UFiEREAS, the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on March 26, 197?, at 1:30 p.m „ notice of satd
publtc heartng having becn duly given as requfred by law and in accordance with the
provfslons of the Anaheim Municipal Code, Lhap[er 18,03, ta hear and consider
evide~ce for and agatns[ said proposed reclassif(cation and to investigate and make

findings and recommendations in connectlon therewfth; sald public hearing having been
continued to the Planning Commisslon meeting of April 9, 1979; and
WHEREAS, said Commtssion after due inspection, investigatton and study made
by itself and i~ its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine thc following facts:
1, That the pe[Itioner proposes reclassffication of subJect property from
the Geunty of Orange A-1 (General Agrtcultural) District to the C(ty of Anaheim ML
(Industrlal, Limited) Zone.
2. That the Anahetm General Plan designates subject property for ~eneral
industrlal land uses.
3. Tha[ the subject property will be developed generally in accordance
with plans as presented at [he pUblic hearlna, particularly ln terms of the parking
ratio (nunber of spaces to bullding floor area) and location of public street access
driveways.
4. That the proposed reclasslficaclon of subject property ls necessary
and/or desirable for the orderly and proper development of the community.
5. That the proposed reclassificatlon of sub)ect property does properly
relate to the zones and thelr permlt[ed uses locally estahlished in ciose proxlmity
to subject property and [o the cones and their permit[ed uses generally establl5hed
throu9hout the communi[y.
6, That the proposed reclassification of subject property requtres the
dedication and improvement cf abuttin9 stree[s in accordance with the Circulatlon
Element of the Generai Pian, due to the anticipa[ed inerease in traffic whfch will be
generated by the intensificaiion of land use.
7, That no one indicated [heir presence at sald public hearing tn
oppositlon; and that no correspondence was received in opposttion to the subJect
petf[ion.
EtIVIRONMENTAL IMPALT FINDING: That the Anahefm ~ity Plannlna Commission has
reviewed the proposal to rec assi y subJect property from the County of Orange A-1
(General Agricultural} Distric[ to the City of Anaheim HL (tndus[rial, Limited) Zone
on an irregularly-shaped parcel of land consisting of approximaeely 7.1 acres, having
approximate frontages of 613 feet on the south stde of Omega Avenue, 750 feet on the
west side of Sunfcis[ Street, and 276 feet on the north side of Wlnston Road and being
located approximately 655 feet snuth of the centerline of Ball Road; and does
hereby approve the Negative Oeclaratlon from che requirr.ment to prepare an
environmental impact report on the basis that there would be no significa~t
individual or cumulative adverse envlronmental impact due to the approval of this
Negative Declaratton since the Anaheim General Plan designates the s~bJect property
for general industrial land uses commensurate with the proposal; thai no sensitive
Pnvironmental impacts are Involvcd in the proposal; that the Initlal Study subm[tted
ay tlie petitloner indicates no significant i~divtdual or cumulative adverse
envtronmental Impacts; and that the tiegative ~Jeclaration substanttattng the foregotng
ftndings is on file tn the Ltty of Anaheim Planntng Department.

NOW, THEREFORE, BE IT RESOLVED that the Anahelm City Planning Commission
does hereby grant suhJect Petitton for Reclassification and, by so doing, that Title
18-Zoning of the Anaheim Municipa) Code be amended [o incorporate the above-descrtbed
property into tfie ML (INDU57RIAL, LIMITED) ZQNE upon the following conditions which
are hereby found to be a necessary prerequistte to the proposed use of subJect
property in order to preserve the safety and general welfare of the Cltizens of the
City of Anaheim:
i, That the owner(s) of subject property sliall deed to the Ctty of Anahelm
a strip of land 45 feet in width from the centerllne of the street along Sunkist
Street and 32 fee[ tn wid[h along uinston Road on an altgnnent approved by the City
Engineer for street widening purposes.
2. That ali engineerin9 requirements of the C(ty of Anahelm along Sunkist
Street and Ninston Road including preparation af improvement plans and installation
of all improvements such as curbs and gutters, sidewalks, street grading and ~aving,
draina9e facilities or other appurtenant rrork, shall be complied with as required by
the City Engineer and in accordance wi[h standard plans and specifications on file in
the Office of the City Engineer; that street Iighting facillties along Sunkist Street
and Winston Road shall be installed prtor [o f(nal buiiding and zoning inspections
unless othen+(se approved by the Director of Public Utilities, and in accordance with
specifications on file in the Office of the Director of Publtc Utilities; and/or that
a bond, cerciffcate of deposit, letter of credit, or cash, in an amount and form
satisfactory to the City of Anahelm shali be posted with the City to guara~tee the
instailation of the above-mentioned requirements.
3. That trash storage areas shall be provided in accordance with approved
plans on file with the Office of the Otrer_tor of Public Works.
4. That fire hydrants shatl be installed and charged as required and
determined to bc necessary by the Chief of the Fire Department prior to commencement
of structural framing.
5. That subject prnperty shal! be served by underground utlliCies.
6. That drainage of subjecc property shall be dTsposed of in a manner
satisfactory to the City Engineer.
7. In the event that subject property is to be divided for the purpose of
sale, lease, or financing, a parcel map, to record the approved division of subject
property shall be submitted to and approved by the City of Anaheim and then be
rec~rded in the office of the Orange County Recorder.
8. That the owner(s) of subject property shall pay appropriate drainage
assessment fees to the Clty of Anaheim as determined by the City Engineer prior to
issuance of a building permit.
9. That the developer shall construct a water main in Winston Road as
requlred by the ~eneral Manager of the Utilities Department.
10. That the owner(s) of subJect property shall pay the traffic signal
assessment fee (Ordtnance No. 3896) In an amount as determtned by the City Councll,
for industrial bulldings prior to the Issuance of a bullding permit.

12. That Londition Nos, t, 2, 7 and 11~ above-men[toned, shall be complled
witn prior to the commencement of the activity authorized under this resolu[ton~ or
prior to the time that the building permit is tssued, or within a period of one year
from date hereof, whichever occurs first, or such further time as [he Planning
Commission may grant.
13. That Condttion Nos. 3, 5, 6~nd 9, above-mentioned, shalt be complied
with prior to final building and zoning (nspections.
BE IT FURTHER RESOLVED tha[ the Anaheim Lity Planning Comnission does hPreby
find and determine that adoption of this Resolutton is expressly predicated upon
applicant's compltance with each and all of the tonditions hereinabove set `orth.
Should any such conditton, or any part thereof~ be declared invalid or unenforceable
by the final judgment of any court af canpeten[ jurtsdiction, then this Resolution,
and any approvals herein contained, shall be deemed null and void.
