provisions of the Anaheim Plunicipal Code, Chapter 1'.~3, to hear and consider
evidence for and against said proposed reclassification anci to investigate and make

bY itself and in its behalf, and after due cc~~sideration of all evidence and reports
offered at said hearing, does find and determine the folioaiing facts:
1. That the petitioner propeses reclassification of suh~~ct ~rop^rty fra~
the Rc_n_t~~~^n~ (R~;fder,~ia1/Ayricuituraij lone to the RS-7200 (Residential, Single-
Family) Zone.
2. That the Anaheim General Plan designates subject property for low-
density resiciential land uses.
3. That tfie proposed reclassification of subject property is necessary
and/or destrable for the orderly and proper development of the community.
4. That the proposed reclassification of subject property does properly
relate to the zones and their permitted uses locally established in close proximity
to subject property and to the zones and their permitted uses generally ~~;tabltshed
throughout the community.
~, That the proposed reclassification of subj,ct property requires the
deditation and improvement of abutting streets in accordance with the Circul~:•'~n
Element of the General Plan, due to the anticipated increase in traffic tiahich wii
gener;;ted by the intensificatiun of land use. '

opposition; and that no correspond2nce a~as received in opposition to the subject

E~lVIROtIHEFlT~1L IMPACT FItIDIIJG: That the Anahcim City P1an~ing Commission has
revie;~ed the proposal t~ reclassify subject property from the RS-A-43,~00
(Residential/Agricultur~l) Zone to the RS-72C0 (Residential, Single-Far~ily) Zone to
establish a 2-lot subdivi;ion with a~~iaiver of minimum lot ~~idth on a rectangularly-
shaped parcel of land consistiny of approximately ~.43 acre having a frontage of
approximately 100 `eet on the south side of Orangewood Avenue, having a maximun depth
of lE7 feet and being located approximately ~5 feet east of Della Lane; artd does
hereby approve the ~Jegative Declaration from the requirement to prepare an
environmental impact report on the basis that there aiould be no significant
individual or cunulat ve a-Jverse envirunmental impact due *o the approval of this
Negative DeclaraEion sir.~e the Anaheim General Plan designates the subject property
for lo~~~-densitv residential land uses cormiensurate ~~ith the proposal; that r~o
sensitive environnen:al inpacts are involved :n the proposal; that the Initial Study
submitte~ by tne retitioner indic~tes no significant individual or cumulative
adverse environmental impacts; and that the Plec~ative ~eclaration suhstantiating the
foregoing findings is on file in the City of Anaheim Planning Department.
PJ011, TtIE2EFORE, 6E IT RESOLVEO that the Anaheim City Planning Commission
does hereby grant suhject Petition for P.eclassification and, hy so doing, that Title
13-Zonin~ of the Anaheim Municipal Code be amended to exclude the above-described
property `ron the r,s-n-k3,~00 (RE51UEtd?L4L/A(;P,IC!)LTtJRAL) Z0~lF. and to incorporate said
descri5e~ property into the RS-7200 ;P,ESIDE+JTIAL, 51`I~LE-Fi1MILY) ZOWE upor, the
foltowing conditio~s 4~hich are hereby found to be a necessary prerequisite to the
propesed use of subject property in order to prescrve tiie safety ancl general welfare
of the Citizens of the City of Anaheim:
1. 1'hat the ormer(s) of suEject property shall pay to tFe City of Anaheim
a fee, in an anoun~ as determined by tlie City Council, for tree planting purposes
along Orangewood Avenue.
2. That *hc o~•m er(s) of subject property shall pay to the City of Anahetm
a fee, in an amount as determined by the City Council, for strect li,hting alon9
Orangetaood Avenue.
3. That drainage of subject property shall be disFosed of in a manner
satisfactory to the City Enginer_r,
4. That the owner of subject property shall pay to the City u~` Anaheim the
appropriate park and recreation in-lieu fces as determined to be appropriate by the
City Council, said fees to be paid ai the time the building permit is issued.
5. In the event that subjact propcrty is to l~e <iivided for the purpose of
sale~ lease, or financing, a parcel map, to record th? approved division of su~ject
property shall be submitted to and approveri by the City of Anaheim and then be
record:d in [he office of L•he Orange County Recorcler.
6. That the o~mer(s) of subject property shall pay thc traffic signal
assessment fee (Ordinance (!o. 33~6) in en amount as deternined 6y the City Cou~:cil,
for each new dwelling uniC prior to the issuance of a huilding permit,
7. 7hat street lightin~ facilities along drangeti•iood Avenue shall be
installed as required by the Office of Utilities General Manager, and in accordance
wtth specifications on file in the Office of Utilities General '1~nager; and/or that

a bond~ certificate of deposit, letter of credit, or cash, in an amount and form
satisfactory to the City of Anaheim shall be posted ~•iith the City to guarantee the
installation of the above-mentioned requirements prior to oc~upancy.
~, That appropriate a~ater assessment fees as determined by the Office of
Uttlities General Manager shall be paid to the City of Anaheim prior to the issuance
of a building permit.
o, That subject property shall be developed suhstantially in accordance
wtth p)ans and specifications on file 4~ith the City of AnaSetm marked Exhibit Plos. 1
through 3; provided, hoi>>ever, that the mar.inum huilding height on the two lots shall
not exceed one-story.
10. P~ior to the introduction of an ordinance rezoning subject property,
Condition ~~os• ~, 2 and 7, above-mentioned, shall be conpleterl. The provisions or
~i9hts gr~nted by this resolution sliall becone null and void by action of the
Planning Commissien unless said conditions are complied with ~vithin one year from the
date hereof, or such further time as tlie Planning Commission may grant.

final judgment of any court of competent jurisdiction, then this Resolution, and any
