WHEREAS, the Anaheim City Planning Commission did receive a verified
petition for Reclassification from GERARD F. WARUE A~~U JOYC[ M. ~lARDE, et al, 1+334
East La Palma Avenue, P,naheim, California 92807, owners of certain real property
situated in tfie City of anaheim, County of Orange, State of California, described as:

acres of the Southeast quar[er of the Soutfnaest quarter of Section
20. Township !~ Soutli. Range 10 West, Rancho Los Coyotes, City of

WHEREAS, the City Planning Commission di~i hold a public heariny at the Givic
Center in the City of Anaheim on December 15, 19£3~, at ~:3n r,m., notice of said
public hearing having been duly given as required by law and in accardance with the
provisions of the Analieim Municipal Code, Chapter 1~,03, to hear and consider
evidence for and against said proposed reclassification and to investigate and make
findinys and recommendations in connection thereriith; and
WfiEREAS, said Commission~ aftcr due inspection, investigation and study made
by itself and in its behalf, and af[er due consideration of all evidence and reporCs
offered at said hearing, does find and de[ermine tlie following facts:
1. That the petitioner proposes reclassification of subject property from
the RS-7200 (Residential, Single-Family) Zone to the Rtl-30~~ (Residential~ Mul;:ple-
Family) Zone.
2. That the Anaheim Gencral Plan designates subject property for low-
medium density residential lan~ use.

3. That the ~~roposed reclassification of subject property is not necessary
or desirable for the orderly and pr~per development of the community at this time and
as specifically proposed for development.
4. That the proposed reclassification of sub.ject property at this tir~ie
does not properly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and their permitted uses
generally established throughout the community.
5. That three (3) persons indicated their presence at said public hearing
in opposition to the specific derelopment proposed; and that no correspondence was
received in opposition to the subject petition.

reviewed the proposa to reclassi y subject property from the RS-7200 (Residential,
Single-Family) Zone to the Rf1-3(1(~ (Residential, Multiple-Family) Zone to construct a
one-lot, I1-unit condominium subdivision o-ritfi ~oaivers of mininum lot area per
dwelling unit, maximum structural height, maximum site coverage, minimum landscaped
setback, minimum recreational-leisure area and minimur,i number of parking spaces on a
rectangularly-shaped parcel of iand consisting of approximately Q.G~E acre located at
the northeast corner of Y.atella qvenue and Dallas Drive, having frontages of
approxirwtely 190 feet on the north side of f:atella Avenue and 170 feet o~ the east
side of Dallas Drive (2035 West Katella Avenue); and does hereby approve the tJegative
Declaration fron the requirerwnt te prepare an environment~l inpact repart on ihe
basis that there v~ould be no si9nifican[ individual or cumulative adverse
environmental impact due [o the approval of this Negative Declaration since the
Anahcim General Plan desi9nates ttie subject ~roperty for low-mediur~ densi[y land uses
commensurate with the proposal; that no sensitive e~vironmental impacts are involved
in thc proposal; that the Initial Study submitted by the petitioner indicates no
siynificant individu~l or cumulative advers~ environmental impacts; and that the
Negative Declaration substantiating tfie forer~oing finciings is on file in the City of
Anaheim Planning Department.
