NHEREAS~ the A~aheim City Planntng Commission did receive a verlfied petition for Reclassificatlon from CITY OF ANANEIM, 106 Worth Ciaudtna S*_reet, Sulte 607, Anaheim, Californla 92805, owner, and OWEN CA21ER~ 6731 Stanton Avenue, Buena Park, California 90620, agent, of certain real property situated in the Cfty of Anaheim, County of Orange, State of California, described as foilows: That portion of the East half of the Northxest quarier of [he Souihwest quarter of the Northwesc quarter of Sectlon 13. Tewnship 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51. page ii of Miscellaneous Maps, recards of Orange County, Californla, lying Northrresterly of the ~~orthwest line of Lot B of Tract No. 2655, as shown on a Nap thereof recorded in Book 79, pages 1, 2. 3 and 4 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom that portion conveyed to the Orange Lounty Flood Control District by deed recorded February 10, 1961 in Book 5625, page 512 of Official Records of Orange Lounty, California. WHEREAS, the City Planning Commission did hold a oubiic hearing at the City Hall in the City of Anaheim on Aprii 23, 1°7Q, at i:30 p.m., notfce of said publTc hearing having been duly given as requtred t~y law and tn accordance wfth the provisions of the Anaheim Municipal Code, Chapter 18,03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findtngs and recommendatlons in connectlon cherewith; and WHEREAS, said Commission. aftcr due irsspection. investigatlon and study made by itseif and in its behalf, and after due consideration of all evidence and reports offered a[ said hearing, does find and determine the following facts: i. That the peti[ioner proposes reciassificatlon of subJect property frcxn the RS-A-43,000 (Residen[tal/Agricultural) to the RM-1200 (Residenttai. Multiple- Family Zone. 2. That the Anaheim General Plan designates subject property for the medium density residenttal land uses. 3. That the proposed reclassiflcation of subJect property is necessary and/or desirable for the orderly and proper development of the cortimunity. 4. That the proposed reclassification of subJect property does properly relate to the zones and thei~ aermitted uses locaily established in close proxtmity to subJect property and to the zones and their permitted uses generalty establTshed throughout the community. 5, That no one indlcated [heir presence at said public hearing in oppositlon; and that no correspondence was received in oppositfon to [he subJect petition. Pt79-78 ENVIRONMENTAL IMPACT FINDING: That the Anahefm City Planning Lommisston has reviewed the proposa to rec ass fy subject property from thc RS-A-43,000 (Residential/Agrictultural) Zone to the RH-1200 (Resfdenttal, Multiple-Family) Zone to construct a 4-u~it apartment complex wich walver of maximum building height on an irregularly-shaped parcel of land consisting of approxlmately 0.4 acre. having a frontage of approximately 175 feet on the south sidc of an alley located southv~est of the southwesterly cul-~e-sac terminus of Floyd Avenue~ having a maximum depth of approximately 109 feet and being located approximately 328 feet cast of the centerline of Beach Boulevard; and does hereby approve [he tlegative Declaration from the requi~ement to prepare an environmental impact reporc on the basis that there would be no significant individual or cumulative adverse enviro~mental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subJect property for medlum density residential land uses commensurate Wlth the proposal; that no sensitive environmental impacts are tnvolved in [he proposal; that the Initial Study submitted by the petitioner indicates no sfynificant individual or cumulacive adverse environmental impacts; and that the Negative Declaration substantiating the fore9oing findtngs is on file fn the City of Anaheim Pianning Departmen[. NOW, 7HEREFORE, BE IT RESOLVED that the Anaheim City Planning Commtssion does hereby grant subJec[ Petitton for Reclassificatton and, by so doing, thac Tltle 18-Zoning of the Anaheim Huniclpal Code be amended to exclude the above-descrlbed property f~~ the RS-A-43~000 (RESIDENTIAL/AGRICULTURAL) ZONE and to Incorporate said described property into the RN-1200 (RESIDENTIAL, MULTIPLE-FAri(LY) ZQ11E upon the fo)lorring conditions which are hereby found to be a necessary prerequistte to the proposed use of subject property in order to preserve the safety and general aelfare of the Li[izens of the City of Anaheim: 1. That the owner of subject property shatl aay to thc City of A~ahefm the appropriate park and recreation in-lieu fees as determined to be appropria[e by [he City Council, satd fces to be paid at the tlme the butldtng permit is tssued. 2. That the owner(s) of subject property shall pay the traffic signal assessment fee (Ordinance No. 3Aa6) in an amount as determined by the City Louncil. for each new dwelling unit prlor to the issuance oP a butlding permit. 3. That trash storage areas shall be provtded in accordance with approved plans on file with the Office of the Director of Public Norks prior to final bullding and zoning in,pections. DE IT FURTHER RESOLVED that the Anahc(m City Planning Commission does hereby find and determine Lhai adoptfon of thts Resolution is expressly predtcated upon applicant's canptiance rrith each and ail of the conditions hereinabove set forth.
