant individual or cumulative adverse
e~vironmental impacts.
NOW. THEREFORE, BE IT RESOLVED that the Anaheim Lity Planning Commlssion
does hereby deny subJect Peti[ton for Conditional Use Permit on the basts of the
aforementioned findings.
THE FOREGOING RESOLUTION is sfgned and approved by me this 12th day of
