WHEREAS~ the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from LEASE-ALL LA PALMA, INC.~ 1594 South Anaheim
Boulevard "A", Anaheim, Califorria, 928n5~ o4m er, and TF'E LEAVERTON COMP~NY, 1594
South Anahetm Boulevard "A", Anaheim, California 928~5, agent, of certa~n real
property sltuated in the City of Anaheim, County o` Orange, State of California~
described as:

WHEREAS, the City Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim an Janvary 12. 1481. at 1s;o p.m., notice of satd
public hearing having been duly given as reauired by law and Tn accosdance with the
provisions of the Anaheim Munic?pal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed conditional use permtt and to invsstigate and
make findings and recortmendations in connection therewith; and
WHEREAS, said Commission, after due inspect(on~ investigation and study made
by itself and in its behalf, and after due consideration of atl evidence and reports
offered at said hearing, does find and determine the following facts:
1, That the proposed use is properly one for which a conditiortal use
permit is authorized by Anaheim Muntcipal Code Section 18.61.~50.611 to wit: to
permit an enclosed restaurant o~ith on-sale beer and wine in the ML (Industrial,
Limited) Zorie.
2. That the proposed use is hereby granted for a period of three (3) Years
subject to review for possible extensions of time upon written request from the
petitioner to determtne whether the use has had an adverse affect on surrounding
businesses.
3, That the proposed use will not adversely affect the adJoining land uses
and the gravth and development of the area in which it ts proposed to be located.
4. That the size and shape of the site proposed for the use is adequate to
allow the full deveiopment of the proposed use in a manner not detrimental to the
pa~ticular area nor to the peace, health, safety, and general welfare of the Citizens
of the Cit~~ of Anaheim.
5, That the granting of the Conditional Use Permit under the conditions
imposed, If any. will not be detrimental to the peace. health, safety and general
welfare of the Citizens of the City of Anaheim.

6. That the traffic generateil by the prn~osed us~ wilt not impose an undue
burden upon the streets and high~~ays designed and improved to carry the traffic in
the area.
7. That no one indtcated their presence at said public hearing in
opposition; and that no correspondence was recAived in opposl:ton to the subject
petition.
ENVIROPl11ENTAL ~HPACT FINDIPlG: That the Anaheim C3ty Planning Commission has
reviewcd the proposa to perm t an enclosed restaurant with on-sale keer and wlne in
the ML"(Industrial, Llmited) Zone on an irregulariy-shaped parcel of land consisYing
of approximaiely 5.~ acres ha~•ing a frontage of anproximately 210 feet on the north
side of La Pa;ma Averue~ having a maximum depth of aporoxtmately 650 feet and oeing
located approixmately 675 feet east of the centerlTne of Van Buren Street ('+095 East
La Palma Avenue); and does hereby approve the Ne~ative Deciaratton frcxn the
requirement to prepare an environmental impact report o~i the basis that there would
be no signiflcant individual or cumulative adverse environmental impact due to the
approval of this Nc:gative Declaration since the Anaheim General Plan desTgnates the
subJect property for general industrial land uses commensurate with the proposal;
that no sensitive environmental impacts are involved in the proposal; that the
IniYtal St~dy suhrr,itted by the petitioner indtcates no significant indivldual or
cumulative adverse environmental impacts; and that the 4eqatlve Declaration
substantlating the foregoing findings is on file in the City of Anaheim Planning
Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petit•ion for Conditional Use PermTt, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Citizens of the Ctty of Anaheim:
i. That subject property shall be developed substantially in accordance

and 2.
2. That the proposed use is hereby granted for a period of three (3) years
subject to review for possible extensions of time upon written request from the
petitioner to determine whether the use has had an adverse affect on surrounding
businesses.
BE IT FURTHER RESOLVED that the Anaheim City Planning Canmtssion does hereby
find and determine that adoption of this Resolution is expressly predicat~~~~ upon
applicant's compliance with each and all of the condittons hereinabove set rorth.
Should any such condition, or any part thereof~ be declared invalid or unenforceable
by the ftnal judgment of any court of competent Jurisdiction, ~hen this Resolution~
and any approvals herein contained, shall be deemed null and vold.
THE FOREGOING RESOLUTION is signed and approved by me thts 12th day of
January, 1981.
