THAT PETtTIOfJ FOR COPIDITIONAL USE PERMIT N0. 213~ BE GRAFJTED
WHEREAS, the Anahetm City Planning Cor.~misslon did receive a verified
Petitlon for Condltional Use Permit from APlA11EIM BUSI~IESS CEPITER CONPA~JY, (Ertc
Marten), 1212 North Broadway, Suite 140~ Santa Ana, California, 42701, owner~ and
~AVI~ ALLYN NEEDHAM. 2532 Ctrcle Drive~ Neiaport Beach~ Caltfornta ?26E3~ agent~ of
certain real property situated in the City of Anaheim, County of Orange, State of
California, described as:
Parcel One of Parcel Nap recorded in 9ook 13u" paaPS 27 and 2? of
Parcel Maps record of Orange County CalPfornia.
61NEREAS~ the City Ptanning Commissfon did hold a public hearing at the Civic
Center in the City of Anaheim on November 17, 1930, at 1:3~ p.m., notice of said
public heartng having been duly given as required by )aw and in accordance with the
provisions of the Anahelm Municipa) Code. Chapter 18.03, to hea~ and cortstder
evidence for and against said proposed conditional use permtt and to investiqate and
make findings and recommendations tn connection therewith; and ~
WHEREqS, sald Commtssion, after due inspection, investigation and study made
bY itself and in i[s behalf~ and after due consideration of al) evidence and repnrts
offered at said hearing, does find and determine the followinq fac[s:
1. That the proposed use is properly one for which a conditional use
permit ts authorized by Anaheim Hunicipal Code Section 1d.030.l13~,~10 to wTt: to

2. That the proposed use is hereby granted for a period of three (3)
years, subject to review f~r possible extensions of time.
3. That the proposed use will not adversely affect the adJoining land uses
and the growth and development of the area in whtch it is proposed to be located,
4. That the size and shape of the site proposed for the use is adequate to
a11ow the f~11 development of the pr~posed use in a manner not detrimental to the
particular area nor to the peace~ health~ safety. and g.:~eral we~fare of the Citizens
of the City of Anahetm,
5. That the granting of the Conditional Use Pernit under the condittons
imposed~ if any~ wi11 not be detrimental to the peace, health, safety and genera)
welfare of the Citizens of the City of Anaheim.
6. That the trafflc generated by the proposed uce ~•rill not impose an undue
burden upon the streets and highways destgned and improved to carry the traffTc in
the area.

opposition; and that no correspondence a~as received tn opposition to the sub.iect

representat ve has determ ned tnat the proposed project falls rrithin the definition
of Categorica) Exemptlons~ Class 1~ as defined in Paragraph 2 of the City of Anaheim
Environmental Impact Report fuidelines and is~ therefore~ cate~ortcally exempt from
the requirement to prepare an EIR.
NOW~ THEREFORE, BE IT RESOLVED that the Anaheim City Planninq Commission
does hereby grant subject Petition for Conditional Use Permit, uoon the foilowing
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general ~.~elfare of the
Citizens of che City of Anahetm:

find and dstermine that the adoption of tfiis Resolutlon is exp~essly predicat~d upon
appitcant~s compitance with each and ail of the conditlons hereinabove set forth.
Should a~ condttFo~~ or any part thereof, he decl~red invalid or unenforceable by the
final Judgment of a~~y court of competent Jurisdiction. then this Resolution, and any
approvats hereln contai~ed, sha11 be deemed nuil and void.
