A RESOLUTION OF THE ANAHEIN CITY PLANNING COMNISSION
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1942 BE GRANTEO
WHEREAS. the Anaheim Clty Planning Commission did receive a verifled
Petition for Conditlonal Use Permit from BEAM INVESTMENT CO., 137~ Narth Red Gum
Street, Anahetm, California 92806, ormer of certaln real property situated ln the
City of Anaheim, County of Oranae, State of Callfornia, described as:
Those portions of the West half of Lot 5 in Btock 6 of the Golden
State Tract, as shown on a map recorded In book 4~ page 66 of
Mlscellaneous Maps, records of Orange County. Californla.
described as follows: Parcel 1 as shorm on a map recorded In book
107, pa9e 47 of Parcel Maps in the office of the County Recorder
of said Orange County.
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the Gity of Anafieim on February 12, i979, at 1:j0 p.m.~ notice of safd public
hearing having been duly 9iven as requlred by law artd in accordance with the
provlsions of the Anaheim tlunictpal Lode, Chapter 18.03. co hear and consider
evidence for and against s.aid proposed conditlonal use anA to investlgate and make
flndtnys and recommendatlons in connection therswith; and
WHEREAS, said Cormnisslon, after due Inspection, investigatlon and study made
by itself and in its behalf, and after due consTderacion of a11 evidence and reports
offered at said hearing, dces f(nd and determine the fotlo++ing facts:
i, That the proposed use is properly ane for which a condltfonal use
permit is authortzed by AnaheTm Municlpal Code Section 18,03.030.010 to Wit: to
permit a truck rentat and leasing facili[y with a waiver of:

2. That the propnsed use Is hereby granted subject [o the follow(ng
condttions stlputa[ed to by the petitloner:
a. That all work on the trucks shal) be conducted wholly inside the
bullding.
b. That permitted mechanical work shall consist of minor repatrs and
matntenance of petittoner's vehicles only wich ne matntanance services
being offered to the ge~eral pubilc.

c. That landscaping plans showing dense landscaping along acd Gum and La
Jolla Streets shall be revTewed and approved by the Planning Commisslon
prior to [he Issuance of a building perm(t.
d. Thac no largc semi-tractor/traller type vehicles shall be stored on
subJect property.
e. That a maxtmum of twcnty-flve (25) 20-22 foot long "bobtall" trucks
shali be stored ~~ [he property at any one time.
f. 7hat adequate parking shall be provided on-slte for all employees,
rental vehicles and customer's vehicles.
3. That the proposed use will not adversely affect the adjoining lartd uses
a~d the growth and development of the area irt which It Is proposed to be located.
4. That the size and shape of the sice proposed for the use ts adequate to
allow the full development of the proposed use tn a manner not detrimental to the
particular area nor to che peace. health, safety. and general welfare of the Cltizens
of the City of Anaheim.

ENVIRONMENTAL IMPACT FINDING: That the Anahelm Clty Planning Commission has
revlewr,d the proposa ta perm t a truck rental and leasing facility with a waiver of
required enclosure of outdeor uses on a rectangularly-shaped parcel c" land
consis[Ing of approxlmatelY 1.1 acres located at the southeast corner of La Jolla
S[reet and Red Gum Street, having approxlmace frontages of 298 feet on the south side
of La Jolla Streec and 155 fcet on the east side of Red Gum Sireet; and dces hereby
approve the Negat(ve Declaratlon from [he requirement to prepare an environmental
impact report on the basls that there would be no significant individual or
cumuiative adverse environmental impact due Co the approval of thls Negative
Declaration since the AnaheTm Ceneral Plan designates the subject property for
general Industrial land uses commensurate with [he proposal; that no sensitive
environmental impacts are involved tn the proposal; that the Initial Study submttted
by the petltioner Indica[es no sTgnlficant Individual or cumulative adverse
envlronmental impacts; and that the Negatlve Declaration substantlating the Faregoing
findlnys is on flie in the City of AnaheTm Planning Oepartment.
NON~ THEREFORE~ BE IT RESOLVED that the Anaheim Ctty Planning CommlssTon
does hereby grant subJect PetT[lon for Conditlonal Use Permit~ upon the folloi+ing
conditions whtch are hereby found to be a necessary prerequlsite to the prcposed use
of the subJect property in ardcr to preserve the safety and general welfare of the
Citlzens of the Ct[y of anahelm:

~, Thai trash sLOrage areas shall be provided tn accordance with approved
plans o~ ffle with the Offlce of the Dlrector of Public Works.
2, That stree[ ligh[ing facilitles atong la Jolla and Red Gum Street shall
be installed prlor to the finat buildi~g and zoning inspectlons unless otherwlse
approved by the Director af Public Utilittes, and in accordance with standard
specificatlons on file in the Office of the D(rector of Public Utitities; and/or that
a bond, certlfica[e of deposit, letter of credit, or cash, in an amount and form
sattsfactory to the City of A~aheim shall be posted ~ith the City to guarantee that
the abov~ improvements will be tnstalled prior to occupancy.
3, In [he event tha[ subJect property is to be dfvlded for the purpose of
sale, lease, or financing, a parcel map, to record the approved dlvision of subJect
property shall be submitted to and approved by the City of Anaheim and ther be
recorded in the office cf the Orange County Recorder.
4, That th~: proposed business shall comply with all signing requirements
of the ML (Industr(al, Limited) Zone.
5, That the existin9 structure shall be brought up to the mintmum
standards of the City of Anaheim, lncluding the Uniform Building, Plumbtng,
Electric~l. Housing. Mechanical and Fire Codes as a~opted by the City of Anaheim.
6. That subJect property shall be developed substan[lally in accordance
with plans and spectfications on f(le wlth the City of Anaheim marked Exhlbit Nos. i
and 2; provlded, however. that there shall be a maximum of two drlveways on La Jolla
Stree[. each being 30-feet wide with one marked "entrance" and the other marked
"exit".
7. That landscapin9 plans showing dense landscaptng along La Jolla and Red
Gum Streets shall be sumitted to and approved by the Planning Commlssion.
8. That Conditton Nos. 2~ 3 and 7. above-mentioned, shall be compiled Hith
prlor to tht c~xnencement of the actlvity authorized under this resolution, or prior
to the time that !he buildtng permit is Issued~ or within a perlod of one year from
date hereof, whichever occurs first, or such further time as the Planning Commission
may grant.
9, That Conditlon Nos. i. 5 and 6, abovc-mentioned, shalt be complted wTth
prlor [o final building and zoning lnspections.
10. That all mechanical work on the trucks shall 6e conducted wholly tnstde
the building; that such work shall consfst of minor repalr and malntenance of the
petit(oner's vehtcles only, and that such rrork shall not be offered to ths general
public.
11, That a maximum of twenty-five (2$) 20'22 foot long "bobtali" trucks may
be stored on the property at any one tlme.

BE IT FURTNER RESOLVED that the Anahelm City Planning Lortmission does hereby
find and determine that adoptian of this Resolution is expressly predicated upon
applicant's comPliance with each and all of the conditions hereinabove set forth.
Should any such condition. or any part thereof~ be declared invalTd or unenforceable
by the final Judgment of any court of competent Jurisdictlon, then this Resotution,
and any approvals hereTn contained~ shali be deemed null and vold.
