A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR VARIANCE NO. 1314 BE GRANTED, IN PART,
SUPERCEDING RESOLUTION NO. PC76 -267, TERMINATING ALL PROCEEDINGS
WHEREAS, on December 19, 1960, the Anaheim City Planning Commission did
receive a verified petition from the owner of a certain parcel of real property
situated in the City of Anaheim, County of Orange, State of California, described as:
That portion of the Southeast quarter of Section 22, Township 4
South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana,
as shown on a map recorded in book 51, page 10 of Miscellaneous
Maps, records of Orange County, California, described as follows:
Commencing at the Southwest corner of said Southeast quarter of
Section 22; thence North 675 feet along the West line of said
Southeast quarter; thence East 833.51 feet parallel with the South
line of said section to the Northeast corner of land described in
the deed to Alwyn 5. Jewell and wife, recorded on October 5, 1959
in book 4912, page 102 of Official Records, being the true point
of beginning; thence South 0° 16' 30" East 675.11 feet to the
Southeast corner of said land of Jewell, being a point on said
South line; thence East to the East line of the West 1320.00 feet
of said Southeast quarter; thence North 675 feet along said East
line; thence West 486.49 feet, more or less, to the true point of
beginning.
WHEREAS, the petitioner requested a waiver from Section 18.16.010 pertaining
to permitted uses of "RS" (Residential /Agricultural) property for any C -1,
Neighborhood Commercial, use for bars, cafes, and restaurants with dancing and
entertainment, for studios, except motion picture and television broadcasting
studios, and for motels and auto courts; and
WHEREAS, the requested variance was granted, subject to conditions, to
permit the following uses on the entire subject property: business and professional
(except real estate) offices, drug stores, pharmacies, restaurants and cocktail
lounges (developed in accordance with floor plans submitted to and approved by the
City Council), flower shops, beauty shops, barber shops, retail dry cleaning -
laundry agencies, tailor shops, telephone answering services, book and stationery
stores, specialty gift shops, tobacco shops, photo shops, shoe repair shops, clothing
shops, toy shops, hobby shops, interior decorator's studios, medical and dental
centers, banks diagnostic laboratories, bakeries, television studios and radio
studios, and studios related to permitted uses.
WHEREAS, on December 27, 1973, the City Planning Commission adopted
Resolution No. PC76 -267 terminating all proceedings in connection with Variance No.
1314 at the request of one of the property owners since they did not intend to
exercise the uses; however, a 1.03 acre portion of the site included in Variance No.
1314 had already been developed for commercial uses and should not have been included
in the termination request.
WHEREAS; on March 10, 1979, the property owner of the aforementioned 1.03
acre portion of the site included in Variance No. 1314 mistakenly included in the
PC80 -51
termination resolution requested that said resolution be corrected to delete his 1.03
acre portion from the termination action, thereby re- establishing the variance on
said 1.03 acre portion, described as:
That portion of the Southeast quarter of Section 22, Township 4
South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana,
as shown on a map recorded in Book 51, page 10, Miscellaneous
Maps, records of Orange County, California, described as follows:
Commencing at the southwest corner of said Southeast quarter;
thence N 675.00 along the west line of said Southeast quarter;
thence East 833.51 feet parallel with the South line of said
Southeast quarter; thence South 0 16' 30" East 675.11 feet to the
true point of beginning, said point being also the southeasterly
corner of the land described in Deed to Alwyn S. Jewell and
Lucille G. Jewell recorded October 5, 1959 in Book, 4912, page 102,
Official Records; thence North 0° 16' 30" West 360.00 feet along
the easterly line of said land; thence East 150.00 feet parallel
with the southerly line of said Southeast quarter; thence South O
16' 30" East, 360.00 parallel with said easterly line of the land
conveyed to Jewell to the southerly line of said section; thence
West along the southerly line of said section 150.00 feet to the
true point of beginning. Excepting therefrom the southerly 60.00
feet thereof lying within ICatella Avenue.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for re- establishing the 1.03 acre portion of
Variance No. 1314.
THE FOREGOING RESOLUTION is signed and approved by me this 10th day of
March, 1980.
