WHEP,;.AS, the Anaheim City Planning Commission did receive a verified
petition for Rec~assification from JAHES E. HUPIDLEY A~ID LOIS A HUtlpLEY, 930 South
Placentia Avenue, Suite A, Placentia, California ~3,'.~7~, owne.rs of certain real
property situated in the City of Anaheim, County of Orange, State of California,
described as follo~•rs:
Lots 3 and !~ of Tract 255 of the East Anaheim Suhdivision as shown
~n a map recorded in book 1~!, page 25 of Miscellaneous ~Maps,
records of Orange County. EXCEPT TIIEREFRl1M the ~lesterly 5 feet of
each lot.
WHEREAS, the City Plannin9 Cor~mission did holci a public hearing at the City
Hall in the City of Anaheim on June 16, 1980, at 1:3~ P.~•, notice of said public
hearing havin9 been duly given as required by lav~ ancl in accordance with the
prov(sions of the Anaheim hlunicipal Code, Chapter 13.03, to hear and consider
evidence for and against said proposed reclassification ancl to investigate and r~ake
findings and recommendations in connectio~ [hereo~ith; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and re~orts
offered at said hearing, does find and deternine the folloi•~ing facts:
1, That the petitioner proposes reclassificatior~ of subject property from
the RS-7200 (Residential, Single-Far~ily) to the CO (Commercial, Office and
Professional) Zone.

commercial-professional land uses.
3. That the proposed reclassification of subject p~operty is necessary
and/or desirable for the orderly and proper development of the community.

relate to the zones and their permitted uses locally established tn close proximity
to subject property and to the zones and their pernittecl uses generally establishe~
throughout the community.
5. That the proposed reclassification of subject property requires the
dedication and improvement of ahuttin9 streets in accordance ~•~ith the Circulation
Element of the General Plan, due to the anticipated increase in traffic ~ahich will be
generated by the intensification of land use.
6. That no o~e indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to Yhe subject
petition.

reviewed the proposal to reclassify suhject prop~rty frori the RS-72~~ (RESIDEtITIAL,
SINGLE-FAMILY) ZOME to the CO (COPiHERiCAL, OFFICE AtID PROFESSIONAL} ZO?1F. to construct
a two-story office building s•rttli ~•~aiver of minimum landscaped setback on an
irregularly~shaped parcel of land consistin9 of approximately 0,5 acre located at the
northeast corner of Center Street and Coffman Street, and having frontages of
approxinately F7 fect on the north side of Center Street and ?0~ feet on the east
side of Coffman Street; and does heref;y approve the "legative Qeclaration from the
requirenent to prepare an environmental impa;,t re~ort on the basis that there would
be no significant individual or cumulative adverse environmental inpact due to the
approval oF tfiis tlegative Dec)aration since tlie Anal~eim General Plan desiqnates the
subject proparty for commercial-professional iand uses commensurate a~ith the
proposal; [hat no sensitive environmental impacts arc involved in th~ proposai; that
the Initial Study submitted by the petitioner indicates no significant individual or
cumulative adverse environmentai impacts; and that the Negative Declaration
substantiating the foregoing fin.~,ings is on file in the Ci*yo uf Ana!~eim Planning
Department.
N01J, THEREFORE. BE IT RESOLV[D that the Anaheim City Planning Commission
does hereby grant subject Petition for P,eclassification and, hy so rfoing, that Title
18-Zoning of [h~ Anaheim ~1unicipal Code be amended to exclude the above-described
property from the RS-7200 (R[SIDEt1T1/1L, SI?JGLE-Fl~~tILY) ZO~fE anci to incorporate said
described property into the CO (COHt1ERCIAL. OFFICE A'1D P?~FFSSInW.AL) ZOtlE upon the
follor~ing conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and gen~ral welfare
of the Citizens of the City of Anaheim:
1. That the u~m er(s) of suhject prooerty shall deed to the City of Anaheim
a strio of land S3 feet in ~~idth from the centerline of the street along Center
Street and a 15 foot property line radius for street t~~idenin~ purposes.
2. That sideiaalks shall he instalied aiong Center Street and Coffman
STreet ~5 re^vireC ';y t4e Clty Lngincer and in aeeordance with sta~dard plans and
speeifications on file in the Office of the City Engineer.
3. That strect lighting facilities along Center Street and Co`fman Str~et
shall be installed as reGuired by the Office of Utilities General Manaqer, and in
accordanc~ with specifications on file in the Office of Utilities General Manager;
and/or that a bond, c~rtificate of deposit, letter of credit, or cash, in an amount
and form satisfactory to t'ie City of /lnaheim sha~l be posted o-~ith the City to
guarantee the installation of the ahove-mentioned requirements prior to occupancy.
4. That the o~:~ner(s) of subject prooert/ shall piy to the City of llnaheim
a fee, In an amount as determined by the City Council, for tree planting purposes
along Center Street and Coffman Street.
5. That trash storage areas shall be provided in accordance ~•~ith approved
plans on file with the Office of th~ Executive Director of Publtc 4lorks.
6. That drainage of subject property shall be discosed of in a manner
satisfactory to the City Engineer.

7. That the o~•mer(s) of sul~ject property shall pay the traffie signal
assessnent fee (Ordinance Plo. 3~~() in an amount as determined hy the City Council,
for commercial buildings prior to the issuance of a huilding pcrmit.
8. That any parF:ing area lighting proposed shall be down-lighting of a
maximum height of 12 feet, ~•rhich lighting shall be directed a4~ay from the property
lines to protect the residential integrity of the area.
9, That subject property shall be cfeveloped sut,stantially in accordance
with plans and specifications on file v~ith ttie City of Anaheim marked Exhibit Plos. 1
through 3.
10. Prior to the introduction of an ordinance rezoning subject property,
Condition Plos. 1, 3 and 4, above-mentioned, shall be completed. The provisions or
rights granted by this resolution shall becone null and void by action of the
Planniny Lommission unless said conJitions are complied with ~~ithin one year from the
date hereof, or such further time as the Pianning Conmission may grant.
11. That Condition Nos. 2, 5, 6, and 9, above-mentioned, shall be complled
with prior to final building and zoning inspections.
BE IT FI!RTHER R[SOLVED that the Anaheim City Plannin9 Cornission does hereby
find and determine that adoptior of t'~is Resolution is expressly predicated upon
applicant's compiiance with each and all of the conditions hereinabove set forth.
Should any such condition, or any part thereor, be declared invalid or unenforceable
by the final judgment of any court of competent jurisdiction, then this Resolution,
and any approvals hercin contained, shall he deemed null and void.
