WNEREAS, the City Planning Conmission did hoid a punlic hearing at the City
Hali in the City of Anaheim on June 3~, 1~30, at 1:3!? p,m., notice of said public
hearing having heen duly giver as required by la~•~ and in accordance with the
provisions of the Anaheim '1unicipal Code, Chapter 18,~3, to hear and consider
evidence for and against said propose~ conditional use permit an~ to investigate and
make findtngs and recommendarions in connection thereivith; and
WHEREAS, said Cummission, aftcr due inspectiort, investigation and study made
by itself and in its bef~atf, and after due consfderation of all evidence and reports
offered at said hearing~ does find and determfne t!,e folloo~in9 facts:
1. That the proposed use is nro~erly one for ~rhich a c~nditional use
permit Is authorized by Anahcim "lunicipal Co,fe Sec[ion 1F.lf~~_~5p,!1~n to ~~rit: to
permit on-sale heer and wine in an existinc~ r~staurant.

2. That the proposed use ~vill noC adversely affect the adjoining land uses
and the yrowth ancl development of the area in ~•rhich it is proposed to he located,
3. 7hat the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not de*.rimental to the
particular area nor to the peace, health, safety, and general ~~elfare of the Citizens
of the City of Anaheim.
1t. That the granting of the Conditional Use Perr~it under the conditio~s
imposed, if any, will not be detrimenral to the peace, heaith, safety and general
weifare af the Ci:izens of tlie City of Nnaheim,
5. That the traffic generated by the proposed use ~•rill not impose an undue
burden upon the streets and high~~~ays designed and improved to carry the traffic in
the area.

opposition; and that no correspondence was received in opposition to the subject
petition.
ENVIROIJMEIdTAL IMPACT FINQIP!G: The Planning Director or his authorized
representative has determined that the proposed project falls ~:~ithin the definition
o` Categorical Exemptions, Class 1, as defined in Para,raph 2 of the City of Anaheim
Environmental Impact Report Guidelines and is, therefore, categoricall;~ exempt from
the requirement to prepare an EIR.
NObI, THEREFORE, BE IT R[SOLI/ED that the Anaheim City ?lanning Commission
does hereby grant subject Petition for Conditional Ilse Permit, upon the following
conditions which are hereby found to be a necessary prereyuisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Cittzens of the City o` /lnahcin:
1. That subject property shall be developed substantially in accordance
wtth plans and specificat°ons on file with the City of Anaheim marl-ed Exhibit tJo. 1.
BE IT FURTfiEP, RESOLb'ED that the Anaheim City Planning Commission does hereby
ftnd and determine that adoption of this P.esolution is expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Should any such condition, or any part thereof, be declared invalid or unenforceable
by the final judgment of any court of ~ompetent jurisdiction, then this Resolution,
and any approvals lierein contained, shall be deemed null and void.
THE FOREGOING RESOLUTIOtI is signed and approved by me this 3~th day of June,
