WHERFAS, the ~nahelm City Planning Comm(ssion did receive a verified
peti[ion for Reclasstfication from ANAHEIM REDEVELOPMENT AGEtICY, 105 North Claudina
Street, Suite 400. Anaheim, Callfornla. 92805, owner, and MC CLELLAN, CRUZ, AND

WHEREAS, the Lity Planning Commisslon did schedule a public hearing at the
City Hall fn the City of Anahe(m on April 23, 1979, at 1:3D p.m., nottce of sald
public hearing having been duly given as required hy law and in accordance wtth the
provisions of [he Anaheim Hunicipal Code, Chapter 1P,.03, to hear and consider
evidence for and agai~st said proposed reclassification and to Investigate and make
findings and recommendations In connection therewtth; said public hcaring having been
continued to thc Planning Lommisslon meetin9 of May 7, 1979; and
WHEREAS, said Commisston after due inspection, Investigatlon and study made
by i[self and in its behalf, and after due consideration o` ail evidence and reports
offered at said hearing. does find and detcrmine the following facts:
1, That the petitioner proposes reclassificatton of subJect property fran
the CG (Commerctal, General) and PD-C (Parking Distric[-Commerclal) 2ones to the LL
(Ccmmercial, Limlted) Zone.
2. Tha[ the Anaheim General Plan designates subject property for general
commercial uses.
3. That the proposed reclassification of subJect property is necessary
and/or desirable for the ordcrly and proper development of the community.
4. That the proposed reclassiftcation of subject property dces properly
relate to the zones and their permit[ed uses locally estahlished in close proximity
to subJect property and to the zones and their permitted uscs generally estabiished
throughout the cortmunity.

ENVIRONMENTAL IMPALT FINDING: Tha[ the Anahelm City Planning Lommtssion has
revfewed [he proposal to rec assi y subJect property frcxn the LG (Commercial,
General) and PC-C (Parkin9 Oistrict-Commercial) Zones to [he CL (Crnmercial. Limited)
Zone on an irregularly-shaped parcel of la~d consisting of approximately 10.8 acres
located at [he south wes[ corner of the proposed realignment of Lincoln Avenue and
Anaheim Boulevard, having approximate frontages of 1050 feet on the south side of
Lincoln Avenue, 540 feet on the west side of Anaheim 8oulevard, 33k fcet on the east
s(de of Clementine Street and 375 feet on the north slde of Oak Street; and does
hereby approve [he Negative Declaratlon from [he requlrement to prepare an
environmental im~act report on the basls tha[ there would be no significant
ind(vidual or cumulattve adverse environmental Impact due to the app~oval of this
Ne9ative Declaration sTnce the Anahelm Genera) Plan deslgnates the subJect property
for general comnercfal land uses commensuratc wi[h the prop~sal; ttiat no sensTtive
environmental Impacts are involved in the proposal; that the Initial Study submTtted
by the p~titioner indtcaces ~o sfgnlficant indiv(dual or cumulative adverse
envfronmental Impacts; and that [he Negatlve Occlaratian substantlating thc foregoing
findings is on file in the City of Anahelm Planning Department.

NON~ THEREFORE, BE IT RESOLVED that the Anaheim City Plannfng Commission
does hereby grant subJect Petitlon for Reclass(fication and. 5y so ~otng~ that Title
18-Zoning of the Anaheim Nunicipal Code be amended to exclude the above-described
property from the CG (LOMMERCIAL, GENERAL) and PO-C (PARKING OISTRICT-COMMERCIAL)
ZONES and to incorporate said described property Into the CL (COMMERCIAL. LIMITEO)
ZOI~E upon the following conditlons which are hereby found to be a necessary
prerequisite t~ the proposed use of subJect property in ordcr to preserve the safety
and ge~eral welfare of the Ctttzens of the City of Anaheim:
1. That prtor to the time that a building permit is issucd, the owner(s)
of subject property shall apply for, and obtain. reclassification of subJect property
from Fire Zone No, t to Fire Zone No. 2.
2. Thac prior to occupancy, all building on subject property shatl be
constructed with fire sprin~lers and Type 5, one-hour construction throughout.
3. Prlor to Introduct(on of an ordinance rezoning subJect property, the
rnrner(s) shall submit a letter requesting terminatlon of Variance Nos. 176~ 774~ and
1042 and Conditional PermTt Nos. 157. 430. 650 and 1441 to thc Planning Camnissfon.
BE IT FURTNER RESOLVED thac the Anaheim City Planning Cam~tssion does hereby
find and determine that adoption of this Resolution is expressly predica[ed upon
applicant's compliance with each and all of the condittons hereinabove set forth.
Should any such condi[ton, or any part thereof, be declared tnvalid or unenforceable
by the final Judgment of any court of competent Jurisdiction, then this Resolution,
and any approvals herein con[afned, shall be deemed null and void.
