WFIERFAS, the City Planning Comnission did hold a public hearlnq at the Civic
Center in the Ci[y of Anaheim on September 22, 5980, at 1:30 o.n „ notice of said
public hearing having been duly given as required by law anci in accordance ~vith the
provisions of the Anaheim 1lunicipal Code, Chapter 19,03. to hear and consider
evidence for and against said proposed conditional use ~ermit and to investigate and
make findings and recom^~enda[ions in connection therewith; and
WHEREAS, said Commission~ after du~ inspec[ton, investigation and study made
by itself ar,d in Its behaif~ and after due consideration of a11 evidence and reports
offered at sald hearinS, does find and determine [he folinwing facts:
1. That the proposed use is properly one for ~ahich a conditional use
per~nit is authorized by Anaheim Flunicipal Code Section 1~.?.1.~50,3?-~ to wit: to
permit a concrete and asphalt recyclin9 operation in the RS-A-~~3,00(1(SC)
(Residential/Agricultur~l - Scentc CorrTdor ~verlay) Zone.
2. That the nroposed usc is 9ranted for a period of ta+o (7) years, subiect

7. That no one indicated their presence at said p~blic hearing in
~PP~sition; and that no correspondence was received in opposi;:ion to the subject
petition.
EMVlRONMENTAL IMPACT FINDING: That the Nnahetm City Plannino Commissi~n has
reviewed the proposal to permit a concrete and asphalt recycling operation in the
RS-A-43,OOQ(SC) (Restdential/Agriculturai - Scenic Corrid~r Overlay) 7one on an
irregu)arly-shaped parcel of land consisting of a~proximately !,0 acres, having a
fror.tage of approximately 650 feet on the east stde of Richfteld Road, having a
maximum depth of approximately 740 feet and being located approximately 1280 feet
south of the centerline of La Palma Avenue; and does here.by approve the Negative
Declaration from the requirement to prepare an environmental impact report on the
basis that there ~~ould be no significant individual or cumulative adverse
envlronmental impact due ~o the approval of this Plegative Declaratton since the
Anaheim General Plan designates the subject property f~r general industrial land uses
cortxnensurate with the proposat; that no sensitive environmental imoacts ar~ iR.~~)y~~
in the proposai; that the ;nit~ai Study submftted by the petitioner indicates no
significant individual or cumu)ative adverse environmental impacts; and that the
Negative Declaration substantiating the foregoing findings is on file in the City of
Anaheim Planning Department.
N04/, THEREFOftE, BE IT RESOLVED that the Anaheim City P)anntng Commission
does hereby grant subject Petition for Condittonal UsP Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general ~velfare of the
Citizens of the City of Anaheim:
1. That the owner(s) of subject proryerty shall pav the traffic signal
assessment fee (Ordinance No. 3~396) in an amount as determined by the City Council,
for industrial buildings prior to the issuance of a building permit.
2. That trash storaye areas shall be provided in accordance ~•~ith aoproved
plans on file with the Office of the Executive Directe~r of Pubiic Idorks.
3. That the owner(si of suhject property shall suhmtt a letter requesting
the termination o` Conaitional Use Permit No, 67S to the P)anning Department.

4. That subject property shall be developed suhstantially in accordance
with plans and speci`ications on filP ~•~ith the City of Anaheim marked Fxhihit No. 1
5, That Condition !!o. 3, ahove-mr,ntioned, shall be complied with prior to
the commencement of the activity authorized ur.dar this rPSOlution, or prior to the
time that the building permit is issued, er ~~ithin a period of one year from date
hereof, whichever uccurs first, or such further time as the PTanning Commission may
grant.
6. That Condition tlos. 2 and 1E, ahove-menttoned, shall he complied with
prior t~ final building and zoning inspections.
7, That the proposed use is granted for a period of t~~~o (2) years, subject
to review for possible extensions of time.
BE tT FURTHER RESOLVFD that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predtcated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Should any such condition, er any part thereof, be declared invalid or unenforceable
by the final judgment of any court of competent jurisdiction, then this Resolution,
and any approval~ herein contained, shall he deemed null and void.
