PC3~-7o ~ 41NEFEAS, the City Planning Commission did hold a public heariny at the City Nall in the City oi Anaheim on ~pril 1_1, 1~30, at 1:3~ p.m., notice of said public hearing having been duly given as required by lai•~ and in accordance with the provisions of the Anaheim Hunicipal Code, Chapter i~.n3, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection there~•iith; and WNEREAS, said Commission, after due inspection, investigation and study made by itself and in its hehalf, and after due consideration of all evidence and reoorts offered at said hearing, does find and determine the follo~•~tng facts: 1. That tlie proposed use is properly one for rlhich a conditional use permit is authorized by Anaheim hlunicipal Code Section 1°.~F5.050,tfn to wit: to permit a motel in the CG (Commercial, Genera',) Zone. 1_. That the prorosed use t,i~il not adversely affect the adjoining land uses and the growth and development of the ~rea in rrhich it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of Yhe pro~osed use in a manner not detrimen*_al to the particular area nor to the peace, health, sarety, and general ~•~elfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, wi)1 not be detrimental to the oeace, hPalth, safety ancl general welfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the propos?d use arill not impose an undue burden upon the streets and highways designecl and improved to carry the traffic in the area. 6. That no one indicated their presence at said public hearing in o~~osition; and ±hat no corres~ondence was received in upposition to tne subject petition. EMVIRONMENTAL IMPACT FINDIMG: ihat the Anaheim City Planning Commission has reviewed the proposal to permit a motel in the C~ (Commercial, General) Zone on an irregularly-shaped parcel of land consisting of approximately 1.12 acres located at the southeast corner of Harbor Boulevard and 41ill;en 41ay, having a frontage of approximately 372 feet on the south side of bJilken !•lay and a frontage of 115 feet on the east side of Harbor Boulevard; and does hereby appr~~ve the Negative Declaration from the requirement to prepare an environmental im~~act report on the 6asis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Plegative Declaration since the Anaheim General Plan designates the subject property for generai commercial land uses commensurate with the prop~sai; that no sensitive enviranmental impacts are involved in the proposal; that ttie Initial Study submitted by the petiti~ner indicares no sianificant individual or cumulative adverse environmental inioacts; and that the Plegatlve Declaration substantiatinq the forecloing fin~itngs is on fil~ in the City of Anaheim Planning Department. hJ01•!, THEREFORE, [3E IT RESOLVFD that the Anaheim City Planning Commtssion does hereby grant subject Petition for Conditional Use Permit, upon the follo~~ing -~- PCB~-70 conditions a~hich are hereby fnund to bc a necessary prerequisite to the prooosed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1, That trash storage areas shali be provided in accorclance o-rith approved plans on file 4rith the Office of the Executive ~irector of Public l~lorNs. 2. That flre hydr~nts sliall !~e installed ancl charged as required and determined to he necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That drainage of subject property shall be clisposed of in a manner satisfactory to the City Engineer. 4. In the event that suhject property is to be dt,rided for the purpose of sale, lease, or financ~ng, a parcel map, to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 5. That the o~~:ner(s) of subject property shall pay the traffic signal assessment fee (Ordinance ~lo. 38~G) in an amount as determineci by the City Council, for commercial buitdings prior to tha. issuance of a building permtt. 6. That the proposed motel shall comply o-~it5 all signing reqiiirements of the CG (Commercial, Generai) and CH (Comm~rcial, Heavy) zoning. 7. That subject property shali be develoned substantially in accordance with plans and specifications un file o~ith the City o` Anaheim marked Exhibit ~os. 1 through 3; an~I provided; ho~~iever, that kitchen efficiency units may be installed in no more than 25~ of the units, a~ith a naximum of h-cubic foot refrtgerators; two- burner stoves, er,cluding oven and baking facili,*.ies; and single compartment sinks; except that the manager's unit ~~ill be allowed to have full l:itchen facilities. 8. That Condition ~Jos. 1, 3, f~ and 7, above mentioned, shall he complied with prior to final building and zonina inspections. 9. That the exi~tino service station and under•groiind storage tanks shall be removed prior to the issuance of building permits. EE IT FURTHER RESOLVED that the Anaheim City Planning Comnission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's comptiance ~aith each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgmeRt of any court of competent jurisdiction, then this Resolutlon, and any approvals herein contained, shall be deemed null and void.
