That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.511 to wit: To permit a metal recycling center in the ML (Industrial, Limited) Zone with waiver of the following. SECTION NO. 18.61.064.020 - MAXIMUM FENCE HEIGHT (30 inches permitted in front setback; 6 feet proposed) 2. That the requested waiver is hereby denied on the basis that the petitioner agreed at the public hearing to submit revised plans, for approval by the City Traffic Engineer and Planning Department, relocating the gate 60 feet from the sidewalk on Miraloma Avenue and relocating the proposed 6 -foot high block wall 50 feet from Miraloma Avenue; thereby deleting the need for said waiver. 3. That the proposed use, as granted, will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use, as granted, is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. PC81 -250 5. That the granting of the Conditional Use Permit under the conditions imposed, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a metal recycling center in the ML (Industrial, Limited) Zone with a waiver of maximum fence height on a rectangularly- shaped parcel of land consisting of approximately 1.7 acres, having a frontage of approximately 265 feet on the south side of Miraloma Avenue, and being located approximately 920 feet west of the centerline of Red Gum Street (2860 and 2870 Miraloma Avenue); and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general industrial land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department.
