AMENDING COPJDITION N0. 6 OF RESOLUTION N0. PC80-54

IN CONNECTION WITH CONDITIOPIAL USE PERt41T N0. 2056
WHEREAS, the petitioner suhmitted a request for an amendment to the
conditions of approval contained in Planning Commission Resolution No. PC80-5~F
adopted in connection with Conditional Use Permit No. 2056 permitttng a contractor's
storage yard on property consisting of approximately 1.1 acres located on the south
stde of l,a Joila Street approximately 18D feet west of the centerline of Red Gum
Street, and further described as 2920 East La Jolla Street; and
WHEREAS, the petitioner ^equests deletion of the followino condition
contained in the above-referred to ,CSOlution:
"6. That all outdoor storage areas be completely paved with
asphalt to a minimum depth of three (3) inches."
WHEREAS~ the Anaheim City Planning commission did hold a public hearing at
the Civic Center in the City of Anaheim on PJovember 17, 198~, at 1:3~ p.m., notice of
said public hearing having been duly given as required by law and in accordance a~ith
tlie provisions of the Anaheim Municipal Code, to hear and consfder evidence f~r and
against said proposal to amend the conditions oF approval of Conditional Use Permit
No, 2056, and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation :~nd study made
by itself and in its behalf, ar,d after due consideration of ail evidence and reports
offered at said hearing, DOES HEREBY FIPJD:
1, That one person appeared at said public hearing in opposition; and that
no correspondence oias received in opposition to the subject request.
2. That the petitioner stipulated to providing one inch to one and one-
half inches of decomposed granite, to oiling the storage area in order to control the
dust, and to maintaining said 3round treatment.
3. That since Conditional Use Permit P~o. 2056 was originally granted for a
three (3) year pertod to expire on March 2~, 1g83, this approval for decomposed
graniYe paving and oiling shall also expire on March 2!!, 1983, unless a time
extension for the use permit is granted hy the Planning Commissi:.n,
ENVIRf1NMENTAL IMPF,CT FINDING: That a Plegative Declaration was previously
approved on March 2, 19 0 and no urther action is necessarv.
NOW~ THEFEFORE BE IT RESOLVED that the Anaheim City P)anning Commission does
fiereby amend Condition No. 6 of Resolution No. Pc8n-54 to reacl as follows:

"6. That all outdoor storage areas shall be completely covered
with one to one and one-half inches (1" to 1-1/2") of decomposed
granite~ that the entire area shall be oited to control the dust
and that satd ground treatment shalt be adequately malntained,"
BE IT FURTHER RESOLVED that the Anaheim City Pianning Commission does hereby
ftnd a~d determine that the adoption of this Resolution is exprassly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Should any condition or any part thereof, be declared invalid or unenforceab)e by the
final Judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is signed and approved by me this 17th day of
November, 1980.
