CHRISTE~ISEN, 73~ Southern Avenue, Orange, CaliTOrnia 92F~5, owners of certain real
property situated tn the City of Anaheim, County of Oranc~e, State of Callfornia,
described as:
Lo~s 2 and 3 of Tract No. 161E7 as per man recorded in 5ook 87,
Pages 10 to 13 inclusive, of ~1iscellaneous Maps in the office of
the County Recorder of Orange County, CaliFornia.
WHEREAS, the City Planning Commission did hold a puf~lic hearing at the Ci•~ic
Center in the City of Anafieim on April 20, 19f31, at 1:3~ P.m., notice of said public
hearing having been duly given as required by lavr and i~ accordance with the
provisions of the Anaheim tlunicipai Code, Chapter 1`~.~3, to hear and consider
evidence for and against said proposed conditio~al use permit and to investigate and
make findings and recommendations in connection Cf~erewith; and
WHERcFlS, said Cor~mission, after due inspeceion, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearin9, does find and detcrmine the follo~vinq facts:
1, That the proposed use is properly one for which a conditional use
permit is authorized by Anaheim t4unicipal Code Section 1".n~,n30,!11n to wit: to
pernit automohile-related uses with i-~aivers of:

2. That the proposed use in the Rt!-1200 (Residentlal, Multiple-Family)
Zone will not adversely affect Lhe adjoining land uses and the growth and devetopment
of the area in which it is proposed to be located.
3. That the proposed ~daivers are qranted on the basis that the existing
commercial building will bE use~, as is, for the proposed uses.
~E. That. the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare or` the Citizens
of the City of Anaheim.

S. That the granting of the Conditional Use Permit under the conditions

opposition; and that no correspondence ~~as received in op~osi~'^~ to the subject
petition.
ENVIRONMENTAL IMPACT F~MDItlG: That the Anaheim City Planning Commission has
reviewed the proposal to reclassi y subject prooerty from the RM-12np (P,esidential,
Multiple-Family) Zone to the CL (Commercial, Limited) Z~ne to perr~it automobile
related uses with waivers of rinimum landscaped setback ancl require~l site screv_ning
on a rectanguiarly-shaped parcel of land consisting of approximately 0.3 acres
located at the south~~~est corner of Cerritos Avenue and 4/alnut Street, (1200 West
Cerritos A•venue); and does hereby approve the Negative Deciaration from *he
requirement to prepare an environmental impact report on the basis that there would
be no significant individual or cumulative adverse environmental ?mpact due to the
approval of this Negative Deciaration since the Anaheim General Plan designates the
subject property for medium dens,ty residential land uses corrm~~nsurate wtth the
proposat; that no sensitive environmental impacts are invoived in th~, proposal; that
the Initial Study submitted by the petitioner indicates no significant indiv(dual or
cumulative adverse environmental impacts; and that the Negative Declaratfon
substantiating the foregoing findings is on file in t~e City of Anaheim Planr,ing
Department.
NOIJ, THEREFORE, BE 17 RESOLUED that the Anaheim City Pianning Commission
does herehy grant subject Petition for Condition2l Use Permit, upon the following
conditions ~~rhich are hereby found to be a necessary prerequisite to the proposed use

1. That the owner(s) of subject property shall mal<e an irrevocable offer
of dedication to the City of Anaheim for a strip of land ~ES feet in Uiidth from the
centerline of the street along Cerritos Avenue and Walnut Street for street widening
purposes.
2. That the a•m er(s) of subject property shall pay to the City of Anaheim
a fee, in an amount as determined by Che City Councii, for street lighting along
'dalnut Street.
3. That the a.~ner(s) of subject pruoerty shall p:~y to the City or" Anaheim
a fee, in an amount as determined by the City Council, for tree planting purposes
along Cerrltos Avenue and Walnii, Street.
4, That trash storage areas shall be provideci in accordance H~ith approved
plans on file ~•~ith th~ ^ffice of the Executive Director of Puhlic ;Jorks.
5. That *he owner(s) of suhject property shall pay tne traffic slgna~
assessment fee (Crdinance No. 3,°,96) in an amount as determined by the City Council,

for commercial buiidings prior to the issuance of a huiiding permit or nrior to
commencement of the use authorized herein, ~ihichever occurs first.
6, That the existing most northerly drive~~ay on Walnut Street shall l~e
removed and replaced o-~ith a s~andard curh, gutter and sideo-~alk.
7. That the existing underground storage tanks shall be removed nr filled
as approved by the f,ity Fire Department if no retai; sales of qasoline xcurs on the
prem~ses.
8. That the a-rner(s) of subjecC property shall submit a letter to the
Planning Department reques*_ing the termination of Variance ~los. 491 and 196P and
Conditional Use Permit No. 2110.
Q That subject property shall be developed suhstantially in accordance
with plans.and specifications on 'rile ~•iith the City of Anaheim mari<ad Exhibit No. 1.
10, Prior to the introduction of an ordinance rezoninq sub.ject property,
Condition Flos. 1, 2, 3, and 3, ahove-mentioned, shall he comeleteci. The provisions
or rights granted by this resolution sha)1 her.r,me null and void h~~ act?on of thc
Planninq Commission unless said conditions are com~lted ~•~ith ~•~ithin one year from the
date hereof, or such further time as the Planning Commission may grant.
11. That Condttion Mos. 4, 6, 7 and ~, ahove-mentione~f, shall he complied
with prior to fina] building and zoning inspections.
12. That the proposed automohi)e-related uses shall consist of: automobile
rentals, a car wash, automohile s~rvicing and repair, or such other similar uses
•N~hich may be approved by the Planning Commission.
BE IT FUkTHER RES01_VED that the Anaheim City Planning C.ommission does hereby
find and determine that adoption or' this Resolution is ex~ressly predicated upon
applicant's compliance with each and all of the conditions hereinahove set forth.
Should any such condition, or any part thereof, be declared inv~lid or unenforceable
by the final judgment of any court of competent jurisdiction, then this Resolution,
and any approvals herein contained, shall be deemed nuil and votd,
