WHEREAS, che Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from E'1YAY BUSINE55 CENTRE/ANAHEIM, 1720 East
Garry Avenue, San;a Ana~ California, 427~4, r~wncr, and E. 0. RODEFFER, 1720 East
Garry Avenue, Santa Ana, Lalifornia 92704, agent. of certatn rcal property situated
in the City of Anahcim, County of Orange, State of Lalifornia, described as:
Parcel 3 as shorm on a map ftied in Book 12E, pa9es 4 and 5 of
Parcel Maps, records of Orange County, Cafifornia,
WHEREAS. the City Plan~tny Lommission did schedule a public hearing at the
Lity Hall tn the City of Anaheim on March 26, 1Q7?, at 1:30 p.m,~ no[ice of said
public hearing having been duly oiven as requlred by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.~3, to hear and consider
evidence for and against said proposed condttional use and to Tnvestiqate and make
findings and recommendations in connection thereNith; said public hearing having been
continued [o the Planring Commisslon meet(ng of Aprll 23. i°7~: and
FIMEREAS, said Lortmission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evtdence and reports
offcred at said hearing, dces find and determtne the following facts:
1. That [he proposed use is properly one for which a conditional use
permit is authorized by Anahelm Muntcipal Code Stctlon 18.61.050,360 and
18.03.030.010 to permtt a sports and enter[ainment complex wtth dancing and on-sale
of liquor.
2. That the propostd use (s hereby qranted suhiect to the followfng
stipuiations made by the petitioner at the puhlic hearin~:
a. That the "Conference Room" wiil be ciosed after 5:00 P.M.
b. That when the "Stadium Lourt" ts in use for exhibiiton 9ames or any
other entertainment activities, [wenty-one (21) of the regular
racquetbali courts will not be used, and [hat the ltghts wil) be turned
off and the doors will be closed to those courts for the duration of
thc Stadium Court usagc.
c. That the serving of on-sale alcoholic bevera9es will be itmited to the
lounge near the racquetball courts and the bar located adJacen[ to [he
boNiing lanes~ and that no alcoholic beverages Nill be sold or served
elseNherc in the buiiding.
d, That food service will be ltmited to only sanciwiehes. salads and
similar foods and that no full dinners or luncheons will be served.
e. That the bo-vling facilfty will be lFmited [o thirty-seven (37) lanes.

3. That the proposed use wtll not adverscly affect the aJJolning lartd uses
and the growth and development of the area in Hhich it is proposed to be located.
4. That the stzc and shape of the site proposed for the use Is adequate to
allow the full development of the proposed use in a manner not detrtmental to the
particular area nor to the peace, health, safety, and general weifare of the Ctttzens
of the Clty of Anaheim.
5, That the gran[ing of the Londitional Use Permit under the condlttons
imposed, if any, Hill not be detrimentai to Che peace, health, safety and general
welfare of the Cltizens of the City of Anahetm.
6. That no one indlcaced thelr presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subJect
pe[ition.
EI~VIRONMENTAL IMPALT FINDING: That the Anahetm City Planning Commtssion has
reviewed the uroposa to permi[ a sports and entertalnment complex with dancing and
on-sale alcoholic beverages on an irregularly-shaped parcel of land consisting of
approximately 6.1 acres located north and east of the northeast corner of Orangewood
Avenue and Santa Cruz street, having approximate frontages of 6C feet on the north
side of Orangewood Avenue and 70 feet on the eas[ side of Santa Lruz Street. having a
maximum dep[h of approximately 741 feet; and does hereby approve the Negative
Declara[lon from the requiremen[ to prepare an environmenial lmpact repor[ on the
basis that there would be no signtficanc indtvtdual or cumulative adverse
environme.ntal impact due to the approvai of this Negative Declaratlon stnce the
Anaheim General Plan designates the subJect property for general industrial land uses
commensurate Nith che proposal; [hat no sensitive environmental impacts are involved
tn the proposal; [hat the Initial Study suhmitted by the petltioner indicates no
signiftcant individual or cumulative adverse environmental impac[s; and that the
Negative Declaration substantiating the foregoing ftndings is on file in the City of
Anaheim Planning Department.
NON, TNEREFORE, BE IT RESOLVED that the Anaheim Ctty Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the follov+ing
conditions which are hereGy found [o te a necessary prereGulsite to the praposed use
of the subject property in order to preserve the safety and general welfare of [he
Citizens of the Ci[y of Anaheim:
i. That the owner(s) of subJect propercy shall pay the traffic signal
assessment fee (Ordtnance No. 38y6) in an amount as determined by the City CouncTl,
for commercial buildings prior to the tssuance ~f a building permit.
2. That trash storage areas shall be provided In accordance with approved
plans on file with the Office of the Director of Public Works.
3, That subject properey shall be developed substantialty in accordanca
with plans and speciflcations on file with the CTty of Anahelm marked Exhibit No. 1
(Revision No. 2) and Exhibit Nos. 2 through 6; provided, however. that the number of
bow}ing lanes shall be limited to thirty-seven (37) not forty-six (46) as ortgt~ally
shown on Exhiblt No. 5.

4. That the proposed recreatton complex shall comply with all signing
requirements of the ML (Industrlal, Limited) Zone.
5. That Condition Nos. 2 and 3, above-me~tioned, shall be complted with
prior to final building and zoning inspecttons.
6. That the "Conference Room" (as shoorn on Exhibit No. 3 of the approved
plans) shalt be closed after 5:00 p.m.
7. That when the "Stadium Court" (as shown on Exhibi[ No. 2 of the
approved plans) is in use for exhtbition games or any other entertatnment activity~
twen[y-o~e (2i) of the regular racquetball courts (also shrnvn on Exh)bit No. 2) shall
not be used~ and that the lights shall be turned off and the doors closed [o those
courts for the duration of the SCadium Court usage.
8. That the serving of alcoholic beverages shall be limited to the lounge
near the racquetball courts (as shown on Exhibit No. 4 of the approved plans) and the
bar located adJacen[ to the bowling lanes (as shown on Exhibit No. S of the approved
plans), and that no alcoholic beverages will be sold elserihere in the building.
9. That food service shatl be limited to only sandwiches~ salads and
slmilar foods, and that no full dinners or luncheons N111 be served.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolutlon is expressly predicated upon
appiicant's compilance with eath and all of the condtttons hereinabove set forth.
Should any such condition, or any part thereof, be declared invalid or unenforceable
by the final Judgment of any court of competenc jurisdiction. then this Resolutton,
and any approvals herein contained, shall bc deG~ed null and void.
