WHEREAS, the City Planning CorcTi,sion did hold a public hearing at the City
Hall in the City o` Anaheim on February ~5, t°0~, at 1:3~ p.n., notice of said public

provisions of the Anaheim Municipal Cod~, Chapter 1'3.~3, to hear and consider
evidence for and against said proposed conditional use oermit an.l to investigate and

WHEREAS, said Corunission, aftcr d~e inspectiu~~ investigation and study made
by itself and in its hehalf, and after due consider~tion of all evidence and reports
offered at said hearing, does `ind and determ~ne [he foilo~•:ing facts:
1. That the proposed use is properly one for ~•~hicli a conditional use
permit is authorized by Anaheim !lunicipal Code Section 1~.(~1.~50.~7~ to wit: to
permit an automotive and marine repair shop in t'ie ML (Industriil, Limit~d) Zone.
2. That the proposed use is hereby granted subject to the petitioner's
stipulation that all worF: will be conducted v~holly inside the structure and there
will be no outdoor storage of any kind.
3. That tl~e proposed use a~ill not adversely affect the adjoining land uses
and tlie 9rowth and ~levelopment of the area in ~rhich it is proposed to be located.
!~. That the size and shape of the site proposed for the use is adequate to
allotv the full development of the pro~osed use in a manner not detrimental to the
particular area nor to the peace, health~ safety~ and general welfare of the Citizens
of the City of Anaheim.
5. That the granting of the Conditional Use Perr~it under the eonditions
imposecl, if any, tiaill not he detrimental to the peace, health, safety and 9eneral
welfare of the Citizens of the City o` Anaheim.
G, That the traffic generated by the proposed use will reot impose an undue

appror.imately 0.3~ acre located at the northi~~est corner of Pacifir_o n~~ ~,~;,~ and Santa
Cruz Street, havinc~ a frontaye of appror,imately 1~~~ fect on LI ~rth side of
Paeifico Avenue and a frontage of aporoximately 12~ feet on the v~est s:~e of Santa
Cruz Street; and docs herchy approvc the Negative Jeclaratio~ from th~ requlrement
to prepare an environmental impact report on the basis t!iat there ~aould be no
signifieant indfvidual or eumulative adverse environnental inpact due to the approval
of this Flegative Declaration since the /lnahein ~enerai Plan desi~nates the subject
property for general industriai la~d uses commensurate t•~ith the proposai; that no
sensitive environmental ir~pacts are involved in the oroposal; that the Initial Study
Submitted Ly the petitioner indicates no significant individual or cumulative
adverse environmental impacts; and that the .'legative Declaration suhs[antiatiny the
foregoing findings is on file in the City of Anaheim Plannin9 ~e~artnent.
PI061, TNEREFORE~ BE IT P,ESOL!~ED that the Anaheim City Plannina Co~mtssfon
does hcreby grant subject Petition for Conditional Use Permit. upon thc following
conditicns which are hereby found to be a necessary prerea~iisite to ihe proposed use
of the subject property in order to preserve the safe[y and general :•~elfare of the
Citizens of the City of Anahein:
1, That appropriate viater assessnent fees as detr.rmined by Che Office of
Utilities General Hanager shall he paid to the City of Anaheira prior to thc issuance
of a bui~ding permit or prior to comnencement of the activity herein approved,
whichever occurs first.
2. That the oamer(s) of subject property snall pay the trdffic signal
assessment fee (Ordinance r~o. 3°~6) in an amount as detPrmined hy thr_ City Council,
for industrial buildings prior to the issuance of a building permit or prior to
cortmencement of the activtty herein approved, ~vhichever occurs rirst.
3. That the oroposed automotive and marine repair shop shall comply ~•~ir.h
all signtng require~ents of the ML (Industrial, Limited) zoning.
G, That subject property shall be developed substantially in accordance
with plans anc, specifications on file i•~ith the City of Anaheim marF;ed Exhibit 'Jos. 1
and 2.
5. That all mechanical and repair work shall be conduct~d wholly inside
the building and that there shall be no outdocr st~raae of any F:ind.
BE IT FURTHER RESOLVED that the Anahein City Planninc~ Cor+mission does hereby
find and determine that adoption of this P,esolution is expressly predicated upon
applicant's comp!iance ~•ritf~ each ~nd all of the conditions hereinabove set forth,
Should any such condition, or any part thereof, be declared invalid or unenforceable
by the final judgnient o` any court of c~mpetent jurisdiction~ then this Resolutton,
anci any approvals herein contained, sh~ll be deemed null and void.
