WHEREAS~ the City Planning Commisston did hold a public hearing at the City
Ha11 tn the ~~ty of Anaheim on July 28, ig$0, at 1:30 p,m., notice of said public
hearing having been duly given as required by law and 1n accordance wlth th~
Provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
eviderce for and against said proposed conditional use permit and to ir~v~sttgate and
make findings and ~ecommendations in connection therewith; anci
WHEREAS, said Commission, after due inspecticn, investtgarton and study made
bY itself and tn its behalf, and after due consideration of all c ence and reports
offered at sald hearing, does find and determine the following fa~._,:
~, That the proposed use is properly one for o-,htch a condttional use
permit is authorized by Anaheim Municipal Code Sectton 16.ti1,,o5o,~ip to wit: to
permit on-sale beer and wine in an existfng restaurant.

3. That the proposed use ~vill not adversely affect the adjoining land uses
and the growth and development of the area in a~hich it is proposed to be located.
1+, That the size and shape of the site proposed for the use is adequate to
alloiv the full develupment of the proposed use in a manner not detrtmental to the
partPcular area nor to the peace, heal*_h, safety~ and general welfare of the Citizens
of thc City of Anaheim.
5. That the granting of the Conditional Use Per~tt under the condittons
imposed, if any, will not be detrimental to the peace, health, safety and general
welfare of the Citlzens of the City of Anaheim,
6. That the traffic generated by the proposed use will not tmpose an undue
burden upon the streets and highways designed and imoroved to carry the traffic in
the area.
7. That no one indlcated their presence at satd public hearing tn
opposttion; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL INPACT FINDING: The Planning Director er his authorized
representat~ve fizs determ ned that the proposed project falls within the def(nition
of Categorical ExempCions, Class 1, as defined in Paragraph 2 of the Cfty of Anaheim
Environmental Impact Report Guidelines and is, therefore~ categorically exempt from
Lhe requirement to prepare an EIR.
NOW~ THEREFORE, BE 17 RESOLVED that the Anaheim City Planning Ca.nmission
does hereby grant subject Petitton for Condttional Use Permit, upon the following
cond;tions which are hereby found to be a necessary prerequisiie to the proposed use
or" the subject prcperty in order to preserve the safety and general welfare of the
Ci`tzens ~+f the Ctty of Ar,aheim:
1. That subject property shall be developed substantially In accordance
with plans and specifications on file with the City of Artaheim marked Exhibit Nos. 1
through 3•
BE IT FURTHER RESOLVED that the Anaheim City Planning Commisston does hereby
find and determine that adoption of this Resoiution ts expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Shou)d any such condition~ or any part thereof, be declared tnvaltd or unenforceable
by the f(nal judgment of any court of competent jurisdictlon, then thts Resolutlon~
and any approvals herein contained~ shall be deemed nuii and void.
