WHFRE/1S, the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on Fehr~ary 25, 1~80, at 1:30 p,m., notice of said
public hearing having been duly given as required by law and in accorda~ce with the
provisions of the Anaheim t4unicipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed reclasstfication and to investigate and make
fin~lings and recommendations in cornection therewitli; said public hearin9 having been
continued to the Planning Commission meeting of Narch I~, 19~i0; and
41HEREAS, said Commission after due inspection, investigation and study made
by itself and in its behalf, and after due c~~sideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the petitioner proposes r?classification of subject property from
the RS-~200 (Residential, Single-Family,l Zone to the Rfi-12~0 (P,esidentlal, Multiple-
Family) Zone.

2, That the Anahefm General Plan designates suhject property for low
and/or ~ow-medium density residential lan~ uses.
3, That the proposed reclassificati~n of subject praperty is necessary
and/or desirable for the or~erly and proper development of the community.
4. That the proposed reclassification of subject property does properly
relate to the zones and tlieir perrnitted uses locally estahlished in close oroximity
to subjcct property anc! to the zones and their permitted uses aenerally established
throughout the community.
5. That the proposed reclassification of suhject property requires the
dedicatton and improvement of abutting streets in accordance ~•,ith the Circulation
Element of the General Plan, due to the anticipated increase in traffic wh~ich will be
generated by the intensification of land use.
6. That three (3j persons indicated their presence at said public hearing
in opposition; and that no correspondence 4l35 received in ooposition to the subject
petition.
FP~VIRONMEiJTAL IMPACT FI~lDIN~: That the Anaheim City Planning Commission has
reviewed the proposal to reclassify subject property from thc RS-72~(! (Residential~
Single-Family) Zone to the RM-1200 (P,esidential, ?lultiple-Fanily) Zone to c~nstruct a
20-unit apartmen*. complex on an irregularly-shaped parcel of land consfsting of
approximately 1.0 acre located at the southeast corner of P,elmont Avenue and East
Street and havin9 approximate frontages of 175 feet on the east side of East Street
and 305 feet on the south side u` Belmont Avenue; and does hereby approve the
Negative Declaration from the requirement to prepare an environmental impact report
on the basis that there would be no sign(ficant individiaal or cumulative adverse
environmental impact due to the approval of this Negative Declaration since the
Anaheim General Plan designar.es the subject o~operty for low and/cr low-medium
denstty residential land uses comr~ensurate ~-iith the proposal; that no sensitive
environmental im~acts ar= lnvo)ved in the prcpos„1; [liat the -nitiai Study submttted
by the petitioner indicates no significant individual or cumulative adverse
environmental impacts; and that the Negative Declaration substantiatina the foregoing
findings is on file in the City of Anaheim (~lanning Department.
NO'~l, TH[REFORE, l3E IT RtSOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Reclassification and, by so doing, t:iat Title
18-Zoning of the A~.aheim Municipal Code be amended to exclude the above-described
property from the RS-7200 (RESID[NTIAL, SItJGL[-F/1"11LY) ZONE and Co incorporate said
described property into the Rh1-12~0 (RESIDENTIAL, F1lJI.TiPLE-F1IHILYj ZOPIE upon the
followinq conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and general welfare
of the Citizens of the City of Anaheim:
1. That tlie owner(s) of subject property shall deecf to the City of Anaheim
a strip of land 40 feet in wl.ith from the centerline of the street along Fast Street
for street widening purposes.
2. That street lighting facilities along East Street and L~elmont Avenue
shall be installed as required 6y the Office of Utilities ;eneral Manager, and in
accordance with specifications on file in the Office of Utilities General 4anager;

and/or that a bond, certificate of deposit, letter of crediC, or cash, in an amount
and form satisfactory to the City of Anahcim shall be posted with the City to
guarantee the installation of the above-mentioned requlrements prior to occupancy.
3. That the o~~rn~r{s) of subject property shall pay to the City of Anaheim
a fee, in an amount as determined by the City Council, for tree planting rurposes
along Belmotit A~ienue.
4. That trash storag~ areas shall be provided in accordance o-~ith approved
plans on file wlth the Office of the Executive Dlrector o` Public Worl;s.
5. That subject property shall be served by underground utilities.
6. Thal drainage of subject property shall be disposed of in a manner
satisfactory to the City Engineer.
7. That the oom er of suhject property shall pay to the City of Anaheim the
appropriate park and recreation in••lieu fees as cietermined to be appropriate by the
City Council, said fees to be paid at the time the huilding permit is issued.
8. That the existin~ public utilities easement on subject property be
abandoned and relocated to the sa~isfaction of the Office of Utilities General
Manager.
9. That subject property shall be devc:'ooed substantially in accordance
with plans and specifications on fite ~•:ith the City of Anahein marl;ed Exhibit Nos. 1
through 7.
10. That the driv~ways to depressed parl;ing areas shall comply with City of
Anaheim Standard Detail Plo. 121,
11. Prior to the introduction of an ordinance rezoning subject oroperty,
Cortditior Mos. 1, 2 and 3, above-mentioned, shall be completed. The provisions or
rights granted by tf~is resol~tion shall become null and void hy action of the
Planning Cor~mission unless said conditions are complied 4rith within one year from the
date hereof, or such further time as the Planning Corumission may grant.
12. That Condition No. :;, above-mentioned, shall be comp)ied with prior to
the commmencement of the activity authorized under this resolution, or prior to tl~e
time that the building permit is issued, or o-~ithin a period of one year from date
hereof, whichever occurs first, or such further time as the Planning Commission may
grant.
13. That Condition Nos. 4~ 5, 6, 9 and 10, ahove-mentioned, shall be
complled with prior to final building and zoning inspections.
14. That the orm er(s) of subject property shall pay the traffic signal
assessment fee (Ordinance No. 33~G) in an amount as drtermined by the City Council,
for each new do-~elling unit prior to the issuance of a huilding permit.
15. That appropriate :aater assessment fees as determi~ed by [he Office of
the Utilities General Manager shall be paid to the City o` Anaheim prior to the
issuance of a building permit.

find and determine that aduption of this Resclution is expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Should any such condition, or any part tliereof, be declared invalid or unenforceable
by the final j~~dgment of any court of competent jurisdiction, then this Resolution,
and any approvals herein contained, shal) be deemed null an~1 void.
