WfIEREAS, the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on December 1, 1980, at 1:3~ p.m., notice of said
public hearing having been duly given as required by lao-~ and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 1$.03, to hear and consider
evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations En connection therewith; said public hearing having
been continued to the Planning Commission meeting of December 15, 1980; and
WHEREAS, satd Commission after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use
permit is authorized by Anaheim Municipal Code S~ction 18.41~.050.160 to wit: to
permit a 73-unit motel with waivers of:

2, That the requested waivers are hereby granted on the basis that denial
would deprive subject property of a privilege enjoyed by other properties in the same
zone and vicinity, and on the basis that even though adjacent property to the north
of subject property is zoned RS-A-~+3,000, it is designated on the Anaheim General
Plan for medium-denstty residential or general commercial land uses and will
ultimately be developed as a use other than singie-family residential.
3. That the proposed use is hereby granted on the basis that the
petitioner stipulated at the December 1~ 1980! publtc hearing, to providing fire
sp~inkler systems (n all units with kitchennettes and smoke detectors in each unit.
4. That the proposed use will not adversely affect the adjointng land uses
and the growth and development of the area i~ which it is proposed to be located.
5. That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health~ safety, and general welfare of the Citizens
of the City of Anaheim.

6. That the granting of the Conditional Use Permit under the conditions
imposed, if any, wili not be detrimental to the peace, heaith, safety and general
welfare of the Citizens of the Clty of Anaheim.
7. That the traffic generated by the proposed use wi)1 not impose an undue
burden upon the streets and higharays designed and improved to carry the traffic in
the area.
8. That one person indicated their presence at saPd public hearing in
opposition; and that no correspondence was received in opposition to the subject
petition.
ENVIRONMENTAL IMPACT FINDiNG: That the Anaheim City Planntng Commission has
reviewed the proposa to permit a 73-unit motel with watvers of maximum structural
height and minimum landscaped setback on an irregularly-shaped parcel of )and
consisting of approxjmately 1.06 acres, having a frontage of approximately 175 feet
on the east side of Beach Boulevard, having a maxlmum depth of approximately 275 feet
and being located approximately 1150 feet north of the centerline of Ball Road; and
does hereby approve the Negative Declaration from the requirement to prepare an
environmenta) impact report on the basts that there would be no significant
individual or cumulative adverse environmental impact due to the approval of th;s
Negative Declaration since the Anaheim General Plan deslgnates the subject property
for medium-density residential or general commercial land uses commensurate wtth the
proposal; that no sensitive environmental tmpacts are involved in the proposal; that
the Initial Study submitted by the petitioner indicates no sfgntficant indivldual or
cumu)ative adverse environmental impacts; and that the Negative Declaration
substantiattng the foregoing findings is on file in the City of Anahelm Planni~g
Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Ctty Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
Q` the subject property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That trash storage areas shall be provided in accordance with approvad
plans on file with the Office of the Executive Director of Public Works.
2. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Ftre Department prior to cortmencement
of structural framing,
3. That fire sprinklers shali be installed in all kitchen ef¢fciency units
and smoke detectors sha11 be instailed in all units.
4. That the owner(s) of subJect property shall submit a letter requesting
the termination of Variance Nos. 2293 and 2245 to the Planning Department.
5. That a 6-foot high masonry wall shall be constructed along the south
and east property lines and the easterly portton of the nortli property ltne abutting
RM-1200 zoning.

6. That subject property shall be developed substanttally in accordance
wlth plans and specifications on file with the City of Anaheim marked Revisicn Plo. 1
of Exhibit Nos. 1 through 4; provided; however, that kitchen efficiency units may be
instalted in no more than 25$ of the units~ with a maximum of 6-cubic foot
refrigerators; two-burner stoves, excluding oven and baking faciltties; and single
compartment sinl<s; except that the manager's un3t will be allowed to have full
kitchen facilities.
7. That any parking area lighting proposed shall be down-lighting of a
maximum height of 12 feet, which lighting shall be directed away from the north, east
and south property lines to protect the adjacent residential uses.
8. That Condition Plo, k, above-mentioned, shall be complied wtth prior to
the commencement of the activity authorized under this resolutton, or prtor to the
time that the building permit is issued, or wlthin a period of one year from date
hereof, whichever occurs first~ or such further time as the Planning Commission may
9~ant.
9. That Condition Nos. 1, 3, 5, 6 and 7, above-menttoned, shall be
complied wlth prior to final building and zoning inspecttons.
BE ~T FURTHER RESOLVED that the Anaheim City Planning Commtsston does hereby
find and determine that adoption of this Resolution is expressty predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Should any such condition, or any part thereof, be declared invalid or unenforceabie
by the final judgment of any court of competent jurisdiction, then this Resolution,
and any approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is stgned and approved by me this 15th day of
