A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TNAT PETITION FOR COHDITLONAL USE PERMIT N0. 1980 BE DEIIIED
WHEREAS, thc Anaheim Cify Planning Commissfon did receive a verified
PetitSon for Conditional Use Per~it from RICHARD 5. MACKENSEN AND ELSIE MACKENSEN,
1616 South Euclid Street. Anahelm, Lalifornfa 92G02, owners, and JOHN h, BEFU~BROCK,
625 South Euclid Street, Anaheim. California 92802, agen[, of certain real property
situated in the CitY of Anaheim, County of Ora~ge, State of California, described
as:
Lot 4 of Block "C" of [he "Center 7ract", in the City of Anaheim,
as per maP recorded in bock 14, page i3, Miscellaneous Records,
in [he office of the county recorder of Los Angeles County.

WtiEREAS, [he City Plannfng Gommission did hold a public hearing at ths
Lity Hal) in the Lity of Anaheim on May 21, 1979, at 1:30 p.n., notice of sald
public hearing havi~g been duly given as required by law and in accordance with
the provisions of the Maheim Municipal Lode, Chapter 18.03, to hear and consider
evIdence for and a9ainst said proposed conditional use and [o investigate and
make findings and recommendations in connection therewith; and
N11[REAS, said Commisston, af[er due i~spection. inves[igation and study
made by itself and in its behalf, and after due consideration of all evidence and
reports offered at said hearing, does find and determine the following facts:
i. That the proposed use is properly one for which a conditional use
permit is authorized by Anahe(m Municipal Code Section 18.45.050.040 to NtC: to
Permit an adult book store.
2. That the proposed use Ntll adversely affect the adJointng land uses
and the growth and development of the area in wfitcf~ it is proposed to be focated,
3, That che size and shape of the site proposed for the use is adequaie
to allow the full development of the proposed use ln a manner not detrimen[al to
the particular area ~or to the peace, health. safety and general Welfare of [he
Citizens of the City of Anaheim.
4. Tha[ the granting of the Londi[tonal Use Permit u~der the conditions
imposed, if any, will be detrimen[al to the peacc, health, safety and general
welfare of the Citizens of the City of Anaheim.
5, That no one indicated their presence at said public hearing in
opposition; and that one letter was rcceived tn opposition to the subJect petition.
EUVIRONMENTAL IMPpCT fINDiNG: That the Anaheim City Planning Commission
has revicwred thc proposa to perm t an adult book stor.e on a roctangularly-shaped
parcel of land consisting of approximately 2865 square feet having a frontage of
approximately 21 feet on the south side of Lincol~ Avenue, a maximum depth of
approximately 135 feet, being located approximately 110 feet east of the center-
line of Philadelphia Street; and does hereby approve the Negatlve Declarat(on

from Che requirement to preparc an environmental impact report on the basis that
there would be no sfgnificant individual or cumulative adverse envlronmental impact
due to the approvai of this Negat(ve Declaration since tht Anaheim General Plan
designates the subJect property for general camnerclal land uses commensurate wtth
the proposal; that no sensitive environmen[al impacts are involved in the proposal;
that the initial Study submitted by the petitioner indtcates no significant
individual or cumulative adverse environmental impacts; and that the Negative
Declaration substantiattng the foregoing findings is on ftle in the Ctty of Maheim
Planntng Department.
NOW, THEREFORE, BE IT RESOLVED that [he Anaheim Ctty Planning Lommisslon
docs hereby deny subject Petition far Conditio~al Use Permit on [he basis of the
aforementioned findings.
THE FOREGOING RESOLUTtON is signed and approved by me this 21s[ day of
