A ZESOLUTION OF THE ANAHFIM CITY PLANNING COMMISSIOPJ
TNAT PETITION FOR RECL~ISSIFICATION N0. 7;-80-29 BE GRANTED.
WHEREAS, the Anaheim City Planning Commission did receive a verified petition
for Reclassification from GORDON E. SLOAN, 345 Carousel, Anaheim, California 92806,
owner, of certain real property situated in the City of Anaheim, County or Orange,
State of California, described as:
LOT 134 OF TRACT 1825, IN THE CITY OF ANAHEIM, COUNTY OF ORAtJGE,
STATE OF CALIFORNIA, AS PER MAP RCCORDED ItJ BOOIC 62, PAGES 4;, "
AND 45 OF MISCELLAPJEOUS MAPS, IN THE OFFICE OF THE RECORDER OF
SAID COUNTY.
WHEREAS, the City ?lanning Commissior~ did hold a public hearing at the Civic
Center in the City of Anaheirri on October 20, 1980, at 1:30 p.m., notice of said
public hearing having been duly given as required by la~-~ and in accordance with the
provisions of the Flnaheim Municipal Code, Chapter 18.U3, to hear and consider evidence
for and against said Nroposed reclassification and to investigate and make findings
and recommendations in connection thereo-~ith.
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due cunsideration of all evidence and reports
offered at said hearing, does find and deterinine ttie following facts:
1. That the petitioner proposes reclassification of subject property from
the RS-7200 (Residential, Single-Family) to the RM-1200 (Residential, tlulti-Family)
Zone.
2. That the Anaheim General Plan designates sub;ect property for low and
low-medi~m density residential land uses.
3. Th~t the prnpoced reclissification ~f subject oroperty is necessary
and/or desirable for the orderly and proper developrnent oF the cemmunity.
4. That the proposed reclassification uf subject property does properly
relate to the zones and their permitted uses locally established in close proximity
to subject property and to the zones and their permitted uses generally established
throughout the comrtiunity.
5. That 1 person indicated his presence at said public hearing in
opposition; and that no correspondence was received in opposition to subject petition.
ENVIP.~NMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has
reviewed the proposal to reclassify subject property from the RS-72Q0 (Residential,
Single-Family) tu the RM-1200 (Residential, Multiple-Family) Zone to permit two
detached single-family dwellings with waiver of minimum lot area per dweliing unit on
an irregularly shaped parcel of land consistirg of approximately 0.22 acre, having a
frontage of approximately G8 feet on the south side of Belmont Avenue, having a
maximum dapth of approximately 16~ feet and being located approximately 280 feet east
of the center!ine of East Street; and does hereby approve the Negative Declaration
from the requirement to prepare an environmental impact report on the 6asis that
there would be no significant individual or cumulative adverse environmental impact

due to the approval of this Negative Declaration since the Anahelm General Plan
desi9nates tlie subject property for low and loar-medium density residential land
uses commensurate o~ith the proposal; that no sensitive environrnental impacts are
involved in the proposal; that the Initial Study submitted by the petitioner
indicates n~ significant individual or cumulative adverse environmental impacts;
and that tiie Negative Geclar~tion substantiating the forenoin~ findin~s is on
file in the City of Anaheim Planning Department.
~JOW, TtiEREFORE, BE IT RESOLVED that tlie Anaheim City Planning
Commission does hereby grant subject Petition for Reclassification and, by so
doing, ttiat Title lu-Zoning of the Anahein tlunicipal Code be amended to exciude
ttie above-described property from the RS-7Z00 (RESIDE~ITIAL, SINGLE-FAMILY) ZONE
and to incorporate said property into the P,~1-1700 (RESIDEtJTI~L, t1ULTIPLE-FAMILY)
ZOtJE upon the following conditions which are hereby found to be a necessary
prerequisite to the proposed use of subject property in order to preserve the
safety and general we!fare of tFie Citizens of A ~heim:
1. That the owner of subject property shall pay to the City of Anaheim the
appropriate park and recreation in-lieu fees as determined to be appropriate by the
City Council, said fees to be paid at the tine thc building permit is issued.
2. That the owner(s} of subject property sfiall pay the traffic signal
assessr~ient fee (Ordinance tdo. 3~96) in an amount as determined by the City Council,
for each new cJwelling unit prior to the issuance of a building permit.
3. 7hat subject property shall be developed substantially in accordance
with plans and specifications on file ~•rith the City of Anaheim marked Exhibit Wos. 1
through 3.
4. That Conclition No. 3, above-mentioned, shall be complied with prior to
final building and zoninn inspections.
BE IT FURTHEF RESOLVED that the A~aheim City Planning Commission does hereby
find and determine that the adoption of this Resolution is expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
ShQUId any condition or any part thereof, be declared invatid or unenforceable by the
final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals tierein contained, sliall be deemed null and void.

THE FOREGOING RESOLUTION is signed and approved by me this 20th day of
