WHEREAS, the City Planning Commission did schedule a public hearing at the
City Hail in the City of Anaheim on November i7, i980~ at 1:30 p.m., notfce of said
public hearing having been duly given as required by law and in accordance with the
provisione of the Anaheim Municipal Code, Chapter 1$.03, to hear and consider
evidence for and against said proposed variance and to investigate and make findings
and recommendations in connection therewith; said public hearing havtng been
continued to the Planning Commission meeting of December 1, 1980; and
WHEREAS, said Cortmission after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at satd hearing, does find and determine the following facts:
1, That the petitioner proposes a waiver of the following to establish two
lots:
(a) SECTION 18.21.061.010 - Minimum lot area.

2. That the above-mentioned waivers are hereby granted on the basis that
the petitioner demonstrated that a hardship exists due to ,*he shape of the property
and denial wou)d deprive subject property of a privile~e enJoyed by other properties
tn the same zone and vicinity.
3. That there are exceptional or extraordinary circumstances or condttions
epplicable to the property involved or to the intended use of the pro^erty that do
not apply generally to the property or class of use in the same vtcinity and zone.
4. That the requested variance is necessary for the preservation and
enJoyment of a substantial property right possessed by other property in the same
victnity and zone, and dented to the property in question.
5. That the requested variance wi11 not be materially detrtmentai to the
public welfare ar injurious to the property or improvements in such vtcintty and zone
tn which the property is located.
6. That no one indicated their presence at said public hearing in
apposition; and that no correspondence was received in opposition to the subject
petitlon.
ENVIRONMENTAL iMPACT FINDING: That the Anaheim City Planning Commission has
reviewed the proposal to establish a taro-lot subdivision wtth waivers of mfnimum loC
area and minimum rear yard setback on an trregularly-shaped parcel of land consisting
of approximately 17,0 acres~ located approximately 300 f~et south of Orangewood Avenue
between Manchester Avenue and Learis Street, having approximate fr~ntages of 500 feet
on the southwest side of Manchester Avenue and 690 feet on the east side of Lewis
Street (2303 South Manchester Avenue); and does herehy approve the Negative
Declaration from the requirement to prepare an environmental impact report on the
basis that there would be no stgnificant tndivtdual or cumulative adverse
environmental impact due to the approval of this Plegative Declaration stnce the
Anaheim General Plan designates the subject property for medium-density land uses
cortmensurate with the proposat; that no sensitive environmental impacts are involved
fn the proposal; that the Initial Study submitted by the petitianer indicates no
significant individual or cumu)ative adverse environmentai impacts; and that the
Negative Deciaration substantiating the foregoing findings is on fite in the City of
Anaheim Planning Department.
NObI, THEREFORE, DE IT RESOLVED that the Anaheim City Planning Ccmmisston

are here:~~ Found to be a necessary prerequisite to the proposed use of the subject
property t^: order to preserve the safety and general welfare of the Citlzens of the
City of Anaheim:
1. That subject property shall be developed substantially in accordance
with plans and spec(ficatlons on ftle with the Ctty of Anaheim marked Exhibit Nos. 1
through 3.
2, That upon the sale of either parcel, the property o~vn~rs shall both
enter into a reciprocal parking agreement.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoptton of this Resotution is expressly predicated upon

applicant's compliance with each and all of the condi~tons hereinabove set forth.
Should any such condition, or any part thereof~ be declared invalid or unenforceable
by the finai judgment of any court of competent jurisdiction, then this Resolution~
and any approvals herein contained, shall be deemed null and void.
