WHEREAS~ the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on Fc:hruary ~3, 1982, at 1:3~ ~.m., notice of said public hearing having been duly given as required by laa~ an~f in accordance a~ith the provisions of the Anaheim Municipal Code, Chapter 1S.n3, to hear and consider evidence `or and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and IJHEREAS, said Commission, after due inspection, investi9ation and study made by itself and in its behalf, and af~er due consideration of all evidence and reports offered at said hearing, does find and determine the folloaiing facts: 1. That the petitioner pr~poses reclassification of subject oroperty from the RS-A-~~3,~Q0 (Residential, Agricultural) Zone to thr_ R~~!-3~Q~ (Residential, Multiple-Family) Zone. 2 Tha[ the Anaheim Generai Pian designates subject property for fow- medium densitv residential land uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of *.lie community. 4. That the proposed reclassification of subject property does properly reiate to the zones and their permttted uses locally established in close proximity to s~bject property and to the zones and their permitted u,es generally established throughout the community. 5. That the proposed reclassification of subject property requires the improvement of abutting streets in accordance ~aith the Circulation Element of the General Plan, due to the antictpated increase in traffic which will be qenerated by the intensification of land use. 6. That 1 person indicated their presence at said public hearing in opposition; and that no correspondence i•~as received tn oppo,ition to the subJe~t petition. (Reclassification No. 73-74-3,), NQW, THEREFORE, QE !T RESQL'iED that the Anaheim Ctty Planning Commtssion does hereby grant subject Petition for Reclassification and, hy so doing, t`~at Title 13-Zoning of the Anaheim Municipal Cod~ he amended to excl~ide the above-described property from the RS-A-h3,000 (Residential, Agrlcultural) Zone to the RM-3~00 (Residenttal, Multiple-Family) Zone, upon the following conditions ~•ihfch are hereby found to be a necessary prerequisite to the proposr_d use of s~~hject property 1n order to preserve the safe:y and general welfare of the Citizens of the City of llnaheim: 1. That sidewalks shall be installed .,long Romneya Drtve as required by the City Engineer and in accordance ~~~ith standar~l plans and spectfications on file in the Office of the City Engineer, 2. That the o~vner(s) of sub,ject property shall pay to the City of Anaheim a fee, in an amount as determined by the City Council, for tree planting purposes along Romneya Drive and La Palma Av~nue. 3. That any ~ntrance security gates shall he controlled by a nur~erical sequence reader, as specified by Streets and Sanitation Division of the Pubiic lJorks Department. 4. That trash storage areas shall he provided in accordance ivith approved plans on file with the Office of the Executive ~irector of Public 4dorks. 5. That fire hydrants shall he installed and charqed as required an~1 determined to be necessary hy the Chief of the Ftre Department nrior to commencement of structural framing. 6, That subject propr_rty sliall be served by ~.~nder9rr~und utilities. 7. 'fhat drainage of suhject property shall be disposed of in a manner satisfactory to the City Engineer. 8. That the o~,m er of suhject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determtned to be appropriate bY the Ctty Counctl, said fees to be paid at the ttme the hiiilding permit is fssued, 9. That ali private streets shail be developed in accordance i•~ith the City of Anaheim~s Standard Detail Plo. 1?2 for private streets, including installation of street name signs. Plans for the private street lighttng, as required by the standard detail, shall be suhntttr_d to the Building Dtvision for approval and lnclusion with the building plans ~rior to the issuance of bui)ding permits. (Private streets are thnse ~•~hich provide primary access and/er circulation ~aith-n the project.) 10. That the o~•mer(s) of subject property shall pay to the City of Anaheim a fee, in an amount as determined by the City Council, for street lighting along La Palma Avenue. 13. Prtor to issuance of building permits, the applicant shall present evidence satisfactory to the Chief Builcfing Inspector that the units ~vill be in cenformance o-~itli Ploise Insulation Standards snecified in the California Administrative Code, Title 25. 14. Prior to issuance of building permits, the applicant shall present evidence satisfactory to thc Chief Building Inspector that t!~e proposed pro,ject is in conformance o-rit}i Council Policy Plumber 5i2, Sound Attenuation in Restdential Projects. 15. That subject property shail be developed substantially in accor~ance with plans and specifications on file alith tl~e City of Anaheim marked Exhibit Nos, 1 through 5. 16. Prior to the introduction of an ordinance rezoning subject prooerty, Condition Nos. 2 and 12, ahove-mentioned, shall be completed. The provisions or rights granted hy this resolution shall become null and void by action of the Planning Commi_sion unless satd conditions are complied with within one year from the date hereof, or such further time as the Plannina Commission may grant. 17. That Conditfon ~Jos. 1, 4, ~, 7 and 15, above-menttoned, shall he complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predtcated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition~ or any part thereof, be declared invaltd or unenforceabie by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals I~erein contained, shall be deemed null and vold.
