THAT PETITION FOR CONDITIONAL USE PERMIT N0. 2133 BE GRA~lTED
WHEREAS~ the Anaheim City Planning Commission did receive a verified
Petition for Condittonal Use Permit from NALCOLM A. TOWtlSEND AND NAOMI D. TOWNSEND~
855 South liarbor Boulevard, Anaheim, Californla 92805, owners~ and JOSEPH B.
~ICKERSON, 7172 Garden Grove Boulevard~ Garden Grove~ Calffornta 926~E1, agent, of
certain real property sltuated in the City of Anaheim, County of Oranae, State of
California, described as:
Lot 34 of Tract Wo. 1392, 1n the City of Anaheim, as per map
recorded in Book 42~ Pages 25 and 26 of Miscellaneous Maas, In the
office of th~ County Recorder of said County.
WHEREAS, the City Planning Commission did hold a puhlic hearing at the Civic
Center in the City of Anaheim on November 17, 1980, at 1:30 p.r~., notfce of said
public hearing having been duly given as required by la~i and in accordance with the
provisions of the Anaheim Municipal Cade, Chapter 18.03. to hear and consider
evidence for and against said proposed conditional use permtt and to investigate and
make findings and recomniendations in connection therewith; and
WNEREAS, said Commission, after due inspection, inve.stigation and study made
by itself and in its behalf~ and after due consideration of all evtdence and reports
offered at said hearTng, does find and determine the following facts:
1, That the prc~posed use is praperly one for which a conditional use
permTt is authorized by Anaheim Mvniclpal Code Sectlon tA,1~~,n~~,~3~ La rrtt• to

2. That the proposed use is approved for a sales oPfTce for manufacturer's
~epresentatives as stipulated to by the petitioner.
3. That the requested waiver is hereby granted on the basts that the
proposed use, a manufacturer's representatives sales office, will not have customers
an~ clients coming to the office~ thereby reducing the need for parking spaces.
4. That the proposed use~ as granted, will not adversely affect the
adjoining land uses and the growt;i and development of the area in which it is
prcposed to be located,
5. That the size a~d shape of the site proposed for the use, as granted~
is adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nar to the peace, health. safety, and genet-al
wetfare of the Citizens of the City of Anahetm,

6.That the granting of the Conditional Use Fermtt under the conditions
imposed~ if any~ will not be detrimental to the peace, health, safety and general
welfare of the Citizens of the City of Anaheim,
7. That the traffic generated by the proposed use, as granted, wlll not
impose an undue burden upon the streeLS and highr~ays ~esigned and tmproved to carry
the traffic in the area,
$. That no one indicated their presence at said publlc hearing in
opposition; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL IMPACT FItJDING: That the Anaheim City Plannina Commission has
reviewed the proposal to permit an o fice use in a residential structure with waiver
of minimum number of parking spaces on a rectangularly-shaped parcel of land
consisting of aoproximately 5700 square feet, having a frontage of approximately 61
feet on the east side of Harbor Boulevard, having a maximum depth of approximately 93
feet~ being located approximately 573 feet north of the centerline of Vermont Avenue;
and does hereby approve the Negative Declaration from the requirement to prepare an
envtronmental impact report on the basis that there would be no significant
fndividual or cumulative adverse environmental tmpact due to the approval of this
Negative Declnratton since the Anaheim Generai P)an designates the subject property
for cortmerctal/professional land uses commensurate with the proposal; that no
sensitive envtronmental impacts are involved in the proposal; that the Initial Study
submitted by the petitloner indicates no signiftcant tndividual or cumulative
adverse environmental impacts; and that the Negative Declaration substantiattng the
foregoing findings is on file in the City of Anaheim Planning Department.
NOW, THEREFORE~ BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the foliow)ng
conditions which are hereby found to b~ a necessary prerequisite Zo [i~e proposed use
of the subJect property in order to preserve the safety and general weifare of the
Citizens of the City of Anaheim:
1. That trash storage areas shall be provided in accordance with approved
plans on f11e with the Office of the Executive Director of Public Works.
2. That the owner(s) of subject property shall pay the traffic signal
assessment fee (Ordinance No. 3896)~ in an amount as detenni~ed by the City Council~
for the existing 1185 square feet of floor area, prior to the fssuance of a building
permit.
3. That the proposed office use shall comply with Anaheim Municipal Code
Sectton 18,41.050.138 pertaining to signs for office uses in residential structures.
4. That the use of thts structure shall be limited to a sales office for
manufacturer's representaitves unless othewise approved by the Planning Commission.
5. That subject property shall be developed suhstantially in accorda~ce
wi*.h plans and specification on f1)e wtth the City of ~naheim marked Exhibit No. !.
G. That Condition Nos, 1, 3 and 5. ahove-mentio~ed, sfiali be complied with
prior to final building and zonfng inspections.

~~ BE IT FURTHER RESOLVED that the Anaheim City Planning Commissfon does hereby
find and determine that the adoption of this Pesolution is expressly predicated upon
applicant's complfance with each and all of the conditlons heretnabove set forth.
Should any condition or any part thereof, be declared invalid or unenforceable by the
final judgment of any court of competent jurisdictlon. then this Resolution, and any
aPprovals herein contained, shall be deemed null and votd.
THE FOREGOING RESOLUTION is signed and approved by me this 17th day of
