WHEREAS~ the Anaheim City Plannina Commisston did receive a verif(ed
Petition for Variance from BILL Z. WEHL'NT AND BETTY F, WFHUNT, 2130 West llth Street,
Santa Ana, California 927~3~ owners of certaln real property situated in tiie City of
Anaiieim, County of Orange. 5[ate of Caltfornia, described as:

WHERFJ~IS~ the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on December 1, 1980, at 1:3~ p.m.~ notice of saTd
publtc hearing having been duly given as required by law and in accordance with the
provfstons of the Anahefm Municipa) Code, Chapter 18.03~ to h~_ar and conside-
evidence for and against said proposed variance and to InvestigatP and make ftndings
and recommendations in connection there~•1ith; said public hearing havi~g been
continued to the Planning Commissian meeting of January 12, 1981; and
WHEREAS, said Commisslon, afte~ due inspection, investiqation and study made
by itself and in its behalf, and after due consideration of all e~ldence and reports
offered at said hearing, does find and determine t~ie following fac:s:
1. That the petitioner proposes watvers of the following to construct a 5-

the petittoner did not demonstrate that a hardship extsts due to the stze, shape,
topography o.- i~cation of subJect property.
3. That there are no exceptional or extraordtnary circumstances or
'~ conditions applicable to the property involved or to the Intended use of the property

that do not apply generaliy to the property or class of use tn the same victnity and
zone.
4. That the rzquested variance is not necsssary for the preservation and
enJoyment of a substantial property right possessed by other prapertv in the same
vicinity and zone~ and denied to the property in question.
5. That the requested variance will be materially detrimental to the
public welfare or inJurious to the property or improvements in such victnity and zone
in which the Rroperty ts located.
6. That one person indicated her presence at said public hearing in
opposition; and that no correspondencc was received in opposition to the subJect
petitTon.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Cortimtsslon has
reviewed the proposal to construct a 5-unit apartment complex with waivers of minimum
landscaped setback. minimum distance between buildings. required site screening and
required vehicular access on a rectangularly-shaped parcei of land conststing of
appronimately 7285 square feet located at the northeast corner of Valencia Avenue and
Ctaudina Street (211 East Valencia Avenue); and does hereby approve the Negative
Declaration from the requirement to prepare an environmental impact report on the
basis that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Negative Declaration stnce the
AnaheTm General Plan des(gnates the subJect property for medium-density residential
land uses comnensurate with the proposal; that no sensitive environmental tmpacts are
involved tn the proposal; that the Inttial Study submitted by the petTtioner
indicates no signlficant individual or cumulative adverse environmental impacts; and
that the Negative Declaration substantiattng the foregoing findings is on fite in the
City of Anaheim Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
daes hereby deny subJect Petition far Variance on the basis of the aforementlaned
findings.
THE FOREGOING RESOLUTION is signed and approved by me this 17.th day of
